Not true.  A top level domain is a functional level of the DNS.  If it is
not in the commonsly used root servers, it *may* be viewed as private from
*their* perspective, but it they are still at the top level.

Yes, but the ccTLD Constituency is NOT included in the gTLD Registry
constituency.
