What they want is to lead others in prayer. They have a deep desire to convert others to their specific beliefs. The Bible instructs us to pray in private. Hitler with his Gestapo, his Nazi party and all his concentration camps could not stamp out the Jewish faith. It is the same with true Christians. They do not need the company of others or the inclusion of their particular practices in various institutions (including schools) to maintain their faith in Christ. If they need such crutches, then they need much more than prayer in school can do for them. Let them invite the students they wish to influence or convert into their homes and churches. The incident quickly poisoned a U.S. attempt to revive security cooperation between Israelis and Palestinians. After the meeting, three Palestinian officials -- Public Security head Abdel-Razek Majaydeh, Preventive Security chief Mohammed Dahlan and top intelligence officer Amin Hindi -- were ferried to the Gaza border in U.S. Embassy vehicles. At some point after the three boarded their own jeeps and a silver Mercedes-Benz, bullets and shrapnel hit the convoy. As the jeeps sped away, one flipped over and two bodyguards suffered broken limbs. "The shooting was planned. . . . We could have been killed," Hindi said. Israeli officials said the Palestinians shot first and that Palestinian gunmen left their cars to continue shooting from nearby buildings. The Israelis offered to join the Palestinians in investigating the incident. However, Brig. Gen. Yair Naveh, who commands Israel's Gaza division, said after the incident that his soldiers "acted appropriately." An Israeli Foreign Ministry official said, "We cannot justify the shooting, but we think we can explain it." The outbursts marred the reentry of U.S. officials into face-to-face talks between the sides. Israeli and Palestinian security officers met near Tel Aviv at the residence of U.S. Ambassador Martin Indyk; a CIA official presided. Both Palestinian and Israeli officials described the get-together as an exploration of whether the sides can revive the cooperation that ended six months ago when the Palestinian uprising erupted. State Department spokesman Richard Boucher said the meeting was "positive and useful." After daylight, however, violence flared throughout the West Bank and Gaza Strip. A top official of the militant Islamic Jihad movement, which rejects compromise with Israel, was assassinated in the West Bank city of Jenin when a public phone exploded as he made a call. Palestinian officials said Israeli planes flying near the city detonated the hidden booby trap by remote control. Israel had accused the victim, Iyad Hardan, of masterminding bomb attacks on civilians inside Israel, including one that killed two Israelis in December. The Nation - April 13, 2001 US Special Forces join drugs war CRACK troops from the United States will join Thailand's war on drugs in the coming months, in a new bid to stem the enormous flow of drugs from Burma. About 20 soldiers from the US First Special Forces Group will train Thailand's newly formed Task Force 399 starting from October, a senior Third Army officer said yesterday, on condition of anonymity. The secretive task force - made up of 100 members of the Thai Special Forces, two infantry units with about 100 soldiers each and a 100-strong unit of Border Police - will be based out of Chiang Mai's Mae Rim district, the officer said. The American Special Forces will arrive here next month along with 5,000 other American soldiers to take part in the annual joint-military exercise, Cobra Gold, with their Thai counterparts. Creating the anti-drugs taskforce is the latest tactic by authorities to curb the flow of illicit drugs, mostly methamphetamines, from areas under the control of Burma's armed ethnic rebels, particularly the United Wa State Army (UWSA), which operates with little hindrance in Burma's Shan State. Anti-narcotics cooperation between Thailand and the US has a long but relatively unpublicised history, Panitan Wattanayagorn, a security expert at Chulalongkorn University, said. Past operations were pretty much focused against opium-poppy cultivation and heroin trafficking, which Thailand sees as mainly affecting other countries. But because growth in synthetic stimulant abuse has become a local issue detrimentally impacting just about every corner of Thai society, said Panitan, news about the American Special Forces working with local troops was likely to attracted great attention. Up to 800 million speed pills produced in Burma's north were expected to flood into Thailand this year, the officer said, adding that the UWSA was responsible for most of the illicit drug production. The UWSA came into being in 1989 shortly after the fall of the Communist Party of Burma (CPB). It soon signed a cease-fire with the military government in Rangoon. The bulk of the UWSA's troops served as infantry for the CPB, which was backed by the Chinese Communists before it fell apart. Under an agreement with the Burmese junta that allows it some degree of autonomy, the 20,000-strong outfit has extended its power base in Burma's Shan State from along the Chinese border southward to areas across from Thailand's Mae Ai and Fang districts. New towns such as Mong Yawn and Mong Mai, built by hundreds of Thai labourers and Thai construction companies, have sprung up in recent years as millions of methamphetamine tablets, known locally as yaa baa, have been sent across the border and sold in Thai cities. The trade proceeded relatively unperturbed until two years ago when the bodies of nine Thai nationals from Chiang Mai's Fang district were discovered by the border near the Wa area. All fingers pointed to Mong Yawn for the murderers. Thai authorities were forced to impose economic sanctions against the Wa by closing the border crossing to their territory. The Burmese regime, on the other hand, has come under strong criticism from both Thailand and Western countries for turning a blind eye to the Wa's illicit activities. Thailand's Third Army commander, Lt General Wattanachai Chaimuanwong, has accused a number of top Burmese military chiefs of taking bribes from the Wa. The Nation - April 13, 2001 LETTERS Give credit to the Shan State Army I WOULD like to commend you for telling the story of the Shan State Army (SSA). There are those in the media and other sources who have been attempting to tell of the changes in direction, especially in the area of drug production, brought about by Colonel Yaud Serk of the SSA. These have been laughed off by United States operatives, who have preached an allied effort with Burma while on the surface, keeping the country where