Well I said it was possible he misjudged. However, if the sandhill was so close to the road that he could accidentally get into the road then he shouldn't have been playing there. That is the parent's responsibility to see that he is not playing in an unsafe manner.
which brings up another point most parents know exactly where their 8 yr old second grader is playing at. if those dirt hills are that close to the road then why should the kid be punished for playing somewhere they knew he was at and gave permission to be at?
its like the skateboard sceneiro you tell your child you can skateboard on the sidewalk she does hits a bump falls the skateboard flies up and hits a car. yes youd pay the damage but are you really gonna punish her for the accident?
