At last night's Council Meeting the topic of controlling what is
built on public property was discussed.  

Curious, was there any discussion of retaining the `improvements'
recently begun by our new found friends of the Oceanfront
Redevelopment, seeing as how there is no lawful official plan or
permit and may not have been a lawful transfer of title?

property, I only take issue with your ridiculous premise that it is 
not PRIVATE property. It is PRIVATE property over/in which the 
PUBLIC has SOME rights.

Werner,

It's called encroachment. When property comes up for sale, a survey 
is taken, delineating property lines according to the lot number on the 
city map! No ifs, ands, buts, or maybes. I have no idea where city 
residents got the idea that they can encroach on ANY property lines, 
not THEIRS! They can be sued and fined if they don't  remove fenches, 
shrubs, stones or any device, aimed at the taking for one's own use, 
the property of others. I scared the hell out of my next door 
neighbor when my home went up for sale. He allowed some shrubs 
to encroach on my property. He had to get a landscaper to move them 
or be fined by Neptune Township and me for every day his shrubs were 
there, in other words, he had to pay me rent! There's a stature or 
law on the books about it. Ask any real estate person about it. No, go 
out of Asbury Park and ask a Neptune Realtor about it. There is a 
disclaimer ,that if you don't cite the encroachment, after 10 years the 
land, even if it's a sliver, becomes yours! That's the caveat! So where 
is the code enforcer or whoever is in charge

Sharon, you are talking about Adverse Possession, a very complex legal 
issue. It is not so easy as that and courts rarely, if ever, award 
adverse possession. There is a criteria to accomplish it, which is 
difficult, if not impossible, to meet.

I will leave planning, etc. to Werner, but he is wrong on the law and 
property rights. We are talking about property rights, and we are using 
the short hand of PROPERTY. Well under that definition, yes whatever 
rights-of-way (ROW)the City may have over private property those rights 
can be considered PUBLIC PROPERTY. However, what I am saying is that 
every right in PROPERTY, when it is less than fee simple, is 
specifically delineated in a contract or agreement. Assumedly, Bradely 
or the founders, when selling the tractss either RESERVED some rights 
for the public in or over PRIVATE PROPERTY or the City later acquired 
those rights. Whatever the case may be, those rights, now referred 
herein as PUBLIC PROPERTY (more specifically, public rights in private 
property) are clearly delineated and limited in some document(s) or 
agreement(s). You have to know what those rights, or their limitations 
are. You just can;t say it is public property and private property 
owners cannot do anything with their own property. If the public 
abridges or increases its RIGHT (or property)in or over private 
property, then it is a taking and the Constitution requires just 
compensation.  As I said before, the PUBLIC can regulate PRIVATE 
property through zoning, police powers, etc., which, if they are not 
considered confiscatory, are not takings and do not require 
compensation. If you want to regulate fences, pass a law for godssakes, 
but don't tell me I don;t own the property. I I didn't, I wouldn't be 
paying taxes on it. Werner is as wrong as wrong can be.

There are a lot of people in this group involved in one charity or 
another! So you're older than me! I knew that! You know me but not by 
name or I have a forgettable face! One of the terms of this group is 
non-solicitation, which means, no spamming or petitoning for 
anything! This group is about everything, Asbury Park! Go to the 
group site and read! Better still, send a press release to the 
Coaster, or heaven forbid, the Press. Ma'm the Mom's you cite here 
are in dire straits, granted. I hated to sound mean-spirited and if I 
did, I beg your apology. I am not here to tell anyone what to do. All 
I asked is that you and some others adhere t the purpose of this 
group. What happened to the Sisters of Mercy? I remember them being 
the place to go, if one needed help. Did Sean Kean get rid of that 
service, too? He's too busy trying to get reelected to a job he's 
unqualified to do. The constituents, the majority, are here in Asbury 
Park! Does ANYONE know where his office is? I sure don't! Low income 
people are NOT being served! Ma'm I tell back everything I said. I