it belongs, on the drug-producers' list. None of these US operatives ever went to the SSA area to see if changes had in fact taken place. Do not look for any changes in the US State Department position. Secretary Powell has named Richard Armitage, who Khun Sa named as his "US connection", his number-two man and most trusted assistant. Khun Sa, with the multimillion-dollar reward on his head, resides in splendour beside his new Burmese allies. The Wa have joined the Burmese Army in attacks on all ethnic groups, especially the SSA. These have been repulsed time and again. The drug labs and caravans hit by the SSA were joint Wa/Burmese operations. No pat on the back from the USA for that. You did a great service by showing the Shan on the march against drugs and dictatorship. But I would not hold my breath waiting for US State Department recognition of these changes. I spoke today with Bob Popovitch James Nichol's best friend in Michigan. He is one of a handful of people that McVeigh calls on the phone. McVeigh can make one 15 minute call a day. Most calls go to his father and sister Jenifer. Our Attorney General has announced that McVeigh can have no more contacts with journalists. That Ashcroft maintains could open wounds, like the American people seeing the Zapruder film would. Bob Popovitch is a good American. I am proud of him for what he has endured. Bob did not know McVeigh well. I believe McVeigh only visited James Nichols with Terry Nichols once. Still Bob is not certain he is talking with McVeigh. He believes he is. But with his limited acquaintance with McVeigh Bob feels McVeigh's mind has been altered. McVeigh is a big puzzle. His "book" backs up the FBI 100% and implicates his friend Terry which seems out of character for Tim. Playing ball to protect the lives of his father and sister does seem in character for McVeigh. I viewed home movies of the teenager McVeigh. I saw a well adjusted teen who was surrounded by good friends. Tim was actually advanced for his age purchasing land early on and doing many responsible things. Tim was given the lead role in the DESERT STORM attack as the lead gunner on the lead tank. This assignment is typically the most dangerous of an assault and earned him the title "hero of DESERT STORM" and a position on the honor guard of General Norman Swartzcoft. He was accepted into Special Forces where no doubt he was recruited for a special assigment --- like the special assignment Lee Harvey Oswald was recruited for after he penetrated the Soviet Union as an agent for James Angelton. It requires great precision when the stakes are as high as the bombing of the MURRAH BUILDING or the assassination of a president. That is Oswald and McVeigh. Oswald was working a deep security assignment doing photo developing of the CIA's U-2 spy photos of Cuba under the supervision of Theodore Shackley of the Miami JM-WAVE station. The Attorney General of Texas Wagner Carr sent the WARREN COMMISSION into secret session when he revealed that Oswald was an FBI informant and revealed Owsald's agent number. The 1st two days of riots were controlled by members of the coalition n16. They staged a Seattle like World Trade protest in Nov 2000 in Cincy and many got arrested. Well, they were in town last week for their courts dates, they were acquitted or the charges were dropped on ALL protesters that challenged the arrests. this ticked off the group and they vowed to get even, (see Cincinnati City beat local newspaper). There tactics were to get a large group 50-100 and then send out a smaller group out from the initial "protest-riot " starting point. The police would move on them to get them back and the large group would pull a pincer movement and the police would fall back. The protesters were able to drive the cops back about 3-5 blocks and this left the "over the Rhine" area open for the subsequent riot and damage. On Wednesday the black panthers moved in and their tactics differed from the more urban/modern/anti Biz Seattle type protesters". The Panthers used CB radios and they went mobile we had early reports (being a Libertarian I have friends not only in high and low place but left and right, I helped train the street medics for the n16 demos's in Nov) that 2 police stations were to be burned after dark. The riots started up at 4-pm on Wed and the Panthers moved out of Downtown to the east (Imagine Cincinnati in bowl, the city in the bottom ring by hill on all side and a river to the South) . At this point they went right into property damage and attacking whites. The police responded up the hill with a bus full of riot police and drove them back. They started fires to cover their withdraw and then headed up a "Main Drag" called Reading Road. They attacked one woman and when the police tried to help they shot at the cops. the woman laid in her call comatose bleeding from a head wound for over 45 mins. They 1st group continued north attacking and burning as they went. A second group headed east and gained more support and tried to re enter the 2 nd riot site from the North. through another small city call Norwood. The Norwood police, in NO uncertain terms told them they shoot real bullets not rubber ones. Those folks then dispersed and headed for a police sub station and burned it. At the same time the rioters in Downtown were setting fires to draw out firemen and then shoot at them from sniper on top bldg.. The fire dept. would have police escort and came in from the North (off a parkway) to fight the fire. When this happen the fire station (6 block west) was not guarded. The rioter started fires around the fire station and when the firemen came out they attacked and shot at the firemen. At 1025 PM in the north of town, the amount of gun fire was heard over police radio as they called in they were taking numerous shot from handguns rifle and possibly full auto. In downtown the Cop was shot at 1115-PM. At that point the 2 swat teams moved in and cleared a few bldg. They did not get the shooter. They then retreated in unit formation to a rally point and sat out the nite. On Thursday morn the Mayor signed a curfew and it has been somewhat calm. The governor sent in over 135 Highway Patrol cars each with 2-4 troopers 12 command cars and 4 large equipment truck, ( I am an MP at the Air National Guard base that they used as an advance rally point before they deploy into the city) Out of the 14 black men shot by police 11 shot at the police 1st after various crimes, including armed robber, drug bust gone bad, one even tried to car jack a POLICE car with the female cop inside. She was shot 3 times with a 357mag at less than 1 foot. She was then pushed to the side and the