No, it is not MM that decides, its the Board.

The testimony was that the bathrooms would be in the shipping
containers - UNLESS the State prohibited it on the green acres space.

As was predictable there is no restriction on restrooms on green
acres space. As I testified at the hearing it is up to the local
authority, Planning Board/Council to set policy.

Once again they failed. They were pressured to beleive that if the
State said OK that they should go along with that.

I remember that there was a sign right when you walk into the
conventon center, one of those a-frame things that sit on the ground.

My experience was not good related to bathrooms, I went in one of
those portable toilets on the boardwalk before finding the other one.

Very tacky and low class to treat visitors that way. Every shop I
stopped in said sorry no toilets, look down there

I would have thought proper restrooms would be the first thing taken
care of. And the idea of rentable lockers is great.

side of CH open to the public now.  Right before the beach bar.  I
wonder if visitors wondering around even know their there yet?  They
should have a sign somewhere inside CH pointing to them.
There might be profit in the ideas you speak of, but i'm pretty
sure their would be more in other rental complexes.  Those types of
locker rooms also promote a different atmosphere for the board walk.
An atmosphere i'm not so sure MM wants. ?  Unless the pass
picks up on the boardwalk, i don't think it will ever been that busy.
Even on the hottest summer nights.  There still seems to be nothing to
do People who like to walk near the beach will walk, but people
who came to  walk the boardwalk for a good summer night may leave
shortly once they find out theres nothing there...

Greeting from Long Branch in today's online AP Press:

Amusing juxtaposition of drug busts story featuring more than a dozen Long

with the Italian Ice Lighthouse as giant phallic symbol:

The city Planning Board will continue in September to review the application
to relocate and expand Strollo's Lighthouse Italian Ice Stand in an issue
that has, at times, taken on soap opera-ish proportions.
The issue has generated waves of controversy, beginning when Planning Board

pedophilia to yourself and stick to the facts when McGovern asked a witness

I don't want to tick anybody off with this post, because traffic at our
boardwalk has been
great.
But, I honestly don't understand why the 1st Ave. pavilion was built up to it's
current
height instead of one of the other pavilions. We've mentioned the blocking of
the Empress
views, but what about the concept that most of that pavilion isn't even visible
from inland?
Wouldn't it have made more sense to build up a pavilion that isn't obscured?
I think it really sucks that the Empress has to suffer since they've been a
successful
business for so long. It's the only oceanfront hotel we have. Oceanfront rooms
get a
premium price.
Somebody else suggested that maybe the Empress should add on a few floors.
At who's expense? Certainly not theirs. Their view has been blocked by MM.
Also, isn't it a waste to have the MM offices in a pavilion? It's vanity for
them, but it's also
a waste of prime boardwalk space. That pavilion would be a great place to add
in lockers
and showers, which would help keep people at our beach longer.

Hi, I thought I included your post? You were commenting on the need
for mixed uses. I was agreeing with that, but then saying that it
doesnt look like much has been done given the years that have gone
by.

I can see why there is a lot of criticism of how its been handled.
I'm still thinking of the big promo with Springsteen concerts and
all.

The places to stay are out of my price range, as are the 'nicer'
clubs and shops. The key to any good revitalization of a down and
out area is a mix thats affordable.

I dont see it and there is really not much entertainment wise in
reality. Funny that you dont think the boardwalk looks 'cheap',
perhaps you dont know what a place like the bandstand building is
supposed to look like?

I am not quite sure to what you are agreeing to in my previous

from 2001 you could drive yourself crazyuse 1/08 or even today
as your frame of reference and move forward from herefuture
looks good in my opinion, why dwell on the past and be negative?

i think the bottom line is that a safe, clean and interesting
boardwalk, beach and city with lots of great businesses, people,
music and entertainment is going to be the deciding factor on the
success of the city not whether or not there is 1 or 3 colors on a
 building.

 Just my opinion.

[AsburyPark] Food For Thought

2008-07-17 Thread sharon_b283
This is a copy of an email I sent to selected Members. I was asked to
post it to the group, so here it is:

Dear Friends of Asbury Park:
Some of us live here and some don't, but it's okay, because my list
consist of those who love this place, have a concept of what life
SHOULD be like here; not just for some but for all of us, please read
the content below and see if you recognize, who READ our groups
gripes, kudos and what ifs! Glenn, it should be obvious to you, in a
conversation we had on July 4th, when we pointed to the roof of the
Berkeley Carteret, noting that the Beach Cam, was NOT working, had not
been working and didn't know when it would be back up and running.

