Sorry - I'm not following.

Lizard can put stats in his novel.  That's just Open Game Content, and the
OGL is the governing agreement.

The question is, "if the amount of game content in a given product is so low
as to be below an arbitrary threshold, should that product be eligible to
carry the D20 trademarks"?

My answer is "no" - game products should carry the D20 trademarks, and other
products that happen to have some incidental game content should not.