guy drove off, the female cop radioed in the attacked and was able to draw her sidearm and kill the now driver, sending them crashing into a bldg. She lost her spleen. Another black male drug a cop to his death over 700 feet as his arm was caught in the door/sterring wheel. After over 500 feet of dragging, ( and after parts of his body were torn from his body) the officer shot the driver, causing the police office to fall and die in the street. the driver later died. Then there was the guy who, (and on audio tape) jumped out at cops doing a drug raid, his words were, I am going to die like a soldier, he emptied his weapon at police hitting a couple of cops. 3 of those 11 took an officers gun and shot cops. 2 cops died (2 years ago) when they tried to serve a warrant, the thug was later Killed. CINCINNATI, April 13 Charles Wimms looked back today from some fresh scars on storefronts in the black Avondale neighborhood to the old, still chilling memories of the last time local youths erupted in violent protest, when the Rev. Dr. Martin Luther King Jr. was assassinated more than three decades ago. "This wouldn't have happened if they had listened to us in those years back then," said Mr. Wimms, a 39- year-old construction worker, recalling that police treatment of black Cincinnatians the issue that drove the wave of protest and vandalism by clusters of angry blacks this week was also a principal issue in the 1968 violence. "So now we have a new generation of young black men running the streets again to stir things up for what is right," he sadly contended. Mr. Wimms stood before broken windows where youths looted a sneaker store on Wednesday night, at the height of protests over a white police officer's fatal shooting of an unarmed black teenager last Saturday. Blacks maintain that the killing, the fourth of a black by the police since November, resulted from racial profiling that they say has long been rampant here. While an investigation into the killing proceeds, officers quoted in the local press have disputed that version of events. They say the slain teenager, Timothy Thomas, was pursued by officers in the first place not because he was black but because the officers had recognized him as someone against whom a total of 14 warrants were outstanding, although most related to traffic charges. With Easter-season allusions to resurrection and regrets at the damage to this city's streets and reputation, people like Mr. Wimms warily greeted the return of civil order after an all-night curfew took hold, with no clear idea of when it might be safe to end it. The Bush family paid $240,342 in federal taxes, the Cheneys $14.3 million. Bush released a federal Form 1040, without attachments. Cheney released only a summary prepared by the White House. The information was released in Crawford, Texas, where the president is spending the weekend. The Bushes reported donating $143,300 to charity, including $75,000 in royalties from his biography published during the presidential campaign last year, ''A Charge to Keep.'' The book sale proceeds went to four organizations: Boy Scouts of America, Girl Scouts of America, Boys and Girls Clubs of America and Girls Inc. The Cheneys donated stock options worth $7.8 million to three beneficiaries: Capital Partners for Education, which provides educational assistance to low-income children in Washington; George Washington University Medical Faculty Associates, the hospital where he has been treated for his heart condition; and the University of Wyoming, in Cheney's home state. They also donated $41,646 to other, unspecified, charities. Cheney's tax total put him in the rarified realm of the top 39.6 percent tax bracket, which Bush wants to eventually reduce to 33 percent. Stephen Jones said he would file papers today seeking a 30-day delay. He met with McVeigh for 1 1/2 hours Monday and described his client as "polite, cooperative, anxious." The Alfred P. Murrah Federal Building was to be demolished by this weekend. City officials were to announce Wednesday exactly when the building will be taken down with explosives. Jones said he had written to Assistant U.S. Attorney Arlene Joplin seeking an informal agreement to allow him to examine the building "to get the feel of it, see it, take pictures and measurements and have the engineers we will consult with take measurements and video." Jones also said the taxpayer-funded $125 an hour plus expenses he is charging for defending McVeigh is fair, and that he normally would charge $175 to $200 for such a case. Michael Tigar, the attorney for suspect Terry Nichols, also will charge $125 per hour. While the rate is high for court-appointed attorneys, it is much less than lawyers make in private practice, particularly in high-profile cases, said Randall Coyne, a University of Oklahoma law professor. "That's dirt cheap and well below the prevailing rates for private attorneys," said Coyne. He said top defenders often charge $300 per hour to clients who can afford them. "I doubt very much that Johnnie Cochran, for example, is charging O.J. Simpson such a meager sum," Coyne said. But even that relatively small amount will add up in a case that may not go to trial for at least a year. A lawyer who bills 40 hours a week for a year would charge $260,000, and Coyne said 40-hour weeks are rare in capital cases. "These cases can't be handled nine-to-five; they possess your life," said Coyne, a death penalty defense specialist. McVeigh and Nichols are charged in the April 19 bombing that killed 168 people. They face the death penalty if convicted. In addition to lawyers' fees, the government must pay for the defense's independent investigation of the crime. -Caveat Lector- Sting exposed men to HIV, lawsuit claims But prostitute never had sex to complete the drug deals, say police in Okanogan Friday, April 13, 2001 By TRACY JOHNSON SEATTLE POST-INTELLIGENCER REPORTER A rural Washington police task force used a prostitute to lure men into supplying her drugs -- an undercover operation that one man claims exposed numerous people to the virus that causes AIDS. A lawsuit against Okanogan County and the North Central Washington Task Force contends police should have known the danger of turning a convicted prostitute into a police informant. "It's outrageous police misconduct to do such a thing," attorney Rodney Reinbold said. "The government has no right to prey on men who are lonely and expose them to AIDS." County Prosecutor Rick Weber, acting as the attorney for the county and task force, said the woman, who says she is HIV-positive, helped nab eight or nine drug suspects. But he maintained that she did not have sex with any of