The AC Units atop the 1st Avenue Pavilion and what it doesn't do for
Hotel Guests, across the street. Me realizing that that Pavilion was
where our Seniors USED to meet, were booted out for a cut gas line and
why work men are feverishly finishing this site, but the band shell is
obviously NOT there and if it is, I can't see it! Would you go and
sit up there with all that noise and the heat emanating from those units?

How Asbury Radio was cut off and the minorities that run the station
are fearful of being cut off permanently, if they allow her back on
the air? (My guess). How you can be jailed for being outspoken,
using your property as the reason, when we ALL know it's because if
you get rid of the problem, you can seize the property? I do perceive
Werner's problems as a potential land grab! (My opinion again). That
when one of the Real Estate and City Planning Posters, write about
what their concepts of Asbury COULD be, without compromising the
Historical landscape, would still designate Asbury Park as a
destination instead of a bedroom community, for new residents, who
then question why we don't have this, or that service.

That the people who have had to suffer through benign neglect, since
the riot of 1970, still haven't had their needs met and the West
Siders, should ultimately be consulted since it is THEIR community, no
matter that those on the City Council, have positioned themselves as
overseers and were the problem in the first place! I don't see
anything happening for their good, (my humble opinion), that there for
the grace of God, go I! Whatever, I'm just venting as usual.

So yes, someone is reading the group, but it's okay, because every
time one of us bitches and moans, they act on it, like the Park, but
ignore the overall picture.
Just some food for thought. Be well and have a great summer!

Views are not protected unless there is an easement prohibiting the
parcel from being developed above a certain height. For instance, I
have lost all of the side windows in my offices because a new building
is being developed next door. The question is whether MM acted within
its rights. If it didn't then that is a separate issue. It is
technically irrelevant that the Empress lost its views if MM acted
legally.

Well, if it comes down to legal vs. principle and MM is acting within it's
rights, then the
Empress loses.
But in principle, the Empress has been a viable and successful business
contributing to AP
long before MM came along.
This if from the Empress's website;
Across the street from the Atlantic Ocean and adjacent to historic Ocean
Grove, our hotel
offers breathtaking views of the beach, Wesley Lake, and our oversized pool.
Now, they are offering breathtaking views of air conditioners.
I guess this is a case of big business winning out over the little guy.
Sorry, but I hate that.

Does the design of the building meet the specifications and intent of
the Redevelopment PLAN. No, it does not.

In fact the application submitted for consideration did not show the
addition of air-handling equipment on the roof. It was intentionally
omitted (MM's testimony), they didn't think it mattered.

The proposal was approved based upon an incomplete disclosure
(falsification?) of what the end product would look like and its
impact on surrounding properties.

Comment from the Planning Board to MM was - 'what you built is not
what we approved'.

Its a shame that things are so dysfunctional, The 3rd and 5th Vve
Pavilions also have intrusive equipment added, they also violate the
plan. But there is no one across the street to complain about it.

Seems that taxpayers concerns from ON the street are brushed aside.

2008-07-17 Thread Jack Pitzer
See, this is what I don't get.
On the one hand, all of us residents and fans of AP are excited that things
look better and
that people are coming to check it out.
But, short cuts are being made. Plans aren't being adhered to.
Take the bandshell for instance...it now has a huge AC unit right next to the
stage, and at
the back of the seating area there are heating or AC units. That's just plain
wrong.
But it keeps happening. Is MM going to claim that these things are just
temporary and will
be addressed later? If that's the case, how long does the boardwalk need to be
a work in
progress?
Now we have people cheerleading for MM and making excuses for things that they
are
doing wrong, just because it's better then it's been in years.
MM mostly does right in my opinion, but we should be so intoxicated by the
right that we
don't have the will to point out injustices and what's wrong.

have lost all of the side windows in my offices because a new building
is being developed next door. The question is whether MM acted within
its rights. If it didn't then that is a separate issue. It is
technically irrelevant that the Empress lost its views if MM acted
  legally.

===
===

See, this is what I don't get.
On the one hand, all of us residents and fans of AP are excited that things look
better and
that people are coming to check it out.
If that's the case, how long does the boardwalk need to be a
work in
progress?
Now we have people cheerleading for MM and making excuses for things that they
are
doing wrong, just because it's better then it's been in years.
MM mostly does right in my opinion, but we shouldn't be so intoxicated by the
right
that we
don't have the will to point out injustices and what's wrong.

