You mean they are not brought out of the dock and displayed open? (invisible windows are not like invisible bus stop queuing men). Well, this in one sense is exactly the same situation as in older OSs with the application menu. The equivalent would be a minimised window, you know, the window collapsed into the title bar, a strip of a thing. Choosing it in the old app menu brings the app to the front, but the window concerned remains minimised. It is true that so doing also "activates" the window, it leaves its shaded out appearance and the change often alerts you to where it is if you have forgotten momentarily. This is lost in the new MS docks arrangement and is an irritating loss.

Nor are Apps with closed windows running
in the background, such as mail.

This is not true on my machine (Tiger). This is what you do:

While holding command down, you press tab just once. All the open apps appear. To select the app you want to come to the fore (meaning the menu item right of apple menu shows the name of the app etc), you press the tab key again and again till you get to the one in the list you want. To go real fast, if you have a lot of open apps, you hold the tab key down.