them. "She disputes that she was using sex to complete these drug deals," Weber said. "She denies it. We deny it." The 31-year-old woman signed on as a task force informant in November, after she completed drug treatment. The officer who had arrested her for smoking pot talked her into helping the task force, according to court documents. She is no longer helping make busts, Weber said, though she still testifies against drug suspects in court. The lawsuit was filed March 30 by John Danny Shearer, an apprentice plumber who was arrested for delivering marijuana. The 49-year-old Methow Valley man claims the woman made sexual advances toward him, cajoling him to hand over some of his pot. They had sexual contact at least a few times, according to his written statement, and now he is fearfully waiting to learn if he is HIV-positive. Five other men arrested on drug charges have come forward, worrying that the woman may have infected them, Reinbold said. He will ask for approval of a class-action suit to seek damages for the other men, along with their partners and their future mates. Several men gave sworn statements claiming the woman made sexual advances, then persuaded them to go find her some drugs.At least three said they had sexual contact with her, completely unaware of her HIV status. Another man who simply knew the woman claimed "she intended to infect as many men, women and children as possible before she died." Reinbold contends the task force knew the woman was HIV-positive. She has disclosed it in several public court hearings, and she even said she told the task force herself, according to court documents. The lawyer also argues that the task force must make sure its informants are gaining the confidence of drug suspects with sex. "They had an obligation to watch her and know what she was doing," he said. A Chelan County judge has banned the task force from employing prostitutes until April 30, when she will hear arguments from both sides. Shearer's earlier claim sought millions of dollars: $100,000 for people who needlessly worried that they were infected with HIV, and $2 million -- plus $15,000 each year for medical expenses -- for those who contracted the virus. It also sought $2 million in punitive damages, roughly five times the task force's $400,000 annual budget, Reinbold said. Aside from money, Shearer's lawsuit also asks to have all drug cases that involved the woman dismissed. As a tradeoff, the men would have to take mandatory HIV tests. Reinbold contends that's the only way to help keep the men from spreading the deadly virus unknowingly, a measure he deems more important than prosecuting crimes that involved negligible amounts of drugs. The drug task force has been around for more than a decade. It targets drug crimes using the combined resources of police in cities like Omak, Okanogan and Winthrop with county and state officers. The Okanogan County Sheriff's Office oversees its efforts. The use of informants is not new, said Weber, the county prosecutor. Officers learn all they can about someone's past, he said, then they make "a judgment call" about whether they would make a trustworthy informant. They were fully aware that the woman at the center of controversy had a long rap sheet that involved prostitution, he said. "Drug task forces have a difficult job," he said. "In order to deal with the criminal conduct, they're essentially required to employ people who fit into that part of society." The woman said she was paid for her undercover work, according to court records. First it was $225 per case, then $50 for each drug buy, and most recently, a flat $75 a day. Weber said the task force had no policy about using people who are HIV-positive, simply because the issue hadn't come up before. He said he didn't know when the task force learned of the woman's HIV status. Brian Puckett, founder of Citizens of America -- a California-based pro-gun organization, and Russ Howard, a past director for the National Rifle Association and founder of Citizens Against Corruption, have developed a new system that would "replace the existing firearm purchase background check system with an identity search/firearms disability check that eliminates the risk of gun registration inherent in the current system." Currently, gun buyers are subjected to NICS -- the National Instant Check System, operated by the FBI via its West Virginia facility -- that immediately informs a gun dealer whether a customer is wanted by police, has a criminal record that would prohibit the purchase of a gun, or is prevented from owning a gun for other reasons. But Puckett and Howard have come up with a different system they call "BIDS" -- Blind Identification Data System -- which purports "to eliminate gun owner registration while continuing to provide for a system to prevent illegal gun sales by dealers." "In BIDS, the word 'blind' refers to the fact that the government cannot detect who is attempting to buy or has bought a firearm and thus cannot add this person's name to a registry of gun owners. Nor can gun dealers randomly view a list of persons who have been denied the right to buy, own and use firearms," the authors said in a published report about the new program. The report calls the NICS system "deeply flawed" because it "provides the means for the government to create and update, with relative ease, an illegal registry of firearm owners." FBI officials say gun buyers are not kept in a permanent database or registry, but despite that, the BIDS system, the authors argue, would alleviate that possibility for good, should lawmakers ever attempt to force the agency to record gun buyers and transactions in a permanent database. Also, the authors said, "Gun owner registries have already been created in certain states (Illinois and Pennsylvania, for example) and the federal government continues to compile a microfilmed list of gun purchasers via surrendered Form 4473's." The BIDS system, the report said, uses computer and Internet technology to allow firearm dealers to determine whether or not a potential buyer is prohibited from purchasing a firearm, but without the government ever knowing the potential purchaser's name or whether or not he actually bought a firearm. "Historical records, such as The Federalist Papers, clearly show that the Second Amendment is intended to stand as a bulwark against establishment of a tyrannical American government," the report said. "It is elementary that the spirit of the Second Amendment opposes the establishment of federal or state registries of gun owners, which would greatly simplify confiscating guns or rounding up gun owners by such a tyrannical government." Also, the