My guess is they have a complex legal structure and WB home video is a
separate legal entity and has no physical presence in New York. I think they
probably do not charge tax anywhere outside of CA, but that you need to
check the website ordering system as opposed to asking strange as that may
sound.
I have asked my friend there to look into making it more friendly to
institutional orders, but the bottom line is they are not going to do
anything that requires any paperwork on their end. Since their titles are
not carried by the major distributors and since they are no frills DVD-R (
but very nicely done) they fly under the radar of many libraries. I urge
folks to check them out as it is an extraordinary collection at very cheap
prices and the more they sell, the more rare films they can put out.

This suggests possibly that WB doesn't have any physical quarters in New York 
(which is difficult to believe) or Connecticut but that they do have some sort 
of presence in Illinois.  As far as I know, companies are not required to 
collect sales tax on internet sales if they don't have a bricks-and-mortar 
presence of any sort in the state where the buyer resides (or is having the 
item shipped to?) although a lot of companies collect it regardless.  Of the 
ones that don't, a non-tax exempt buyer is responsible for paying the sales tax 
directly to their local tax entity, although most do not do so.

Hi Rue,
We don't officially teach Genocide Studies, but between a class on Survivors 
and programming by the Peace Institute, I feel like I have a de facto 
curriculum.
If it was purchased with library money, it lives in the Library. If it's in the 
Library, it's in the catalog and WorldCat.
All videos not on reserve are in open stacks and circulate for one week.
No, we do not have separate subject libraries in other campus locations.

I don't know what films are owned by departments/offices since those materials 
are purchased with departmental and/or personal funds and are therefore not 
cataloged anywhere.

Hi everyone.

I am beginning an assessment of our Library's media collection dealing with 
genocide (in very broad terms).  I feel we have a relatively strong collection 
both in content and accessibility, and this area is an ongoing collection 
development focal point for me.   As a very preliminary starting point, I would 
greatly appreciate hearing from other academic libraries regarding the 
following:


  *   Does your institution have an identified program in Genocide Studies 
and/or a Genocide Studies Center?
  *   If so, does the Library purchase media materials in support of Genocide 
Studies, and are these materials a part of the Library's general media 
collection?  (as opposed to a closed, departmental, or special collection)
  *   Are these materials cataloged and available in your OPAC?  Do they 
circulate?
  *   How is your institution's library system arranged?  The USF Tampa Campus 
has a centralized library as opposed to official Departmental, School, College 
or Graduate/Undergraduate individual libraries across the campus.

Ultimately my assessment will include comparative reports using tools such as 
WorldCat Collection Analysis as appropriate.   And I will be also be looking at 
the identification of vendors handling this type of content.  I'm aware of 
many, but it's a 'big world' out there.

I have added you to our e-distribution list to receive our weekly comprehensive 
new release information. The prime source for each title is shown along with 
the other title information.

I wanted to send you the file for the Oct. 26, '10 releases but our research 
staff has already taken it down as they're putting the Nov. 2 release 
information together now. You will receive the Nov. 2 information sometime over 
this coming weekend.

I think this will resolve any question or cunfusion and eliminate the need to 
go back & forth on the source issue.

a large company, but I believe some of the smaller companies focused most 
directly on libraries carry the titles.

I doubt you can require a company to sell anything to a particular person or 
institution that frankly is  going to require extra work. They don't sell to 
wholesalers and I am pretty sure they limit quantities during the 25% off sales 
to  limit clever wholesalers. FYI what I mean is wholesalers can buy like 
anyone else but they don't get a discount and have to pay upfront just like 
consumers.

  This is very unfortunate. The WB archive is doing what all movie 
buffs wish all studios would, make available a huge number of rare & often 
important films. The only way they can  do this is a bare bones operation in 
terms of both the DVD ( not extras DVD-R for now) and selling ONLY directly and 
not through wholesalers. Now some clever companies buy and resell the stuff, 
but they obviously have to charge something to do that which is likely to be 
more than the tax. Since WB is selling all titles at $20 and frequently has 25% 
off sales, they really can not afford to do anything but "straight" sales, as 
in no extra paperwork that might be needed for institutions. I will check with 
my contact there. I am sure they would like to encourage institutional sales, 
but again not enough to do anything extra.  For the record I just checked one 
WB archive title on Amazon. Amazon sells it for $27. some Amazon seller has it 
for $22. It would clearly be cheaper to buy direct from WB but if it costs a 
few more bucks to get it past your purchasing people it is worth it. I will 
post next time they have a 25% off sale.

