I know when I was a kid I played where I was not suppose to play many times...and I knew the consequences if I did.  Mom would have taken up for me in a situation similar to this, but I guarantee that she would also correct me for my disobedience. :-)

That's a valid question.  One we can 't answer.  It's possible he had permission to play there, and it's also possible he was playing somewhere that was forbidden.  That would definitely affect the punishment question.
 
As to the second one, like anything it would need to be on a case by case basis.  It goes along with the first one.

which brings up another point    most parents know exactly where their 8 yr old second grader is playing at.  if those dirt hills are that close to the road then why should the kid be punished for playing somewhere they knew he was at and gave permission to be at?

its like the skateboard sceneiro you tell your child you can skateboard on the sidewalk  she does hits a bump falls the skateboard flies up and hits a car.  yes youd pay the damage but are you really gonna punish her for the accident?
