A basic right? An interesting observation. Sure disability is not a ground
to deny it, however, what if the work of the post acquired after promotion
is incapable of being performed with a given disability, with the given
level of technology? Would the norm of supernumerary post of section 47[2]
come in or exemption contemplated under proviso to it would be applicable!

Fair construction of statutes as it stands today, in my opinion, does not
warrant supernumerary post in case of promotion, and unless the said
excemption is obtained, promotion can not be legally denied. This also seems
to be the approach of high court decision cited in the article. However,
things do take different turn when it comes to perceptions of promoting
authorities, particularly in cases like those cited in article. The fact
that the disability is acquired in service or in the course of performing
duties should also in my opinion be given due weightage.

And besides, the employee ought to be considered for posts higher in
hierarchy than post in contention after due period, for this notion of
notional promotion may be introduced.

Promotion is a regular activity. Disability does not come in between it.
Just write an aplication to the Chief Commissioner Disability, stating your
problem; you will surely get your issue solved. Send a copy  to UGC and HRD
ministery. I just would like to ensure you that promotion is your basic
right and no one can take it away from you.

he would not be able to do the arduous job of Inspector of Central Excise
and Customs. How unfortunate!



There were more people like John who had been refused promotion on account
of disability. They had approached the Central Administrative Tribunal,
which

issued directions to the Department to consider the applications of the
physically challenged persons for the post of Inspector of Central Excise
and Customs.



What happened thereafter? The Department called upon John `to undergo
endurance test of cycling and walking.' And `he was found to have performed
the same

successfully.' Yet, in 2004, John was rejected on the ground that he did
not
have `the prescribed height'.



He approached the Tribunal for remedy. Disappointingly, it held that there
was no scope for relaxing the standards prescribed in the Recruitment
Rules,

and rejected John's application. Aggrieved, he took his case before the
High
Court.



Speaking for John, his counsel V. Raghavachari said that the Tribunal had
erred in rejecting the claim of the petitioner to the benefits conferred
under

Section 47(2) of the Persons with Disabilities (Equal Opportunities,
Protection of Rights and Full Participation) Act, 1995 in the matter of
promotion.

Hi rajiv, I am not too sure about that. Although I don't have specific info
on this, cases have been brought before the courts and it has been ruled
that reservation should be given once. But the governments have not been
following this policy and same benefit is being given for promotion as well.
Please correct me if I am wrong.

as i understand, the benefit of reservation is only given once. so if
reservation benefit is availed at the time of recruitment then no benefit is
given in reservation in promotion. however if recruitment is got without the
benefit of reservation then at the time of promotion reservation will be

Thanks for your concern. Let me inform you that Disability act is silent as
far as the reservation is concerned in promotion is concerned. I have
recently written a note to the Ministery of social justice and empowerment
in this regard. This was done to  provide them the feed back for the
suggestions they were seeking.
Now let me come to the issue of Mr. Dadu's issue. His issue is very basic.
This is an issue which is core to each teacher. Each teacher is entitled for
promotion irrespective of one's disability. So please don't club these 2
important issues.

Hello,
  From Past some days I am facing some problem with out look express. That is.
  I have 6 accounts configured in out look express. And I have just configured 
my new seventh I d.
  And my Default I d is the fourth I d.
  When I compose a new message it goes as it is suppose to from the default I 
d. but, When I want to forward or reply to a mail then? Instead of going from 
the same I d, from which the mail has come? It just goes from the new seventh I 
d. which I have just configured. Actually it should be going from the I d from 
which that particular mail was received.
   I have no clue why this is happening. And till I do not delete the seventh I 
d. this problem does not get rectified.

Your out mail will be only sent from the default account you have 
configured.

However, if you want your mail to go from a specific  account, then go to 
the from field and you will get a list box of all the accounts. Pick from 
it.

Dear Sir, it has been a very controversial issue. Don't you think that 
promotion is also a method of recruitment? There may be two sort of 
promotions, 1. time-bound and 2. promotion to fill vacancies that have 
fallen vacant in higher grade. In the second case, reservation may be 
claimed as it is a process of recruitment. And, so far as time-bound 
promotion is concerned, there is no point for discussion.

when she is forwarding or replying to the messages, it is not happening from 
the id where they originally landed. The new mails she is composing are 
going from the default id.
Queer case in fact. Selecting from the 'from' field while forwarding and 
replying seems to be the only solution that comes to my mind.

1. there are devices like Bonham device and the tailler frame which have 
been out dated and do not match the new developments in the field. 2. the 
main problem is not the unavailability of devices but the general feeling in 
the instutes where the blind kids are educated that they cannot be taught 
the subjects like mathematics etc. 3. there are two devices which can help a 
lot: one, a compass-like instrument, which can draw various shapes and which 
should be handy as well as within reach. two, a device like taller frame for 
rough work in maths. the former has been outdated because all algebraic 
expressions cannot be depicted over it.

Well, this is what works for me.
When you are replying to particular message,  pls do shift tab till you hear
from and then ensure that it goes from your desired id by up arrow or down
arrow.

I have no clue why this is happening. And till I do not delete the
seventh I d. this problem does not get rectified.

Absolutely! Therefore in promotions where a person is recruited, reservation 
should be aplied for the persons with disability. As far as i am informed, it 
is given to SC and ST. I have sent a note in this regard to the concerned 
ministry   through Sambhavana: the organisation which we are running. I fully 
believe, it will meet it's desired end very soon.

  reservation benefit is availed at the time of recruitment then no benefit

[AI] How to remove tilda files?

  Hi !
   
  Please anybody on the list tell me how to remove Tilda files.
  I know it is temporarily created files  will be removed automatically, but 
it is not happening on my computer.
  Every time I press Ctrl+S these are files are being created and not getting 
removed even after closing the folder.
   
  Please tell me what to do. How to remove these files?
