[AI] Pls Advise - Case of Shalini Sethi from Delhi
-- Forwarded message -- From: shalini sethi Date: Tue, Jun 22, 2010 at 1:02 PM Subject: Fw: plight of disabled To: dlu.so...@gmail.com - Forwarded Message *From:* shalini sethi *To:* secy...@nic.in *Sent:* Fri, 21 May, 2010 4:07:00 PM *Subject:* Fw: plight of disabled Respected Madam, 1. I joined the IDBI Bank at its Chandni Chowk branch on 26.11.2007(later shifted to its Rajouri Garden Branch) as Executive , based on my selection in the all India Test conducted by the said Bank, under the quota for persons with disabilities, as per the PwD Act, 1995. This post was initially on contract, to be renewed year-to-year, to be absorbed in the services of the Bank as Assistant Manager, an A category post, on availability of vacancies, performance and a further selection process. 2. I was performing well, doing multi-task duties, as a Teller, handling cash, preparation of demand drafts, handling Demat accounts, tax collection matters. I also worked on cheque clearing seat. During this period I also participated in two training seminars, conducted by the Bank. Trouble started for me when Shri Rajesh Kumar joined this Branch as Head in July, 2008. He was harassing me for no reasons, teasing me on my disabilities, calling me mad, threatening the non-renewal of my contract etc. Things came to peak on 21.11.2008, when I could not bear the daily bickering and indignities any longer, I talked on my mobile to Shri K.P.Nair, Head HRD, who sits at Bombay Headquarters of the Bank, because he had earlier helped me in my posting problem, expecting that he will again sort out my problem. But instead of getting any relief I got a fax from his office at 5.00pm on 25.11.2008, when I was leaving the Bank, after my days work, informing me that my contract is not renewed and that I should apply to the Bank for encashment of my leave etc. I talked to him in the evening the same day on returning home but he informed me that the contract has not been renewed because of performance. When I talked to him about my complaint, he told me that he was looking into the matter. It took the Bank nearly 6 months and several e-mails to honor encashment. 3. Not getting any response, my father wrote to him on 1.1.2009 seeking proper justice, considering that I got this job quite late in my life and now at the age of 38 yrs. I had no further job opportunities; pleading that the state policy is to properly rehabilitate persons like me so that they could live their lives with dignity and self respect to become a part of the mainstream of the Society, but this letter failed to get any response. 4. Realizing that waiting further for justice from the Bank was futility, my father formally lodged the first complaint with the Chief Commissioner for persons with disabilities 24.2.2009, under Sec.59 of the PwD Act, 1995 This relevant Section reads that apart from taking steps to safeguard the rights and facilities made available for persons with disabilities, the Chief Commissioner, on his own motion or on the application of the aggrieved person or otherwise look into the complaints in matters relating to deprivation of rights of persons with disabilities, non-implementation of laws,rules,bye-laws,regulations,executive orders, guidelines or instructions made or issued by the appropriate Governments and the local authorities for the welfare and protection of rights of persons with disabilities, and take up the matter with the appropriate authorities. As per Sec. 63(1) of the Act, the Chief Commissioner for discharging their function under the Act, have the same powers as vested in a court under Code of Civil Procedure, 1908 while trying a suit in matters like summoning and enforcing the attendance of witnesses; requiring discovery and production of document; requisitioning any public record or copy thereof from any court or office; receiving evidence on affidavits; and issuing commissions for the examination of witnesses and documents. Its proceedings are judicial, within the meaning of Sec.193 and 228 of the Indian Penal Code. It is deemed as Civil Court for the purpose of Section 195 and Chapter XXXVI of the Code of Criminal Procedure, 1973. 5. In the above said complaint, while explaining the facts it was pointed out that no-renewal of the contract was an act of personal vendetta because I complained against the Branch Head for humiliating me for no reason. I expected that the Chief Commissioner, concerned with the welfare of persons with disabilities and protection of their rights etc. will kindly independently get the complaint investigated and take action against the person who harassed me for no reason leading to deprivation of my right, as a person with disability, for gainful livelihood. It was also explained, enclosing a copy