Jack, right on the money, echoing what I have been saying for years.
The age of desperation has not ever really left Asbury Park and these
are the results we get. The submission/approval/follow-up process
continues to be dysfunctional.

The 'developers', Asbury Partners and now MM, intimidate the City
which has no will to say no, follow its own plans and act in the
interests of the public.

As it stands, the approval for 1st Ave is permanent, the 3rd Ave is
temporary, with a request pending to make it permanent, and the 5th is
permanent. (seems that details such as railings are currently temporary)

I feel there are more children in AP who want to learn than there are children
who don't want to learn and if the powers that be could find a way to legally
separate the two-I know the school system will turn around--but first everyone
has to get on the same accord---the main goal is educating our future.

Discipline needs to be instilled for allchildren-parents-teachers.  The
fight should not be against one another, the fight should be for the children-
their future and our future depends on it.  We need to change  our public
schools from being a daycare center and make it what it was built to be a
school of learning.

the question is  what does one do with the kid that tells you to go f yourself?
YOu send him

IMO
So many variables -
Does the teacher really command respect, know the subject matter and pedagogy
well,  and is he or she a fair and competent teacher?
If so, does the administration and board have zero tolerance for behavior which
interferes with the education of the other students; if so, great reason to
have strong suspension and expulsion criteria.
if not, is there mentoring support for the teacher by master teachers?
Are parents being held accountable for the behavior of their children?  Are
they invited to sit in classrooms?
Is good student behavior being noted and commended?
Do less than effective teachers still get satisfactory observation reports
because the district can't attract any better emplyees,  or conditional
evaluations contingent on specific areas of needed improvement within a
specified time?
If not, do supervisors fulfill their job descriptions to document the poor
teacher performance, required for dismissal?
Are counselors always available to student and not overloaded with too many
students and CYA paperwork?

Just a few examples.  Hard work, but it can't be achieved with lots of catered
luncheons from Frank's, Serpico's, TJ's, et al.

Watch the number of students coming and going to school, particularly high
school, with books, indicating homework.  Usually a good indication of how
serious the district is about academics.

[AsburyPark] Appearance of Pavillions this summer versus last summer

Hi, I thought I included your post? You were commenting on the
need
for mixed uses.

-

We are in agreement on mixed uses.

We disagree on the renovated pavilionsI don't think they look
cheap. Although I think we need to give the boardwalk a bit more
time before we cast a final judgement, it is still a work in
progress.

I have seen some of the pictures Oak has posted of the pavillions
and also viewed them prior to contruction last summermy feeling
is that most people would feel that the pavillions looked tired
prior to the renovation and they look better today? Maybe someone
can start a survey on this?..it would be interesting to see the
results. Pavillion appearance this summer versus last summer?

I'll give you everyone the results to the above question.

98% yes, they look better.

2% No, they don't.

The storage trailers are iffy right now and while they serve a
purpose, don't exactly cut it, in my mind - as they stand TODAY.

I conducted my study/survey the following ways.

1). I grew up on the boardwalk. I wash as old merchants dealt with the
city and the times.

2) I worked and owned a place in the first and third ave pavillons. I
worked in the 5th ave Pav. I can tell you what was leaking and where
and what was done by the city (tar paper) and by us to operate -
nothing short of hard hats.

3) Glass windows on our days and after would typically get a brick or
body tossed through it. The garage doors that lined the boardwalk
really didn't belong on the buildings if you really think about it.
Only Criterion and the other candy shops had all glass. Convention
Hall was empty, the Paramount useless.

4. The boardwalk was caving in and instead of splinters you'd get
nails in your feet. NO one was on the boardwalk - not even pigeons
would bother coming - why would they - nothing for them even to do.

5. The bnadshell became deserted - it became unsafe - as wsa the rest
of the town. And this was long after the riots. IT wasn't jsut Asbury
- Long Branch, AC, Wildwood even POINT. Seaside was it. Wildwood and
Point had a couple fires as did long branch - all aroud the same time.
Unfortunately, AP didn't - not fires weren't consuming alot of the
redevelopment zone. Point, Wildwood and Long Branch all recovered
after their fires. AP was just tooting along.

OVer the years boardwalk businesses cama and went - as it will be now.
Not everyone will make the cut. Maybe some of these ideas are good -
but better in smaller spaces.