report cites federal law, which prohibits government collection of gun ownership information. Section 926 of the 1968 Gun Control Act, the authors quote, says: "No such rule or regulation prescribed after the date of the enactment of the Firearm Owners' Protection Act may require that records required to be maintained under this chapter or any portion of the contents of such records, be recorded at or transferred to a facility owned, managed, or controlled by the United States or any State or any political subdivision thereof, nor that any system of registration of firearms, firearms owners, or firearms transactions or dispositions be established. ..." Also, the authors said the so-called "Brady Law," which codified the NICS system, also prevents firearms transaction and ownership records from being permanently catalogued in a database: Section 25.9(d) -- The following records of state and local law enforcement units serving as POCs will be subject to the Brady Act's requirements for destruction: (1) all inquiry and response messages (regardless of media) relating to the initiation and result of a check on the NICS that allows a transfer that are not part of a records system created and maintained pursuant to independent state law regarding firearms transaction; and (2) all other records relating to the person or the transfer created as a result of a NICS check that are not part of a records system created and maintained pursuant to independent state law regarding firearms transactions. There she was, Florida Secretary of State Katherine Harris, embraced by the rank-and-file Republicans who believe she deserves much of the credit for President Bushs victory. But now, in the aftermath of Floridas colossal political dispute, the states leading Republicans are keeping their distance. People in this town are backing away from her, said a key GOP aide in Tallahassee. The Republican Party cant say it, but there are certainly elected Republicans who would rather not be in the public spotlight with her. Its unwise politically. Harris office calendar tells the story. The secretary of state was invited and then abruptly uninvited to join Gov. Jeb Bush and members of his election reform task force as they revealed their findings this month in Tallahassee. Minutes before the event began, Harris said she was told by the governors office that her presence was not needed. Days later, as a thunderstorm pounded the state Capitol, Harris canceled a news conference where she had planned to unveil her $200 million plan to modernize Floridas voting system. Her aides said Harris canceled after the fierce storm kept her from giving a preview to the governor, the Senate president and the speaker of the House. But the leaders aides said they had no plans to attend the event, rain or shine. I think its very strange, Harris said when asked to explain the back-to-back jilting. Nervous Republicans To be sure, Republicans here are nervous. Even though the next state election is 20 months away, the Florida Democratic Party is already airing television ads attacking Jeb Bush. With those commercials in mind, GOP political strategists say its dangerous for Republicans to align themselves too closely with Harris. Democrats, meanwhile, are savoring the possibilities for future television ads, many of which are sure to feature Harris. Theres a whole lot of fodder out there, said Tony Wyche of the Florida Democratic Party. Four months after one of the most controversial elections in American history, Harris spends much of her time traveling around the state. She delivers up to 35 speeches a week, giving Republican audiences a peek into her thoughts from the election dispute. The grandchild of a Florida citrus and cattle tycoon, Harris is a former state senator and served as the state co-chairwoman of the Bush presidential campaign. But her relationship to the Bush campaign was barely noticed until after the election. Harris certified the results that gave Bush a 537-vote margin of victory in Florida and thus the presidency. From my rise from some sort of obscurity to notoriety, famous, infamous depending on what side of the aisle youre on, you learn the value of perspective, Harris said. I certainly think I developed a sense of humor. I used to not be able to laugh at myself. I took myself so seriously. But at certain points you either had to laugh or go to the 22nd floor of the Capitol and find an empty window. Though Harris is the states top election official, she is one of Tallahassees few ranking politicians who has not been invited to testify before election reform committees in the House and Senate. Its a vast change from three months ago. Then, one day after Vice President Al Gore conceded the bitterly fought election, the Florida governor and secretary of state stood side-by-side before a bank of television cameras and pledged to reform the states troubled election system. Shes either a heroine or the devil incarnate, said Susan MacManus, a professor of political science at the University of South Florida in Tampa. Theres not much in between. Political liability Harris self-described lightning rod image is bad for political business as the Republican-controlled Legislature tries to salve the raw wounds from the 36-day election dispute that ultimately delivered the presidency to Bush. Jeb Bush, the presidents younger brother, also is trying to calm the political waters before facing a potential re-election campaign in 2002. And even though the secretary of state insists she used the law, not politics, to guide her during the five-week election controversy, political strategists say she is unlikely to shed the image she picked up after the election. http://www.counterpunch.org/ Bombing Big Sur Apparently, the deserts of Nevada, so similar in terrain to the Pentagon's other main target practice area, the Iraqi outback, simply aren't challenging enough for the Navy's top guns any more. Now they want to bomb Big Sur. A new plan issued by the Navy's Strike Fighter Wing in January calls for nearly 3,000 bombing practice a year runs from Lenmoore Naval Air Station, in the Central Valley, and aircraft carriers in the Pacific, to Fort Hunter Leggett, in the Santa Lucia Mountains near Big Sur. Lemoore is the home base for the F/A-18 Hornet strike fighter planes. The scheme calls for the jets to drop 25-pound "test" bombs onto a 500-foot in diameter target painted on the grounds of Fort Hunter Liggett. One Navy flack called the plan "kindergarten for bombers". Pressed by Congressman Sam Farr (D-Monterrey) to explain itself, the Navy, perhaps trying to capitalize on the current fuel crunch, says it all comes down