This is not a question of malice. It's a question of what to do when clearly
confronted with a case of academic dishonesty. The whole of science works on
trust. When I read a journal article that reports the results of an
experiment I trust that the experiment was actually done and that the data
were truly as reported. If I found out that the authors had never done the
experiment, or had falsified their data, I would be outraged. I would expect
that a retraction would be printed and I would also expect that these
authors would never be allowed to publish in that journal again. I teach
this to my students and I back it up in practice. I just had the unpleasant
duty of failing a student for plagiarism. I not only failed her on the
paper, I also gave her an F in the course and requested that the dean expel
her from the College. I did this without malice (nor with any sense of
pleasure, because there was none). I did this because it's important to show
other students that we view the issue of academic honesty with extreme
seriousness.

Having said the above, I also am willing to agree that participating in a
listserve is different than publishing in a journal. I believe that
different sanctions may apply. I too am not a fan of censorship and as
egregious as MS was (and probably still is) I would be willing to allow him
to continue on the list with the following proviso: That in the interest of
new members who may not know of his history MS be required to begin each
post with "I am ashamed that I have lied to this list in the past and
falsified my academic affiliations". This might make him think twice about
what he puts in his posts. It will also make it easier for me to adjust my
spam filter.
