Jim, I find it hard to believe that a photo taken circa 1900 (106 years ago) can still be under copyright. I would have asked to speak to the manager and for a copy of the statute under which they claim the pictures cannot be reproduced.
Have you tried Walgreen's, Target or K-Mart? I've never had a problem copying pictures at their stores. If the pictures have the name of a photographer on the frame, have you tried cropping the scanned images to get rid of the names?
