RE: [AZORES-Genealogy] Re: Translated 4th volume of Saudades

2011-03-24 Thread John Raposo

I just checked my copy which I bought directly from Edna. There is nothing
indicating that it was copyrighted. Although ethical issues about distributing
unauthorized versions are valid, there is another point of view: mass producing
Edna's massive project will perpetuate her memory, at least until a better
translation becomes available, especially among all those non-Portuguese
reading researchers of Micaelense genealogy.

Edna, who did this book, was not a native speaker. She had to work from the
old Portuguese (and probably with some type of translation program) to make it
resemble English. Sort of. Here's an excerpt:

The doctrine is such that it may not permit him to stay in good privileges in
the land, because, of the following. Hanging right away the wrong doers and
thieves, who were believed, had theft in their hands. They had now not worked
on many who were, in fact, avoiding them, without punishment

Huh?

The family part isn't too bad.
The said Nuno Goncalves, son of Goncalo Vaz, The Great, has one daughter
called Isabel Nunes Botelha, that married Sebastiao Barbosa da Silve, much
discrete and generous and grand lecturer, nobleman, who lived on a farm of
Faja, at the city limits of Ponta.

There are very few dates. That's the way that Doutor Gaspar Frutuoso (c. 1522
- 1591) wrote it. The Saudades da Terra wasn't published until 1873.

More on Dr. Gaspar Frutuoso can be found on Wikipedia (it does state that the
article has some problems): http://en.wikipedia.org/wiki/Gaspar_Frutuoso

Re: [AZORES-Genealogy] Re: Translated 4th volume of Saudades

2011-03-24 Thread John Raposo
Dear Sonia:

I would certainly agree that if there is any danger of legal prosecution, then
discretion is the better part of valor, I am grateful to you and Cheri for
educating me as to the law,. I suppose that in the future, when somebody on the
list is desperate for information and I know that there is a treasure trove in
Rodrigo Rodrigues, I will simply cite the chapter and section and tell that
person to look it up in that work. There were only 500 copies printed. How many
do you think are available in the US and available for an intra-library loan? I
bought one of those 6 volume sets. I will take great care to abide by the law
and not  share any information protected by copyright on a public list,

My lawyer tells me that whenever a letter is sent to somebody, there is no
expectaion of privacy, and no protection against disemination. There is no
copyrifgt protection. I wonder if that applies to an e-mail sent to me as a
member of a list?

As for Edna and her fine work, I think she would be delighted to know that she
has left an enduring legacy that will perpetuate her memory. Edna and I
exchanged several e-mails. Her translation of Saudades da Terra went through 3
printings. As for the quality, it is a terrible translation, except for the
fact that since there is no other, it is the best English translation
available. And, it is good enough to do the trick. It has helped many, many
Azorean-Americans connect back to the earliest Azorean colonists and, in some
cases, back to the the nobility and royalty of Portugal. How many copies of
Edna's translation do you think are available in American libraries and
available for intra-libraryt loan? Those who have no access to Edna's book will
need to make do with the original 16th century Portuguese of Gaspar Frutuoso.

I am fluent in Portuguese and can easily read even the handwritten entries in
the Ribeira Grande parish registers kept by Gaspar Frutuoso, so I have no need
of English translations, but I can sympathize with those who cannot read even
typed Portuguese,

Thank you for clarifying the copyright restrictions. However, relative to those
restrictions, unpleasant though those restrictions are, the law is the
law (dura lex sed lex) and I do not want to shoot the messanger.  I cannot help
but quote Charles Dickens, though: If the law says that then the law is an
ass.

I am in your debt and in Cheri's for claifying the law for me. Thank you!

John

I just checked my copy which I bought directly from Edna. There is nothing
indicating that it was copyrighted. Although ethical issues about distributing
unauthorized versions are valid, there is another point of view: mass producing
Edna's massive project will perpetuate her memory, at least until a better
translation becomes available, especially among all those non-Portuguese
reading researchers of Micaelense genealogy.

I am not sure if any CD copies are authorized as the book was published in
paper cover. I would be careful of distributing any burned copies of a CD.
I think translating this would be considered a intellectual work and thus
protected under copyright laws. Even if not how would you feel if someone
took the genealogy work you did and distributed it freely?

2011-03-22 Thread Richard Francis Pimentel
Book 4 of Saudades Da Terra was translated by Edna Phillips kern and
published in 2001. I purchased a copy from her and had this email and
address for her in the cover of the book nerka...@aol.com, 12760 Perris Blvd
A-8, Moreno Valley, CA 92553-2339. I think I paid around $35.

I am not sure if any CD copies are authorized as the book was published in
paper cover. I would be careful of distributing any burned copies of a CD.
I think translating this would be considered a intellectual work and thus
protected under copyright laws. Even if not how would you feel if someone
took the genealogy work you did and distributed it freely?

days of the Azores. Mostly Sao Miguel and Santa Maria...little on the other
islands. Frutuoso, I believed died in the late 1500's. I know several
people on the list have the book. I gave my copy to the Family History
 Library in Oakland.

Re: [AZORES-Genealogy] Re: Translated 4th volume of Saudades

2011-03-22 Thread Cheri Mello
Edna, who did this book, was not a native speaker. She had to work from the
old Portuguese (and probably with some type of translation program) to make
it resemble English. Sort of. Here's an excerpt:

The doctrine is such that it may not permit him to stay in good privileges
in the land, because, of the following. Hanging right away the wrong doers
and thieves, who were believed, had theft in their hands. They had now not
worked on many who were, in fact, avoiding them, without punishment

1522 - 1591) wrote it. The Saudades da Terra wasn't published until 1873.

More on Dr. Gaspar Frutuoso can be found on Wikipedia (it does state that
the article has some problems): http://en.wikipedia.org/wiki/Gaspar_Frutuoso

Re: [AZORES-Genealogy] Re: Translated 4th volume of Saudades

2011-03-22 Thread Pat Nostrome

 Cheri,

If we go to Google books they have the original book in Portuguese on ebooks
available and it can be read on the computer.

Saudades da terra. [Historia geneologica de Sam Miguel
By Gaspar Frutuoso, Francisco Maria Supico, José Pedro Cardoso

Maybe we aren't Portuguese readers but we can look thru the 278 pages.

That's what I am going to try and do. If I find a relative I will try to
translate.

Maybe that helps alittle.
