I know that you don't know exactly what is going on about the Montezuma 
titles.
I was just wondering what was going on since the original Montezuma's 
Revenge was not developed by Utopia and was released before Windows was an 
operating system for PC.

Such the original Montezuma game is theoretically classed as Abandonware.
And I am also not sure what the status of the Montezuma's Return from 1998 
is or was when you got your problems with it.
And even if you got problems or James North could have gotten into problems, 
then the question to ask would have been is the Name protected, or is the 
game and the content also protected.
If just the name and/or character(s) is protected, then you can make Mota 
3d with no problems. But since Mota 3d could be an audio clone of any Tomb 
Raider game, someone might take offense to this while you do not create a 
new Tomb Raider title without permission.
I mean, how many Asteroids and Tetris games or games like the original are 
out there? I also know more than one Pacman game and no one has them thrown 
out of business.
Hell, Phil Vlasak should be in more legal danger than you had been for the 
game concept (not the name) of Monti  for his Sarah game, allthough he did 
not copy an original Harry Potter character, he copied Hogwarts to some 
extend and there are also licensed Harry Potter games and other products on 
the market.

I didn't want to bombard you with questions and I definitely don't want you 
to do work for me.
I just wanted to know since you said you had the option of optaining such 
things had you bought a license for Star Trek games.
And one last thing about sounds and libraries. I do know what 
www.sounddogs.com is for and that some of the greatest and most expensive 
libraries of sounds or production music can be bought there if you have the 
money.
However, there is absolutely no Star Trek related sound information 
whatsoever on that portal which does host libraries from many different 
creators and/or distributors. There are supposedly some Trek related sounds 
(Star Trek Nemesis) in one of the large collections, but Nemesis not 
standard in Trek sounds in comparison to all other Trek movies and shows 
up to the point of the movie's release.
I also can use google to search, but like the situation was when we talked 
about audio game engines namely the GMA engine, there is no sign which says: 
to optain a license for ... contact us at

developer I thought you might be able to direct me to where I could find out

[Audyssey] Castaways upgrade bug in 1.8B

New game, just built my tavern and upgraded my cook and bartender.  When I
upgraded the cook, it told me I'd upgraded the bartender to an innkeeper,
and when I upgraded the bartender it told me I'd upgraded my cook to a chef.

[Audyssey] another possible mota bug

Hi, This is really something I should have reported a while ago 
(I noticed in in beta 18). The bug is that when you're on a 
vanishing platform, and you move to the start or end positions 
(I'm less sure about the former, but I believe it worked) and the 
platform turns off, you don't fall. If you try to move or jump 
straight up, you die but you still have the ability to jump over 
to the ledge on either end of the platform. I do have a recording 
of this if you'd like it. The bug is always consistent.


P.S: if it helps, I'm running windows 7sp1x64.

just up through 30% but the entire histogram.

 

Also, I don't think I've ever seen a report of people eating at the tavern
with the t key.  Has anyone else?

anymore is because a handful of versions ago I drastically shortened the amount 
of time it takes for people to eat while At the tavern.  Because they aren't 
actually in there long, it is less likely you will be checking on the exact 
tick, or ticks, that someone is in there.

Can you be a little more specific about how you'd like the hunger displayed?

If you always have a cook standing by, I think the t key won't be of much 
help to you. If you want to see some1 at the tavern, assign your cook to 
something else and let some people be at the verge of starvation then try 
the t key again. As for the hunger report, you can check each individual 
energy status with g.

Hi Michael,

There is one thing to keep in mind here. Back in early 2008 I myself
didn't know too much about U.S. copyright law so was sort of cowed
into giving up the game without researching it legally first. Since
then I've read up on copyright law and while I'm not an expert on it I
know enough to stay out of trouble now.

What it boils down to is a company can copyright trademarks,
characters, music, sounds, storyline, etc but they can not copyright
an entire idea. So what that means is that Edos Interactive can
copyright a trademark like Tomb Raider because it belongs to a
specific product complete with its own unique storyline, characters,
music, etc. They can copyright the characters for their Tomb Raider
games like Lara Croft because she is a unique and specific character
within that game world. Of course, the artest who compose the music
for the games can copyright that because it was specifically written
and performed for that product. All of these things make up the Tomb
Raider product, and can b be copyrighted based on specifics that make
them unique from other games or products of that type.