to conserving energy. By bombing Big Sur, instead of Fallon, Nevada, they can save nearly $3 million a year in fuel costs. It's curious that the Navy doesn't show such a penny-pinching attitude when it comes to funding for Trident submarines, F-22 jets or aircraft carriers. The 150,000 acre military base, nestled next to the Ventana Wilderness Area, was sold to the Pentagon, at a handsome profit, by William Randolph Hearst in the 1940s, who had evicted the remaining Salinan Indians from the site when he purchased it as his private pleasure ground in the early 1900s. Today, the upper Stony Valley area, wedged in the mountains, is still largely an entact ecosystem, a thriving oak savanna of the type that is becoming increasingly rare as so much of the coast falls to the bulldozers of developers. Indeed, a 1981 report commissioned by the Fort's top brass concluded that the base probably contained a "greater conservation of resources (of grassland, oak savanna and woodland, and chaparral) than any other contiguous parcel in the state of California." The land is so special that National Park Service has tried to get the Army, which manages the Fort, to turn over to them. This part of the California coast is home to some of the nation's rarest and most prized species, starting with the California condor and the sea otter. There are also endangered fairy shrimp, Pogogyne clareanna, a rare mint endemic to the area, bald eagles and 450 Tule elk. Not to worry, says the Navy, we have the best interests of these creatures at heart and no harm will come to them. This is a rather robust bit of eco-consciousness from the same group that is even now attempting to secure the right to permanently bombard humpback whales in the Pacific with mega-shots of high range sonar. The sonar pulses have been known to cause the whales to issue cries of distress, become disoriented and beach themselves. The Navy's underwater soundings have also been linked to ear hemorrhages in the giants of the deep. Those bullseyes for the Navy fighter jets' bombs would nearly mark the precise area that the now landless Salinan tribe considers as the center of the creation. And indeed the area harbors one of the richest clusters of archaeological sites on the California coast, including painted caves and a delicate and fragile sandstone natural arch used for vision quests. "It only takes one bomb to land in the wrong place," says Gregg Castro, head of the Salinan tribal council. "The arch is unique. Once it's gone it's gone. There's no repairing it." There are also several private inholdings within the proposed bombing range, including the San Antonio de Padua Mission, founded in 1771. The Franciscans--the closest you get to a nature sect in the Catholic Church--aren't too pleased about their ancient sanctuary being buzzed by F/A-18 fighter jets ten times a day. The Friars are joined in opposition with the Benedictines, who have just built and opened the New Camaldoli Hermitage, a hillside retreat meant for quit meditation and worship, a few miles away. Forgive the residents of the coast if they are a little bit skeptical of the top guns at Navy HQ. After all, this is the same Navy which just sank a Japanese fishing boat because the sonar crew was distracted by a group of big time Republican donors who had been allowed to pilot a billion dollar submarine. Will execs from Boeing or Microsoft be allowed to co-pilot bombing runs? It's also the same outfit that had to admit that more than 40 percent of its "smartest" bombs had missed their target in the recent remote control bombing of Baghdad. The Navy brass blamed those recent misfires on wind. Well, there's plenty of that on Big Sur. So you can excuse the residents of San Luis Obispo and, even Salinas, if they are somewhat anxious about the Navy's novice bombardiers ability to consistently hit their targets. The average temperature of the Atlantic, Pacific and Indian Oceans has risen 0.06 degrees C since 1955. Two separate studies - both carried out using computer modelling techniques - have now linked that rise directly with global warming caused by human activity. "I believe our results represent the strongest evidence to date that the Earth's climate system is responding to human-induced forcing," said Dr Sydney Levitus of America's National Oceanographic and Atmospheric Administration in Silver Spring, Maryland. Ocean simulation Dr Tim Barnett of Scripps Institute of Oceanography, in La Jolla, California, who led the other research team, indicated the implications of the findings were not straightforward. He said: "Warming in the oceans is bad news and good news. It really does add strength to the claims that global warming is here. But it also suggests that the immediate impact may not be as great, because the oceans may slow things down a little." Each research team used a different computer model to simulate how ocean temperature should respond to current levels of greenhouse gases and other atmospheric conditions. Both predicted a warming similar to that measured by scientists. The Scripps team also ran their model without the extra greenhouse gases and sulphate aerosols produced by human activity and found that without these the simulated ocean did not warm significantly. 'Big and bold' signal "What we found is that the signal is so bold and big that you don't have to do any fancy statistics to beat it out of the data. It's just there, bang," said Dr Barnett. "The odds are exceedingly good that the model did not trick us with this signal. It couldn't have done it by itself." He added that the findings "will make it much harder for naysayers to dismiss predictions from climate models." In their model, the team from NOAA also factored in the effects of the sun's changing intensity and the aerosol particles produced by volcanic eruptions over the last century. 'Robust' models They too found a very close match to the actual measurements. Dr Levitus said: "The fact that the model ocean warms by approximately as much as our observed estimate indicates that the models are very robust in simulating the observed changes in the Earth's climate system during the past 100 years." Both sets of results are published in this week's Science magazine. Computer models have come in for criticism in the past. Earlier versions included measurements of atmospheric temperatures, but not ocean ones. Revising predictions As a result, it is thought that they frequently predicted that air temperatures would increase by more than they have - as the oceans absorb heat. The findings have often been used by sceptics, who have argued that global warming predictions are exaggerated. No doubt some will continue to argue that modellers can get any answer they want about climate change, simply by adjusting any of the numerous inputs into them. The researchers themselves agree more work is needed to make computer models deliver more consistent and specific predictions. But Dr Levitus says that one important benefit of the new research is that "in future, models will have to get the ocean right in order to be believable. These results raise the bar for sorting out the best models".

