The problem is defining 'incidental'. Page count? Use a big font. Word

I suspect this is the sort of thing to be settled in precedent. Since
the trademark DOES belong to WOTC, it seems they will have final
authority on any disputes, but this is an area where things can get
sensitive. A lot of people are watching to see how 'sincere' WOTC is. A
lot of other people are watching to see 'what can we get away with'.