Helpful Things---who knew??? === Sealed envelope - Put in the freezer for a few hours, then slide a knife under the flap. The envelope can then be resealed. (hmm...)
  Use Empty toilet paper roll to store appliance cords. It keeps them neat and you can write on the roll what appliance it belongs to. 
 For icy door steps in freezing temperatures: get warm water and put Dawn dishwashing liquid in it. Pour it all over the steps. They won't refreeze. (wish I had known this for the last 40 years!) == Crayon marks on walls? This worked wonderfully! A damp rag, dipped in
 baking soda. Comes off with little effort (elbow grease that is!).  Permanent marker on appliances/counter tops (like store receipt BLUE!) rubbing alcohol on paper towel. == Whenever I purchase a box of S.O.S Pads, I immediately take a pair of scissors and cut each pad into halves. After years of having to throw away rusted and unused and smelly pads, I finally decided that this would be much more economical. And now a box of S.O.S pads last me indefinitely! In fact, I have noticed that the scissors get sharpened this way!  Blood stains on clothes? Not to worry! Just pour a little hydrogen peroxide on a cloth and proceed to wipe off every drop of blood. Works every time! Now, where to put the body?  Use vertical strokes when washing
 windows outside and horizontal for inside windows. This way you can tell which side has the streaks. Straight vinegar will get outside windows really clean. Don't wash windows on a sunny day. They will dry too quickly and will probably streak.  Spray a bit of perfume on the light bulb in any room to create a lovely light scent in each room when the light is turned on.  Place fabric softener sheets in dresser drawers and your clothes will Smell freshly washed for weeks to come. You can also do this with towels and linen.  Candles will last a lot longer if placed in the freezer for at least 3 hours prior to burning.  To clean artificial flowers,
 pour some salt into a paper bag and add the flowers. Shake vigorously as the salt will absorb all the dust and dirt and leave your artificial flowers looking like new! Works like a charm! = To easily remove burnt on food from your skillet, simply add a drop or two of dish soap and enough water to cover bottom of pan, and bring to a boil on stovetop.  Spray your TUPPERWARE with nonstick cooking spray before pouring in tomato based sauces and there won't be any stains.  Wrap celery in aluminum foil when putting in the refrigerator and it Will keep for weeks. When boiling corn on the cob, add a pinch of sugar to help bring out the corn's natural sweetness.  Cure for headaches: Take a lime, cut it in half and rub it on your
 forehead. The throbbing will go away.  Don't throw out all that leftover wine: Freeze into ice cubes for future use in casseroles and sauces. Left over wine? What's that?! :)  To get rid of itch from mosquito bites, try applying soap on the area And you will experience instant relief.  Ants, ants, ants
 everywhere . Well, they are said to never cross a chalk line. So get your chalk out and draw a line on the floor or wherever ants tend to march. See for yourself.  Use air-freshener to clean mirrors. It does a good job and better

Sharon, I completely understand your frustrations with this group, but perhaps you can view us like i do, i am sooo busy these days with being care giver to my senior mom and handicap brother that I welcome any news of what's going on in the lives of others, sort of like, if you're with 2 year olds 24/7 that any adult conversations are a blessing, lol.

lighten up dear heart and go with the flow, we all mean well, i think, lol, or better yet, when i lived in nyc, i'd rather say, some of us fly further than fire island, and/or,its a small world after all, never know who knows who when you're doing whatever you do, where ever you do what you do. and its not what you know, but what you know about whom that counts most.

as for my little charity, please help by volunteerring your time, and or donations, people (children, seniors, etc)are sufferring and Mercy Center, like Chant ran out of food before the month's end too. why do you think they have fund raisers. spread the word, how ever you can, even on a yahoo group, email list etc., CHANT's motto is, "hunger does not take a vacation." and i hope you read the article in the app and coaster, this is no joke, good nutrition is good for life.

Kean maybe the cause ofmany people being without a pay checkto spend in asbury park when he closed Tom Smith's office in Asbury, that's why there is a CHANTfood pantry, Tom Smith helped to build it. Smith even helped me get my show on cable in 1992 when he presented the cable company with the FCC rules and regulations to train his residents to be Producers of their own show. He also got memy notary stamp too. 

to badSmith was a Lincoln republican, but at least they named a building after him, even if he was the first and only black assemblyman in the history of monmouth county. yet he made his mark to helppromote many blacks, likejudges, policeman, broadcasters, etc., 

but when it came to politics,Smith couldn't do anything to help Mr Fashion get his job because "the 11th district wasn't designed to be a life long position for black candidates" according to Bill Dow on the day Kean was selected. I put it on my show and you know what happened toBill Dowand his job, he was challenged and lost to a kean supporter. and there goes the Smith office to Wall, the beginning.

I got to document all eventsand Idonating my skillsbecause ofknowing Tom Smith. I hope I do him proud, perhaps if I become the Oprah of NJ, money wise, he'd rise from the grave smiling saying, did I do That? Yes, Mr Smith, there is a money tree in asbury park for me too, a democratic humanitarian black cherokee asbury park woman. talk about a wammie of tokens all wrapped up into one, lol