Earlier this week, the U.S. State Department welcomed a step by Cambodian Prime Minister Samdech Hun Sen -- a former leader of Pol Pot's Khmer Rouge -- toward the resettlement in America of 24 ethnic minority Montagnards who had fled their homes in Vietnam. The 23 men and one woman were arrested in remote northeastern Cambodia nearly a month ago and have been held at military police headquarters in Phnom Penh since March 24. The decision by the U.S. drew a strong protest from the communist Vietnamese dictatorship. Vietnam called the granting of asylum interference in Vietnam's domestic affairs that would encourage illegal border crossings and regional instability. Why did the 24 Montagnards flee their own nation and travel through jungle, valleys and landmined fields on their way to Cambodia? The Vietnamese government has been persecuting the Montagnards, many of whom are evangelical Christians, for over a quarter century. Vietnamese dissidents in exile have long accused the communist government of brutality repressing Christians and Buddhists, saying hill-tribe people were attacked and tortured to death after recent protests in the Central Highlands. The Unified Buddhist Church of Vietnam, Buddhist Hoa Hao, the Catholic Church and Protestants of the Central Highlands have all been repressed by the government. The Buddhist church, banned since 1981, has been severely persecuted. Patriarch Thich Huyen Quang has been detained in his pagoda without trial for 20 years. "Actually, the Vietnamese dictators want the Montagnards trapped inside Vietnam so they can control them and kill them," said Don Scott, who works with the hill tribes of Southeast Asia and acts as the American representative for the exiled anti-communist Prince of Laos. The State Department praised Hun Sen -- whose son graduated from West Point last year. Hun Sen was placed in power by the Vietnamese when they invaded Cambodia on April 17, 1979, to overthrow Pol Pot and his genocidal regime. The U.S. and UK responded by arming the Khmer Rouge cadres in western Cambodia to act as a buffer to keep the Vietnamese from invading Thailand -- a key U.S. and UK ally. By granting asylum to the 24 Montagnards, America's relations with Vietnam could be strained. One of the Clinton administration's last acts in office was to establish formal trade ties with Vietnam's Marxist government. "We ... welcome the decision by Cambodian Prime Minister Hun Sen to allow processing for third-country resettlement those persons determined by the U.N. to be refugees," State Department spokesman, Philip Reeker, said in a statement. The Vietnamese were livid. "We protest the granting of permission for these people to settle in the United States," Foreign Ministry spokeswoman Phan Thuy Thanh said in a statement urging their return to Vietnam. Earlier this week, U.S. ambassador to Cambodia Kent Wiedemann said officials of the U.S. Immigration and Naturalization Service were due in Phnom Penh to start processing the group for resettlement in the United States. Over 50 members of Congress have signed a letter urging democratic reform in Vietnam. The European Parliament has also pushed the letter, which will be delivered by Buddhist Monks to Vietnamâs communist government. Wiedemann dismissed Hanoi's complaint of interference. "It's a humanitarian issue, not interfering in Vietnam's affairs," he said. "These people came into Cambodia ... and we interviewed them based on the claim that there was a good chance they would face persecution if they returned." As for the Montagnards fleeing Vietnam, they said they fled their homes to escape Vietnam's crackdown on recent unrest. Thousands of ethnic minority farmers took part in anti-government protests in Vietnam in early February, the biggest for years in the communist country. Recently, the Montagnards engaged in a march in Washington, D.C., to call attention to their persecution in Vietnam. Some marchers also demanded that Americans boycott Vietnamese coffee and Nestle products. The latter has ingredients from the communist state. The U.S.-based Montagnard Foundation, which represents the mountain tribes, wants to see trade and foreign aid cut from the Western nations to Vietnamâs regime. Bush Baffles Med-Privacy Pundits by Jeffrey Benner 2:00 a.m. Apr. 13, 2001 PDT The Bush Administration baffled pundits and defied predictions on Thursday when it decided to allow sweeping privacy regulations drafted under the Clinton Administration to take effect this Saturday. Once they become law on Saturday, the new regulations (PDF file) will grant patients more control over their medical records. Any time medical information changes hands, it will require consent from the patient -- something the health care industry claims will be cumbersome and expensive to do. The new administration has repeatedly declared its opposition to new government regulations that make it harder to do business. And from repealing ergonomics legislation to arsenic rules, it's proven itself willing to side with business, even in hot-button political issues. The smart money said the same thing would happen to the medical privacy rules. It was wrong, and now medical privacy pundits are wondering why. "I'm surprised they didn't pull the rules," said Bob Gelman, a consultant who has worked on the medical privacy issue for over 20 years. "Everyone I talked to thought they would. It's a little bizarre." Gelman is not the only one confused. Health care industry organizations like the American Hospital Association (AHA) pushed hard to loosen the new rule, claiming it would be too difficult and expensive to implement. When Secretary of Health Tommy Thompson reopened the new rules to public comment last February, it appeared the AHA's message was getting through, and the administration would make good on its reputation as a friend of business and foe of government regulation. Melinda Hatton, an AHA lawyer, struggled to explain what had happened. "I don't know," she said. "I wish I knew. It was a profound disappointment to us. We wanted them to extend the effective date and fix the rule." Joy Pitts, who is senior counsel for Georgetown University's Health Privacy Project and