I did notice the difference and I missed out yesterdays news because of that. I hope that it gets changed soon. As I understand, the website designer is from the US and it may be due to the time zone difference. We can bring this to the editors attention if it does not chage. It's almost ironic that you contacted us now about using DocScanner as a reading tool, as we are just launching an app called SayText. SayText is an app designed especially for the visually impaired and by the way, it's free! In a few words to describe it's use, you need to place the iPhone on the center of a document. There's a big button for starting the tool, tap it. Slowly elevate the iPohne upwards from the document until you hear an beep sound - this indicates, that the document is now fully in frame and the camera will shoot automatically, when the picture is stable / focused. Now only thing you have to do, is to wait for a while (You can tap the screen to hear the OCR progress, e.g. OCR 35%). When the OCR is ready you can start the voiceover to read the document out loud. Re: [AI] The Hindu's new lay out
Both the new as well as the old website carry the daily news in different layouts. I responded in haste earlier saying that the new website is only for news updates. The index feature in the new website appears quite good as it gives us the option to quickly browse the topics as well as various pages/features. However, for selecting states other than Tamil Nadu, Karnataka and Andhra Pradesh, e.g. New Delhi, one still has to rely on the Dropdown, it seems. Besides, the New Delhi page in the new website is carying the news of the previous day, but that is not the case with the old website. What can be the reason? Or maybe it would go normal in the days to come. - Original Message - From: "Adhimoolam Vetrivel Murugan" To: Sent: Friday, June 25, 2010 2:49 AM Subject: Re: [AI] The Hindu's new lay out I retract my prior point. Re: [AI] Insensitive serial ads cause furore
Yes of course, such matters must be brought to the notice of the channels and programme producers concerned. One must make conscious effort to see that whhile putting up your views across that you are in no way hurting anybody's feelings. A Marathi play called All The Best is the best example where differently abled people like blind and deaf are made fun of. - Original Message - From: "Vishnu Ramchandani" To: Sent: Thursday, June 24, 2010 11:07 AM Subject: [AI] Insensitive serial ads cause furore Advertisements to promote some TV serials that use terms deemed derogatory for the differently abled are earning the wrath of activists. One such ad, for a TV drama Shorr... Goongi Kankoo Ki Bolti Kahani on SaharaOne, shows the protagonist as a mute girl in a bridal outfit, with a tagline 'Kyun karega koi goongi se shaadi' (Why would anyone marry a mute girl?) uses the term goongi, considered an insult. The ad for Sony TV's Maan Rahe Tera Pitaah, uses the phrase "mad man" to describe the mentally challenged father of the protagonist. Activists are threatening legal action. "Such regressive ads are not acceptable We will lodge an official complaint with the I&B Ministry... We have an archaic law, the Disability Law of 1995, which needs urgent amendment...," said Javed Abidi, convenor, Disabled Rights Group. Uma Kapoor, secretary of NGO Delhi Foundation of Deaf Women, and a mute and deaf person, wrote in an email, "We have seen inappropriate terms being used by channels to describe disability conditions The serials are made with a positive approach, but their promotion should not reflect roughly on the physically/mentally disabled characters." Ad professionals too are shocked. Ad Guru Alyque Padmsee said, "Ad writers today do anything to be sensational... Though I am anti-censorship, I urge the producers of these serials to reconsider their ads..." The channels say such ads are part of the marketing strategy. "In our show, the lead actress cannot speak, and so we have used it in the ad. But the story is positive and not regressive," says Sheetal Ladha, Sahara One Television. Re: [AI] important circulars
Hello, Teaching posts in schools and colleges in West Bengal are reserved for vh candidates as per law after Blind Persons' Association moved the Kolkata High Court about 10 years back. I could not locate the original order in our office yesterday. I shall upload a scanned copy if I find it. Pratik Agarwal asked me for it earlier. But I forgot the matter totally. As regards primary teachers, low vision candidates are allowed here. Only yesterday we obtained a notification from the state disability commissioner's office acording to which the Ministry of Social Justice recommended primary teacher's post as a suitable job for blind and low vision persons. If possible, I shall try to find its scanned copy also. However, it should be on the Ministry's web site, at least the survey. As Mr. Prateek Agarwal has offered, you can search and download the required circulars and government orders from his website. Lists of identified jobs of government