Re: PADV Improving Women's Safety Project

In May 2002, the Improving Women=B9s Safety project, funded through the
Partnerships Against Domestic Violence II, commenced.  The project will run
for a 12 month period (until May 2003) and is designed to develop strategies
that can be used in each state and territory to enable victims of domestic
violence (and their children) to remain safely in their home through the
departure (voluntary) or removal (mandatory) of the perpetrator. This may
involve a range of possible strategies such as providing alternative
accommodation for perpetrators, legislative interventions that require
perpetrators to live elsewhere or support services to improve the likelihood
that perpetrators will remain away from the family home for an extended
period.

A comprehensive website has been set up to provide interested people with
information about the project including its aims, objectives, methodology,
project team, timelines, progress to date and, importantly to provide people
with the opportunity to have their say on this issue.   People can also
register to attend one of the four forums we are holding in each state
(women=B9s issues, perpetrators issues, issues in diverse communities and
legal issues).

Because of the importance of this project (it has the potential to enable
victims of domestic violence to choose to stay in their homes rather than be
forced to leave), we are seeking your assistance and input.

If you, or any of your staff are able to assist us in either of the
following areas, we would be most appreciative:


1. Are you aware of any services, programs, projects or legislation that
work to support/remove perpetrators thus enabling victims to remain in their
homes safely?

1. Are you aware of any documents (eg articles, reports, brochures,
summaries) that may contribute to our understanding of what strategies could
be utilised to enable victims to stay in their homes safely?

TRUST THE WOMEN: WOMEN'S CONSTITUTIONAL CONVENTION

- FINAL DAY PAPERS -

The available papers presented on the final day of the Trust the Women
Convention today are now available on the web site. Additional papers
presented on Day 1 and  2 are also now on the site at:

The Convention finished with a summary of the themes from presentations and
workshops and a number of resolutions. These should be on the web site by
tomorrow night (Friday 14th June).

- DEBATE AND TOUR -

Tonight in Canberra there has been a free public debate at Old Parliament
House. The topic was 'That Women Should Never Have Got the Vote,' with
Rachel Berger.

Tomorrow some delegates are staying in Canberra to take a tour that
includes the National Archives, National Library and Parliament House on
the theme of women's suffrage and women's social and political participation.

- FOLLOW ON COMMUNITY WORKSHOPS -

Many delegates are going back to their communities buzzing with information
and enthusiasm to discuss the issues further.

families, children, women and men. I watch our Government's grinding
approach to assessment of their applications for asylum, and I realise that
our own system is adding to their trauma. If women had an equal place at the
table, things would be different.

We have to negotiate and persuade, manage and deliver, feed and teach every
day, at home and at work, while keeping in mind the big picture of happiness
and health for all. We know about consultation and checking all options
before acting. We're very good at making things work.

There would be no asylum seekers in extended detention; we know what happens
when you do not deal fairly and quickly with issues.

All decisions would consider the future of our families and our planet - a
long-term and broadly based future, rather than one that just gets us past
the next election. Asylum seekers would not be vilified and locked up.

Imagine it is 2006 and Hollingworth's term as Governor-General is over.
Today, a new head of state will be announced. And a man is appointed - for
the 24th consecutive time! People turn to the Women's Electoral Lobby for
comment. We have a strong sense of deja vu but now we ask, Would any woman
want the job?

The governor-general's job is a combination of constitutional, official and
ceremonial duties. If you go to www.gg.gov.au you are told that possibly
the most important role of the governor-general, as the office has evolved
over the years, is to encourage, articulate and represent those things that
unite Australians as a nation.

The head of state has an important role in filling the void created by the
trend towards small government. (Remember the blurring of church and state
in the appointment of the current G-G? And the undermining of the federal
public service in the children overboard crisis?) The position of
governor-general can help to fill a void by mirroring to Australians the
good parts of themselves - the core values of respect for the law, equality,
tolerance, fairness, inclusiveness and respect for indigenous values.

It is likely there are a good number of women willing to commit to this
significant role. The Prime Minister's dismissive statement in 2001 that
there aren't any women suitable for the position defies belief.

The first of the public fortnightly national e-news bulletin following on 
from the conference Through Our Eyes: Legal Needs of Women in Regional, 
Rural and Remote Australia was published on Thursday 15 Feb. 2001.

Put briefly, the Follow On project aims to:

*  promote information flow about legal issues relevant to women to and 
from RRR networks
*  promote networking and the building of links with existing networks and 
organisations
*  increase policy input about the legal needs of women in RRR Australia.