Alex, you nailed it!! I think I might have heard the live broadcast also 
because when Dibya, my colleague here, mentioned it to me it was very familiar 
to me. I totally didn't think about radio however. And she swears she's seen 
visuals on the same issue -- I don't know, maybe the audio is so convincing 
that you can almost picture it in your head as a video! <> 

We settled on about 6 videos from those other suggestions -- I think we'll use 
the TAL segment as a thought piece to open the discussion.

of a documentary film -- but I wonder if your colleague is remembering instead 
a radio piece? This American Life did a wonderful story on this topic : 


" Sam Slaven is an Iraq War veteran who came home from the War plagued by 
feelings of hate and anger toward Muslims. This American Life producer Lisa 
Pollak tells the story of the unusual action Sam took to change himself, and 
the Muslim students who helped him do it. (34 minutes)"

I am confused. WB is the direct seller, you could buy from them but only if
you purchase at full price and pay upfront. It probably does not work for
such a large company, but I believe some of the smaller companies focused
most directly on libraries carry the titles.
Obviously WB discourages wholesalers/distributors from buying from them, it
is not their business model. Again for a company your size it does not seem
practical to buy them at
full price.

Why do you not go through some one like Action media.  Explain the situation to 
them, pay them with a PO and have them just bundle the tax into the price they 
quote you.  You are not paying TAX then you are merely paying a purchaser the 
cost of the item.  That way you do not have to wait until some one else adds a 
title into their database.  Just send Action a fax with the items you want them 
to order from WB.

On the advice of our accountants, Music Hunter has never collected sales tax

In my experience, studio and network sites (such as Warners, HBO, etc.)
are little more than dumb, automated fulfillment machines.  Unlikely
you're gonna get past the tax exempt issue.

Re amazon and paying more...may be they charge a bit more, but you always
need to factor in the staff/processing/administrative headaches and costs
when thinking about such things.  I'm always willing to pay more for
efficient, no-fuss, no-muss fulfillment.

Even for private universities the tax issue can be a problem. You might also 
consider asking your regular video vendor to place the order on your behalf, 
though I'm not sure whether the resulting handling fee ultimately will be 
cheaper than purchasing the DVDs from Amazon. We've done that on occasion with 
Action! Library Media, such as when a video required payment through PayPal.

By the way, I've had good experiences with Action! Library Media as a 
vendor--very fast and reliable.

We have been having just this problem with an order. They want us to pay tax, 
saying that because they are producing on demand we are not tax exempt, or that 
they have to charge tax. The matter has gone to the university lawyers, where I 
imagine it will sit indefinitely. I decided to revendor my order with Movies 
unlimited (www.moviesunlimited.com ) who charge 
the same price as the Warner site. The Turner Classic Movies website also has a 
shop with the same prices, but don't seem to carry all the titles.

Since we are a state institution, we are prohibited from paying sales 
tax. We have two options when a company can't/won't honor our tax exempt 
status - 1. have a staff member or friend purchase the title(s) 
personally and pay the tax, then donate the title(s) to our library; 2. 
don't buy the title(s) - which has happened on a few occasions.

I think your best option is to find a different place to purchase these items. 
Movies Unlimited carries a good chunk them, as does Midwest Tapes and of course 
Amazon.   I believe these companies are a little slow in getting the latest WB 
archive releases into their databases but they eventually do.

Like Jessica said WB is not really set up for institutional orders.  Some 
persistence with them may eventually get you the right person to talk to, but 
it may be too much of a hassle.  It is too bad you can't absorb the taxes since 
in the end it would be less expensive with the generous discounts WB give for 
time to time.

Hi Randy,

Your question about the documentary film about an Iraq War veteran working with 
Iraqi-American community college students didn't spark anything for me in terms 
of a documentary film -- but I wonder if your colleague is remembering instead 
a radio piece?  This American Life did a wonderful story on this topic :

"Sam Slaven is an Iraq War veteran who came home from the War plagued by 
feelings of hate and anger toward Muslims. This American Life producer Lisa 
Pollak tells the story of the unusual action Sam took to change himself, and 
the Muslim students who helped him do it. (34 minutes)"

This story, part of the episode "The Devil in Me", originally aired 09.07.2007.

Has anybody been able to order DVDs from the Warner Archive without paying tax? 
 I have been trying to order a DVD from them for months, but the order form 
does not allow me to tell them I am tax exempt.  I sent them an e-mail to ask 
them how I could order from them and include a tax exempt number.  They 
responded saying they needed more information which I gave them.  When I did 
not hear back, I e-mailed them again and they did not answer this e-mail.  Now, 
I have a request for a second title which is in their archive.  I see that
