From what I gather, it's the legitimate users who have suffered in this case. Their data may be irretrievably gone. It also appears that megaupload didn't really do all that much wrong, or all that much different from other cloud storage facilities. If this is the case, then it may well just be random chance that they were chosen by the FBI to be made an example of, in which case no cloud storage facility is safe, and this is just one more way to lose data.