What Edos Interactive can not do is hold an exclusive copyright on a
concept like a female archeologist because it is too generic. Author's
like Alex Archer has written a 26 book series called Rogue Angel about
a female archeologist who hhappens to rediscovers Joan Of Ark's magic
sword and uses it to right wrongs and so on. Alex Archers female
archeologist, Onia Creed,  and Edos Interactive's female archeologist,
Lara Croft,  are completely different and each hold separate
copyrights under U.S. copyright law because they are very different
characters. So to come after my lead character, Angela Carter, Edos
Interactive or Alex Archer would have to prove in what way I
infrindged upon Lara Croft or Onia Creed. Which I have not infringed
on either character.

However, I think what happened is by changing the name to Montezuma's
Return I unintentionally atracted the attention of Utopia who had
produced a game titled Montezuma's Return in 1998. The original game,
Montezuma's Revenge, had been published by Parker Brothers in 1984,
and was of course available for download from a number of Atari rom
sites for free. Its quite possible in hind sight had I not changed the
name of the game from Montezuma's Revenge to Montezuma's Return I
wouldn't have landed in hot water. As I don't blame Parker Brothers
for any part of what went down in 2008.

That said, your argument is based on a false asumption. Montezuma's
Revenge was abandonware therefore it is legal to clone it. that's not
true. The way copyright law works regardless of weather or not a
software company supports a game, declares it freeware, abandonware,
whatever does not mean the company does not have any copyright control
over it. Companies can hold a copyright for a product long after the
life time of the original programmers have passed away and most people
have forgotten the product existed. It really is up to the company if
they want to legally protect those copyrights after a certain amount
of time has passed.


For instance, you mentioned a number of classics like Packman,
Asteroids, etc. You are right those are copyrights held by Activision,
but I don't believe Activision really cares about shutting down every
clone  or possible copyright infringement case because they've made
their millions off those games already. If Hasbro wants to create an
electronic handheld Packman game they legally have to licence the game
from Activision, but if a free open source programmer develops a
Packman game for Linux Activision is going to blow it off because
there is no money in suing the developer. The intent to release the
game as freeware and not for commercial gain makes a huge difference
in court cases of copyright infringement.

I understand. I also apologize for being a bit short with you yesterday.

I don't know specifically who creates and sells the Star Trek sounds
but in looking at games like Star Trek Elite Force and Elite Force II
it looks like Activision obtained the sounds from Raven Software. I
don't know if that's who Activision got the sounds from or if Raven
merely got them from someone else. All I can tell you is back when I
was looking to get a legal license for the Star Trek trademark from
Paramount finding out where to purchase and license sounds was one of
the things I was going to ask, but I never got that far. So I created
my own sound library from sounds acquired over the internet and from
other people like Shaun Everest who happend to have a large number of
Star Trek sounds on his computer.

Hi Thomas,
No, actually I was talking to Tom Randall when explaining that
downloading pipe or troopanum is legal, cause he said it is illegal to
get the older version of hunter unless you purchased it. So I had to
do a bit of explaining. Also, noone was passing around montezuma's
revenge. I got a copy of it from an archive of almost all of the
abandoned games. I found the 2 level demo from the alchemy games
directory. He's not passing it around anymore, in fact he wasn't
passing it around. Now would you please give me hunter1.0 and the 7128
gamebook demo? I know you don't have it on your sight, but I still
want the demo. I don't need you to give me the super mariobrothers
game, since I grabbed a copy off of the audiogames.net forum. Also I
would like troopanum1.0. The reason I prefer hunter1.0 is because I
like the small setup files and the unpacking process.

[Audyssey] Some Nujam demonstrations.

   I bet some of you remember this toy. It's a hasbro toy called the NuJam, 
and in my opinion, one of the best electronic toys ever made. Why it was 
discontinued is anyone's guess. If you guys want one, your best bet is to 
ebay them as they're no longer being sold anywhere. I got lucky that I 
managed to get another one to be honest. I had one before and it broke. 
lucky for me, I managed to grab a brand new one on ebay cheaply. Anyhow, the 
first file I'll be sharing is a free jam session. this thing turned out 
quite good I think. If you guys still have this toy, I dare you to try and 
beat my awesome epic jamming session. hahaha. second one is a rhythm jam 
playthrough. you'll have to listen to see how it turned out. there's more to 
this toy, so if you wanna hear more let me know and I'll be happy to upload.

