I question if the hammer is a "notice ... reasonably calculated to make any Person ... aware that the Content was obtained from the Database ... and that it is available under [ODbL]". The example notice for satisfying 4.3 is "Contains information from DATABASE NAME, wich is made available here under the Open Database License (ODbL)" I've cc'ed legal-talk@ because if this is even allowable is a legal question.
