Of course, this would make sense. Only Sun has the rights on the name OpenSolaris but OpenSolaris is a product of the work from a community. As it makes no sense to allow everyone to call a distribution "OpenSolaris", it make no sense to call one OpenSolaris. And because of the fact that OpenSolaris is the product of a community, Sun does not have the moral right to use the name OpenSolaris for a distribution.