[Audyssey] Moderator: Off Topic Messages

I must once again bring up the painful but somehow ironically recently 
reoccurring subject of off topic messages on list. It keeps being stated, 
reminded, warned etc, and it keeps slipping by the wayside.
The guidelines, and the moderators in person, have clearly stated that all off 
topic messages should be sent to Kevin, Tom and myself for review before 
posting to the Audyssey list, either to our individual addresses, or to us as a

We have already placed one or two people on moderated status for the posting of 
nonapproved messages within the last week and I'm afraid we shall continue to

right? If that's the case then it would be classified as a toy and not

Oh, I see. As for the games you want I can't help you there. I don'
have Hunter 1.0, and I don't think I ever had a copy of Hunter 1.0 to
begin with. As for the 7-128 Gamebook I'd have to ask 7-128 before
handing out the demo as it is deprecated. As it was being sold through
us via partnership with 7-128 I'm not just going to slap up an old
demo without consulting them before hand.

Hi John,

Ok, that's strange. Although, I think I have an idea what is going on.
Problem is that it will be difficult but not impossible to fix.

Basically, when you walk the surface under Angela's feet is updated
according to what is straight ahead. So if Angela is walking a
platform and the next step is a drop off it stops you from moving, but
the surface saved at that location is drop off. Problem is if the
platform vanishes and your surface constant is dropoff instead of
platform Angela won't fall because the surface constant is the same as
the actual position. I'll have to figure out how to rewrite the
walk/run code to correct this behavior.

To be totally honest, I think you're being a bit unfair here. how is this 
toy not classified as a game? it isn't as if I'm playing dolls or something. 
this thing you need to strum, twist the neck etc. also, you get a high score 
at the end of a session. are you saying that just because it is guitar 
shaped and a toy, that it isn't considered a gaming device? so the bop it 
isn't considered a game either, just a toy? how about rock band? you insert 
a disc into the console, but the game is played with instrument-shaped 
controllers. if moderators are going to get all strict about this, then 
there should be some clear definitions of what you guys consider games on 
this list.

Calm down. That's what I'm trying to find out. I have never owned one
of these NuJam toys so I am trying to determine weather it is just a
toy or is a type of game. That's the point of inquary here. You stated
below it has a high score after a session. That would make it more
like a game than I first thought, and no I didn't know anything about
the scoring until you braught it up.


The point I want to make here is the shape of the game has nothing to
do with it. Obviously BopIt and Rock Band have been classified as
games on this list for a long time, and I have personally experienced
both first hand. So naturally i would not restrict talking about them
on list. With your NuJam, however, I confess I don't know anything
about it. I've seen them in stores and had always assumed they were
just a basic toy guitar more or less like any other toy guitar you can
buy from Wal-Mart, K-Mart, whatever. If Im wrong about that I'm
sorry. Excuse my ignorance, but all I want to know from you is in what
way is the NuJam a game and not just a basic toy guitar?

Sorry about that. I got a little defensive. I assumed you already knew what 
the nujam was for some reason. oops. I must've not read your email properly 
or something. Happens on these lists sometimes haha. the nujam is pretty 
much like the bop it, except it's sort of guitar shaped. kinda funny how all 
these electronic toys are similar to each other lol. it has several games, 
one of which you get a list of commands and you need to play it back. if you 
play it in rhythm you get a higher rhythm bonus. which doesn't affect the 
game but it's kinda cool to have anyway. then there's a bop it style game 
where you get 1 command at a time and you must play it back. unlike bop it, 
this toy has some cool modifiers that increase the challenge, such as double 
time for example, which essentially doubles the speed. Let me know if you 
have any more questions.

Calm down. That's what I'm trying to find out. I have never owned one
of these NuJam toys so I am trying to determine weather it is just a
toy or is a type of game. That's the point of inquary here. You stated
below it has a high score after a session. That would make it more
like a game than I first thought, and no I didn't know anything about
the scoring until you braught it up.


The point I want to make here is the shape of the game has nothing to
do with it. Obviously BopIt and Rock Band have been classified as
games on this list for a long time, and I have personally experienced
both first hand. So naturally i would not restrict talking about them
on list. With your NuJam, however, I confess I don't know anything
about it. I've seen them in stores and had always assumed they were
just a basic toy guitar more or less like any other toy guitar you can
buy from Wal-Mart, K-Mart, whatever. If Im wrong about that I'm
sorry. Excuse my ignorance, but all I want to know from you is in what
way is the NuJam a game and not just a basic toy guitar?

a disc into the console, but the game is played with instrument-shaped
controllers. if moderators are going to get all strict about this, then
there should be some clear definitions of what you guys consider games on
