Isn't it also valid if he can post a url where you can simply download his "app"? It sounds like he's operating more under the "application" clause(s) of the TOS, in which case your test more or less always fails...
Also, someone mentioned that requiring a login violates the TOS, but I thought it was pretty clear that as long as the user doesn't have to purchase an account (i.e. free registration) you're in the clear.
