Keith - the argument will not have anything to do with the jury deliberations.
Galanter already made the Batson argument. The appeal will be based on what the defense considers to be "irregularities" in the jury selection process (my friend MB may have the juror questionnaire still up online at TheLegalEdge.com.) The Legal Edge streamed the entire trial live.
