It all comes down to what is or is not derivative. Stat blocks are a 'weak'
copyright because they are based on form rather than content. They can be
easily circumvented. Rules cannot be copyrighted, but their expression can
be. So if you come up with a stat block based on rules not derived from
OGC, then you don't have to make it OGC. However, if you really are basing
the stat block on OGC, then it makes it much easier to prove that the work
is derivative, perhaps even when it shouldn't be. That is what makes this a
very tricky path to walk. The OGL is designed to make it safer, but it
doesn't help if you don't use it.
