In the OLD Cab case, it just meandered along. So in that sense, Werner is correct. Doesn't matter now whose right or wrong. Hopefully things will keep moving along the RE market will pop again. I just read the most interesting article in the Law Journal. It was written by a fellow who describes himself as the Self Imposed Exiled Something or Other from APNJ. Apparantly this fellow has determined that every single Bankruptcy lawyer and judge in the entire Federal System has had it wrong all these years. Here we were thinking that Federal Statute says that immediately upon the filing of Bankruptcy, the assets of the debtor become the property of the Trustee to be disposed of for the benefit of creditors. I guess we were all thrown off the Federal Statute that, you know, says that. Well this fellow has discovered a double secret statute (seen only by him and kept hermetically sealed in a mayonnaise jar on Funk Wagnalls' porch) that says sometimes the assets are not controlled by the trustee, are not subject to the ruling of the judge, rather a third party has veto power over all of it. This is huge news. It throws the entirety of Bankruptcy Law into disarray. According to the article, if the Trustee and the Judge obtain an offer from a high bidder, some third parties can tell the trustee and the judge to go screw. Such power! As further support for his discovery, he cites several atta boys from Internet posting friends, which appear to have the force and effect of Federal Case law. Who knew? I'll be citing it all as binding authority in my next brief. The City should have foreclosed on all the delinquent tax accounts and should have vigorously prosecuted its case that the redevelopment contract was in default. Here we were thinking that Federal Statute says that immediately upon the filing of Bankruptcy, the assets of the debtor become the property of the Trustee to be disposed of for the benefit of creditors. as in the Dwek case, people don't realize that dwek still owns the properties...meanwhile, the creditors,professionals, lenders brokers and even some attorneys are left waiting to collect, hoping the current trustees and other professionals handling the disposal for the benefit of the creditors don't wipe out the estate with fees. My post was about me not them. Just wanted to make the point to certain folks that I knew what I was talking about when I said a bankruptcy trustee's job is to maximize the income, so anyone could have walked in and bid more, whether the City liked it or not. You're right about not returning to the rest of the stuff and moving on. Except that the Dwek fisaco and the AP deal are two great case studies for a law class. The first deal sold in the Dwek case since November was the former Cranes Fire building on Rt 35 in Neptune was my deal. It went for $380k. One of best commercial deals. The Farmingdale case should of closed prior to the bankruptcy, but didn't. I was in court the day that deal originally was auctioned off by Lehrer. Tommy, forget the board of Ed. Become an attorney for the trustee or action in Bankruptcy. You can go online in the bankruptcy system and see how much the new set of professionals are taking in. I think the new trustee is up to about $3 MILLION. The Dwek case is a big piggy bank for the attorneys. Amazing how they can screw the brokers. We all know that MOST people couldn't get involved in AP at that period in time. There were way, way to many clouds and no one wanted to play the AP game. Larry and deserve credit for being able to pull it off and then benefit on the rest of the little guys coming in to do their thing. And Madison Marquette for the past year to make all seem rosy.
