Actually, the original suggestion is not as far out of order as you think. It has been used for Linux Mandrake, an impeccably OSS distribution!

 

(Via the Mandrake Club, although the benefit was faster and less overloaded ftp servers rather than a completely different method of distribution; that said, the vapours when it was first announced - "banknote seen within 20 miles of a Linux distribution, cue attacks of spleen" - almost beggared belief :)

 

On the other controversial point, I am sure that .torrent files will be appearing very soon after general release for the Mandrake 9.2 distribution. "Substantial non-infringing use" indeed to the tune of about 1.9Gb per downloaded set.