of India in group A, B, C & D are also available on the site of ministry of social justice and empowerment, government of India. Here, this is more important to know whether the job of language teacher is identified for the blind or not in your state. Actually we at Karnataka also facing the similar problem. Job of any type of school teacher accept the music teacher has not been identified for the blind by the Karnataka government. Even in 2007, when the 1000 of vacancies were advertised for the post of primary school teacher a PIL was filed in Karnataka High Court for recruitment of blind as a primary school teacher as per their reservation quota. And court gave the favourable judgment directing the state government for recruitment of the V.H. persons for the job of primary school teacher as per their reservation quota. But the state government move to the supreme court to stay the judgment and since than the matter is pending in the supreme court neither the stay has been granted nor the afforstated judgment is being implemented. NFB, Karnataka also filed a fresh PIL petition in 2009 while again 4900 vacancies of primary school teachers were advertised and blind persons were bared to apply for these jobs. In its interim order of 29th October 2009 against the said PIL the high court directed the state government to keep at least 49 posts vacant until the final disposal of these petition and accept the applications of qualifying blind persons for the same. Since then the matter is standing in the high court for the next hearing. You would be aware of recent interim order of Mumbai High Court in which the honourable high court has expressed its displeasure on the attitude of the Maharastra Government on the matter of identification of jobs and its time bound review. It may also be helpful in your case as a reference. I am forwarding a copy of this interim order at your personnel mail I.D. We have also filed a new PIL in the matter of appropriate identification of jobs and review of the existing lists, the first hearing of which expected to be scheduled with in two, three days time. I would inform you of the outcome of the same after the hearing. Best of luck for the desired success. Re: [AI] Accessibility of MChek application with Talks?
Certainly IVR/SMS is good option sir. Actually till now the available information was that for registering SBI Visa debit card you need to have the MCheck app. However today itself from MCheck customer care I came to know that currently all debit cards are not supported. So now at least for SBI users there is no way to recharge online / via mobile unless you use SBI mobile banking. I haven't tried the SMS based mobile banking since it was launched recently but the app again is not accessible due to it's java designing. Honestly Java inaccessibility is a major issue which is troubling me from last few months whether it be on the pc or on phone. Anyways thanks for your response. Since it is a drop down combo box,the cities have to be selected by pressing alt down errow after the Forms Mode is turned on. Re: [AI] important circulars
Dear Amitji, Efforts of you and your friends are admirable. With regards, Gautam Prakash Agarwal President, NFB, Karnataka. -Original Message- From: accessindia-boun...@accessindia.org.in [mailto:accessindia-boun...@accessindia.org.in] On Behalf Of amit patel Sent: 23 June 2010 21:20 To: accessindia Cc: vib-india Subject: [AI] important circulars Dear friends, I am writing this mail on behalf of my visually impaired friend kaushik. Gujarat government has decided to recruit 1 language teachers in middle school to teach standard 6 to 8. It means there is around 270 sits reserve for the blind. Now the problem is government is denying recruiting 100 percent blind people for the same post. Their argivement is that a totally blind person can not work on black board. How ever we have tried our best to convince them, but they are not ready to change there mind. Though we have approached high court, and the matter is in progress. So we need necessary circulars such as: list of identified jobs by central government, circular for employment and other important documents as soon as possible. And your valuable advice will really help us. So please reply as soon as possible. And pardon my poor English. Thanks in advance. A loving husband had to part with his wife, as she was to be sent to her parents house for delivery. At the time of her departure, the husband handed over a bundle of inland post cards and asked her to write him letters everyday. For her convenience he had himself written his full postal adress. Her job was simple, only write the letter and put it in the post box. The wife dutyfully did what she was told by her husband. When she returned back to her husband along with the baby, she scornfully asked why he did not reply to any of her letters. The husband simplypointed his finger to the drawer of his table. On opening the drawer, the wife to her surprise saw all her letters in tact. Re: [AI] Care for spellings in postings - a request
