You tell me what's fair here:   

        We're a hosting company.  One of our clients spammed through
SOMEBODY ELSES mail server, however they hosted the site that was
mentioned in the EMail with us.  Bad thing?  Yes.  Against our policy?
Absolutely.  Mail Abuse contacted us and said pull the site offline
within 8 hours.  Our policy states we will allow the customer 24 hours
to respond to our request for additional information.  We sent a message
to mail-abuse and said it would be pulled after 24 hours if we didn't
receive a response/good explanation.  8 Hours later, 11 of our mail
servers were added to mail-abuse.org.

        Shortly after, the owner of the domain sent in proof that it was
*NOT* them that sent the EMail or had any connection to it.  It was one
of their customers referring hits to their site (A link with their
customer # of some sort), however in our customers policy it states
advertising their site with bulk EMail is against policy.

        So, because our clients customer spammed with SOMEONE ELSES mail
server with a link to a site we host (even though their account was
terminated with our client), we were blacklisted and had thousands of
undeliverable messages for a 14 hour period.  Fair?  Hell no.  We won't
purchase Above.Net routed backbones and we now route all mail around
Above.Net at all costs.

Why? Are you a spammer? Hopefully ORBS will be back soon and
mail-abuse.org will continue as they have. Very useful services and I
for one, hope that IMail 7.0 will finally add integrated support for the
ORBS and mail-abuse databases...
