You have it in one! The rules themselves are open. How a given 
company expresses those rules (i.e. the words used to describe 
them and/or detail those rules can be copyrighted, and thus are not 
open content.

Again, correct. The rules are what is open, unless something else 
is added to the OGC intentionally.