Dear friends, Namasthee to all. This animated discussion is quite interesting. The spirit behind making efforts to improve one's language abilities is good and should be taken in that spirit. It is for the individuals to act and improve their abilities. After having said as above, it is also necessary to understand why many people, myself included, make spelling mistakes. One, unlike our Indian languages, English spellings do not fully conform to pronounciation. Two, we very often wrongly pronounce English wordsand more often than not our pronounciation carry a tinge of of our mother tongue's accent. I should confess that my ability to spell correctly has improved after I started losing my sight. I should thank my good friend JAWS for this improvement. Also, Mr JAWS has helped me in learning the correct pronounciation( of course excluding our Indian language words). Friends, what should be one's approach on this spellings issue one may decide after reading the following story. Her husband, being a school teacher, had corrected the spellings and put marks as 2/10, 3/10, 5/10 and so on with remarks also. [AI] Digit-Eyes Audio Labeling System Advances Independence For Visually Impaired
folks, the below pasted news item looks promising. i kind of liked the software. though, its more or less similar to pen friend labler if someone has seen it, but still it can't be denied that it's a utility product. have a look: --- Digit-Eyes Audio Labeling System Advances Independence For Visually Impaired 23 June, 2010 @ 4:17 pm by Cara FOR IMMEDIATE RELEASE Contact person: Davey Hulse Cell: 503-559-3787 Email: pressrelati...@digitalmiracles.com DIGIT-EYES AUDIO LABELING SYSTEM ADVANCES INDEPENDENCE FOR VISUALLY IMPAIRED Digital Miracles, LLC, is pleased to announce a major advancement in assistive technology for people who are blind and visually impaired. The Digit-Eyes Audio Labeling System has been approved for sale on the Apple Apps Store. As of June 23rd, the millions of people worldwide with substantial vision loss can begin downloading the iPhone application to recognize and label the important items in their lives. Reasonably priced at $29.99, the Digit-Eyes phone app is a powerful tool that fits into any budget and life- style, turning challenging tasks into easy, safe activities. The Digit-Eyes system gives users a simple way to make custom labels for everyday items and it identifies packaged goods-joining advanced software with the iPhone, the Internet, home computers, printers, and inexpensive off-the-shelf labels. People of almost any visual ability can now put groceries away and grab the right prescription bottle independently. “This is the most exciting product I’ve worked on,” says Nancy Miracle, president of Digital Miracles and software engineer with 40 years experience. “The limited functions and high cost of existing assistive devices just seemed wrong, so our objective was to develop a product that performed better than any comparable technology and offer it at about 10% of the price. Combining the need for identification with a natural, powerful and robust tool like the iPhone made the project irresistible.” With Digit-Eyes, users can print custom text labels or record audio labels that they make by scanning specially coded labels and speaking into their phones. They attach the labels to household items, and the messages are played back whenever the codes are rescanned with their iPhones. This Digit-Eyes app can also scan manufacturer codes (UPC, EAN, ISBN) and say what’s inside the package after checking the vast Digit-Eyes product database. Each iPhone stores over five hundred hours of information and can be used just about anywhere. “This product is amazing! By labeling leftovers with their contents and date refrigerated, I can determine if my dinner will be edible or not. Next, I’ll be labeling my jungle of AC adapters so I’ll never again have to guess what they all go to. The ease of use and flexibility of the process make it an invaluable tool!” Randy Builder, Seattle, Washington. The first public display of Digit-Eyes is at the National Federation of the Blind convention in Dallas, Texas, July 4 – 7, booth B113. The exhibit then moves to the American Council of the Blind convention July 10 – 15 in Phoenix, Arizona, booth #41. Attendees can experience the use and capability of the system with hands-on demonstrations. Details, explanations, and examples will be available at both conventions, or immediately on-line at www.DIGIT-EYES.com. Digital Miracles, LLC, the parent company of Digit-Eyes, is a Texas-based corporation that develops customized software solutions. The Digit-Eyes Audio Labeling System was created by a team of engineers, software designers and members of the visually impaired community.