Dear All,

Below is a letter drafted by the Women's Rights Action Network Australia 
(WRANA) concerning the Government's current review of Australia's 
participation in the UN Treaty System. This review process was initiated by 
the Government in response to the adverse findings of the UN Committee on 
the Elimination of Racial Discrimination (CERD) in relation to Mandatory 
Sentencing laws in W.A and N.T.  We are seeking endorsement from women's 
organisations and individual women to demonstrate to the government that 
there is a constituency of concerned women, prepared to engage with this issue.

Please could you send organisational and/or individual endorsements to Di 
Rokvic by 5pm on Wednesday 14th June.  An endorsement form is below.

Dear Mr. Downer,

We are writing on behalf of women's organisations regarding the 
Government's review of the UN Treaty Committee system, announced on 30th March.

As women's organizations, we have always been proud of Australia's 
participation in the development of an international system to enable the 
realization of human rights for all people.  In particular we have welcomed 
the Howard Governments commitment to women's human rights, as evidenced 
through your leadership in the adoption of an ICC Statute which provides 
specifically for the protection of women's human rights; the Government's 
constructive role in the negotiations which led to the adoption of the 
Optional Protocol to CEDAW; and the Governments productive role in the 
current negotiations surrounding the review of theBeijing Plus Five.

We are nonetheless concerned that the current review, and its announcement 
immediately after release of the CERD Committee's recommendations, 
undermines the Governments commitment to the promotion and protection of 
human rights through the UN Treaty system, and also the role of the Joint 
Standing Committee on Treaties review into Australia's relationship with 
the UN.

We are concerned that in announcing such a review, the Government 
misrepresented the role and structure of the UN Treaty Monitoring 
mechanisms: in particular, the experts of the Committee are not delegates, 
but rather experts; it is a provision of the Conventions that initial and 
periodic reports are filed, not a political process determined by the 
Committee; and finally, that the process for NGO engagement is ad hoc and 
has disproportionate influence; the CEDAW Committee has been carefully 
considering NGO engagement with the Committee since 1997, and is producing 
a comprehensive and balanced practice in this regard.

The UN human rights system provides citizens in many countries in our 
region with their only source of recourse for human rights 
violations.  Australia has consistently supported the promotion of human 
rights within our region, and at a time when governments in the region are 
increasingly ratifying or acceding to treaties, we are concerned that 
Australia's review process sends a contradictory message to our partners in 
the region.

We seek your assurance that this review will not limit the Australian 
Governments participation in forthcoming reviews, including the fourth and 
fifth periodic reports to CEDAW.

We also seek your commitment to a constructive and transparent engagement 
with NGOs in this review process.  The Women's Rights Action Network 
Australia (WRANA) looks forward to cooperating in this process, 
particularly to share the views of women's NGOs in Australia.

Australia has much to be proud of in its record on developing the human 
rights system of the UN.

We urge the Government to continue to work to strengthen the UN Treaty 
process in a  manner that will ensure that this review contributes to such 
a commitment.

1. INVITATION

The National Women's Justice Coalition and the Albury Wodonga Community
Legal Centre have great pleasure in inviting you to a national conference
focusing on the legal needs of the two million women living in regional,
rural and remote Australia.

What kinds of problems relating to the law and legal protection do women
living in regional, rural or remote Australia have? Is there adequate
access to legal assistance and other relevant services? What kind of
assistance and services are needed? What 'works' and what doesn't!

The conference will focus on these questions, showcase and debate service
delivery models and bring together community workers, service providers,
courts, researchers, advisers and parliamentarians.

The members of the Board of the National Women's Justice Coalition and the
conference organising group look forward to welcoming you to Albury, NSW
for this conference. With your help this conference will lay the
foundations for new emphasis, partnerships and directions at a community,
regional, state and national level.

More than two million Australian women live outside metropolitan areas.
This conference would focus on diverse legal needs and service delivery
issues relating to women living in rural, regional and remote areas.

Reports by local and regional community organisations from many parts of
Australia highlight needs for legal services for women in their area,
including limited access to legal information, representation and essential
support services.

The conference will focus on diverse needs at a local and regional level
and aim to:

* draw out themes for local, state and federal government policy
development,
* build new networks and partnerships between researchers, community
workers, legal service providers and government agencies, and

* examine service delivery models and practical solutions.

The conference will provide an opportunity to showcase and debate
innovative legal information and legal service delivery models.