AP never had beer/liquor on the boardwalk. Now it does. AP once
purchased lots of old liqour licences on the west side - the belief
from the state that there should not be so many in a small areanow
we'll ahve liquor in every pav.

Sorry about the ramble, I forgot .

Stand on the boardwalk and listen to the older people go past. Listen
to all the different races/nationality/sex and their comments. Very
interesting.

It's a great place. A great boardwalk and a great beach - it's
changing day by day.

I know I am paying Ralph's rent. Another one today. The water park
going in there is top notch. They are putting real dollars into
construction - regardless of the end result. Does it make it right?

Does it make it look better, feel better and attract more people?

The fight should be against entrenched politicians who used charges of

Google's alert fuction trolls the web for me 24/7/365 and I can't keep up with

(http://www.state.nj.us/education/legal/sboe/1997/asbpk.pdf) where the
judge noted this
district was repeatedly late in supplying discovery requests and filing
responsive papers.

And that incompetence was compounded by a board, then, which reputedly
allowed itself to be overcharged hundreds of thousands of dollars by .its
attorney.

The under-the-radar smears against later board members during recent
election cycles equal those being waged against Obama now.

Re: Re: [AsburyPark] Re: IT'S COMING -----OH NO!!!!!

2008-07-17 Thread Michael W. Brim
As they say No good deed goes unpunished, No act of charity goes unresented

The block party is to provide kids going back to school with supplies has
NOTING TO DO WITH THE BOARD OF EDUCATION or what they should be doing ...
period!

The Ridge and Bangs Revitalization Committee and the City of Asbury Park are
working together to give students a jumpstart on the new school term.

As Denise wrote “Just imagine over 1500 children and parents in attendance
enjoying fee food, fun, mentors and entertainment with a guarantee that each
child receives a book bag full of supplies for the upcoming school year (one
less worry)”!

This is more that what the school district should be doing it’s about giving
hope for a better future for each and every child attending school in Asbury
Park!

So, please let's end this subject under this subject heading. If you want to
continue, which you have the right, please do it under another subject title.

Thank you!

Michael

Subject: Re: [AsburyPark] Re: IT'S COMING -OH NO!

The ALJ dismissed this district for inexcuseable incompetence:  Further..., we
cannot ignore the fact that [Asbury Park] was permitted to amend its petition
several times and that it received five separate extentions for filing
necessary papers.  Moreover, Asbury Park had notice as early as November 27,
1996 that Red Bank Regional would be presenting expert testimony to rebut
Asbury Park's contention that its performing arts program was equivalent to the
program offered by Red Bank Regional and yet, at hearing on December 18, 1966,
requested and additional delay so that it could consult an expert. Those
lawyers fees and the luncheon fees can buy / could have bought lots of jackets
and pencils. No offense to those wanting to throw parties these days, but we
are fooling ourselves if we think such nickle and dime fundraising is going to
effect any radical change toward thorough, efficient, and excellent education
here.  In a message dated 7/17/2008 4:59:38 P.M. Eastern Daylight Time, [EMAIL

Re: [AsburyPark] Appearance of Pavillions this summer versus last summer

2008-07-17 Thread charlie
From pictures years ago, the first ave pavilion looked plane.  It may have
been an old building that's been around a few decades but I don't really see
anything that architectural intriguing about the building.
Weather you like the current remodel or not, something needed to be done
with it.  Again, the back was closed off to ocean ave.  Closed in feeling.

Lockers would be great for day trippers to use who come in by train.
I think it would also help to increase the numbers of tourists per
day. No need for parking spaces for these folks either.

I really think when Asbury Park starts to build more hotels in the
future that they ought to promote coming in by train and leaving your
car at home.

Even if you live a block or five or twney blocks away- it might be
nice to clean up before heading home or heading home and coming back
to enjoy the rest of the day or night.

[AsburyPark] Maybe I am glad that I will never have kids!

2008-07-17 Thread dapawprint
I don't know how parents do this on a regular basis!

I have taken the dog with me on vacation, SIMPLE; dog food, bowls,
water and a leash (poop bags too).

The duck is like having a real kid! Diapers, stroller, food, water,
diaper bag, toys, playpen, stuff to clean stuff up! I have been
loading the car all day! I attend to him every day, but taking this
show on the road (and it is only for a weekend!) has tired me out.

At least I'll get a break on tuition!

We'll see all of you tomorrow, good night!

Glenn
