How do you plan to get around the whole character creation and applying
effects of experience clause in your class-less adaption?

Easy. Don't use the d20 logo.
Although I haven't posted on this subject, I've been thinking (over the
past couple days) of using a class/level-less skill based system for my
setting. Since August when I formulized by plans for a players guide
for my setting, I intended to not use the d20 logo, and include
everything in the book that is not allowed by the d20 stl. This product
would be linked to all my other d20 products for my setting by the
setting logo. At the moment, I don't have any plans for any commercial
printing, but the goal is atleast some free pdfs.
The reason to use the d20 logo is for the network effect of your product
being compatible with other d20 and (indirectly) D&D products. There
are ways to make your OGL-only products compatible with your own d20
products, without having the direct connection of the d20 logo.

If you have found a way around this, please let me know. Since my lawyer
assures me there is no way around it for the purposes of retro-fitting
the system or altering the advancement scheme of characters.

While there is no direct way to get around the restrictions in the same
product that the logo is used on, two products from the same company
that have the same style, and layout could give enough connection, that
consumers can pickup on it. Of course, it relies on the consumers to
make the connection.