On July 8 1999, 276 women came together for three days for the Pacific
Sub-Regional Meeting of Non Government Organisations in preparation for
Beijing plus Five, or Women 2000 - the special sitting of the United
Nations General Assembly to evaluate the implementation of the Beijing
Platform for Action (BPFA) to be held in New York in June 2000. The
meeting, held at the Women's College, Sydney University, was convened by
CAPOW! and ANCORW, with a management committee and sponsorship from a
number of women's organisations.

The task of the meeting was to produce an evaluation of the implementation
of BPFA in the Pacific sub region. The outcomes from the conference will
form our input into the Regional Report which will go to New York in June
2000 and will form the basis of an NGO response to the questionnaire on the
implementation of the BPFA, which has been distributed to all Governments

Legal Aid ­ Towards 2010

Our legal aid system is facing increasing demands and shrinking resources
in an environment of change and uncertainty.

National Legal Aid and the National Association of Community Legal
Centres bring together people who provide legal services to disadvantaged
Australians.  Towards 2010 has been organised by both peak bodies in order
to consider the way forward to a fairer justice system in the year
2010.

Are expectations that disadvantaged Australians will be treated fairly
before the law being eroded? How can we overcome challenges such as the
high cost of litigation and limited legal aid resources? How can
government, service providers, the profession and the community work
together to ensure a fair and equitable system in the next century? When
and how will such a partnership be established? What will that partnership
need to do?

The Forum is designed to encourage discussion about the future of legal aid
services with the help of eminent speakers working in the justice system.
We feel you have an important contribution to make about how an equitable
justice system for all Australians can be achieved.

   PREAMBLE TO THE CONSTITUTION

The Federal Coalition Joint Party Room has today overwhelmingly endorsed a
draft preamble to the Federal Constitution to be put to the Australian
people in
conjunction with the referendum on whether Australia should become a
republic later this year.

In issuing the text of that draft the Federal Government is inviting public
comment on it and that comment will be considered before the final preamble
document is
put to the Australian electorate.

The preamble itself will be a schedule to an Act authorising the matter to
be submitted to a referendum. That legislation will be circulated by the
Federal
Attorney-General, the Hon Daryl Williams MP.

The legislation will contain a clause declaring that the preamble has no
legal force or effect and cannot be invoked in the interpretation of the
Commonwealth
Constitution. The text of the draft preamble approved by the Joint Party
Room is attached.

With hope in God, the Commonwealth of Australia is constituted by the equal
sovereignty of all its citizens.

The Australian nation is woven together of people from many ancestries and
arrivals. 

Our vast island continent has helped to shape the destiny of our
Commonwealth and the spirit of its people. 

Since time immemorial our land has been inhabited by Aborigines and Torres
Strait Islanders, who are honoured for their ancient and continuing cultures.

In every generation immigrants have brought great enrichment to our
nation’s life.

Australians are free to be proud of their country and heritage, free to
realise themselves as individuals, and free to pursue their hopes and
ideals. We value excellence
as well as fairness, independence as dearly as mateship.

Australia’s democratic and federal system of government exists under law to
preserve and protect all Australians in an equal dignity which may never be
infringed by
prejudice or fashion or ideology nor invoked against achievement.

MEDIA RELEASE

A DEEPLY EMBARRASSING DOCUMENT

Women are shocked and appalled at the set of disjointed concepts and
phrases that was released today as the draft Preamble to the Constitution.

In leaving out any mention of equality of men and women, the Prime Minister
has clearly not been listening to half the population.

Despite raising women's expectations that there would be a specific
statement of equality of men and women before the law, and having received
submissions from the Women's Constitution Convention Steering Committee
calling for a clear and encompassing statement of equality of men and
women, he has let us all down.

The expressions of dearly valuing 'mateship' is also revealing. Mateship
has always been about Anglo male bonding. It excludes women, Aboriginal
people and men who look different. When the Coalition uses it about the
Opposition, it's meant as an insult.

Considering the Preamble was supposed to express the values underpinning
our government, you'd expect that the first thing it would talk about is
democracy. Its appearance in an unintelligible next-to-last paragraph,
linked to invocations against achievement is astounding.

WEL deplores the omission of recognition of original Indigenous ownership
and ongoing custodianship. The attempted references about valuing diversity
are incomprehensible gobbledegook, ie 'people from many arrivals'. 

We wanted an inclusive Preamble that expressed the principles agreed by the
Constitutional Convention and included the principle of equality of men and
women as their starting point. We wanted words with emotional impact that
would lift the spirit of those who claimed them.

As a grade three attempt, WEL would give the document a score of one out of
five for trying.
As a serious draft to be put to a referendum, it needs to be torn up.
