I don't think he should get off totally without penalty. It was his neighbors property, and the police told him to let it go.
He should at least have to take a gun-owners rights course, or pay an "unlawful discharge of a firearm". And maybe an assault charge. I don't think I want my neighbors to be able to fire guns into people in _my_ yard "because I think I heard glass breaking". And the thieves should still be prosecuted for the break in.