a supporter of the new regulations, didn't expect the victory. "It is a surprise," she said. "Especially considering the intense pressure from the industry. They really put out an all-out attack." Despite the rule taking effect, the battle isn't over. Critics of the rule, like the AHA's Hatton, plan to hold Bush and Thompson to their puzzling promises to modify the rule after it goes into effect. In the same Thursday statement that announced the rule would become law, Bush acknowledged that some complaints about it were legitimate, and "asked Secretary Thompson to recommend appropriate modifications to the rule to address these concerns." In a separate statement, Thompson promised to publish "guidelines" that "will allow us to clarify some of the confusion regarding the impact this rule might have on health care delivery and access. And we will consider any necessary modifications that will ensure the quality of care does not suffer inadvertently from this rule." Why would the administration implement a new rule and then promise to change it all in one breath? Larry Gostin, a professor of Law and Public Health at Georgetown, thinks the administration may have had no choice but to let the rule stand. "The legal wiggle room was minuscule," Gostin said. According to the Taipei Times, Taiwanese Vice Adm. Hung Cheng-lo, deputy chief of the general staff for defense planning, said Taiwan has the shipbuilding experience but lacks only the software technology to build ships equivalent in performance capability to U.S. warships. USS John A Moore, a Perry-class frigate decommissioned in September 1998. Taiwan has built its own warships based on this class. "Our state-run China Shipbuilding Corporation [CSC] has experience and competence in building warships," he told the paper. "It built the Chengkung-class frigates" for Taiwan's navy. The ships, which are based on U.S. Perry-class frigates, are still under construction under a program to build eight of them. The program, which began in 1989, is slated to end soon, with the construction and delivery of the eighth warship. The last ship should be delivered to Taiwan's navy in 2004; each vessel costs around $212 million. "The previous shipbuilding experience of the CSC shows that we Taiwanese are not inferior to the people of any other country," Hung said in speech to lawmakers earlier this week. In addition to the seven Chengkung-class frigates, six Lafayette-class frigates have been purchased from France and six Knot-class frigates have been leased from the United States to form the backbone of Taiwan's fleet. Other naval officials told the newspaper that while Taiwan was eager to get advanced U.S.-built warships like Aegis-equipped destroyers, officials were less interested in buying them without technology transfers than they are about building them in Taiwan with U.S. technology. One of the reasons why, officials say, is the lengthy amount of time it would take to acquire the U.S.-built ships. Even if the Bush administration agrees to sell Taiwan Aegis air-defense and battle-management warships at a meeting between both countries later this month in Washington, D.C., it would still take eight to ten years to build, test and transfer the warships. Taiwanese officials have said they were interested in buying four of the U.S.-built ships, but the Bush administration has not publicly committed to the sale. "If the U.S. agrees to sell us the Aegis-equipped ships this year, the ships will not be delivered to us for another eight to ten years," one unnamed Taiwanese naval official told the paper. "What the navy wants most is to buy technology from the U.S. and build the Aegis-equipped ships in Taiwan." One CSC official quoted by the paper said the company "absolutely has the ability to build Aegis-equipped ships." What we need is technical support from the U.S." Perry-class frigates are primarily warfare ships intended to provide open-ocean escort of amphibious ships and convoys in low- to moderate-threat environments in a global war with the Soviet Union. They could also provide limited defense against anti-ship missiles existent in the '70s and '80s, according to the Federation of American Scientists. The ships are equipped to escort and protect carrier battle groups, amphibious landing groups, underway replenishment groups and convoys. They can also conduct independent operations to perform such tasks as maritime interception operations and exercises with other nations. The class, however, is viewed as vulnerable to multiple anti-ship missile threats and functions now primarily in an anti-submarine and patrol role. They are robust, however, as demonstrated by past incidents. The USS Stark was hit by two Iraqi-fired Exocet anti-ship missiles in 1987. And the USS Samuel B. Roberts struck a mine. But both ships survived, were repaired and returned to the fleet, FAS said. The U.S. Navy has 36 Perry-class frigates in active service. "It is common knowledge that China and Cuba have very good bilateral relations," stated China's ambassador to Cuba, Wang Chengjia. "Cuba and China are both socialist countries; we share the same ideals and objectives," Wang declared. The statements were carried by Radio Habana Cuba, the official broadcasting service of the Cuban government. Jiang's Cuban tour, which began Thursday, is part of an extended trip throughout much of Latin America, including Argentina, Brazil, Uruguay, Venezuela and Chile, as well as a number of Central American states. This is Jiang's first official visit to the region since 1993 and occurred in the midst of the Chinese-U.S. crisis over 24 U.S. service personnel held for 11 days in China. Jiang is visiting Cuba, according to Radio Habana, in response to an invitation from Cuban President Fidel Castro. Trade and other forms of mutual cooperation are expected to increase even further after Jiang's visit to the island, especially in the areas of electronics and telecommunications. China-Cuban trade already stands at some $500 million annually. Just prior to Jiang's arrival on the island, Havana and Beijing signed an accord in the "electronics, infomatics and telecommunications sector," according to Cuban sources. China and Cuba are planning joint production of "TVs, VCRs, air conditioners, mobile telephones, and short-wave radios" for both Cuban consumption and foreign export, Havana stated. Although no mention was made of any military use of China's high-tech aid to Cuba, some observers are uneasy about Beijing's increasingly sophisticated technological assistance to Havana. Beijing is in possession of advanced technology from U.S., western European and Russian sources -- and some sources claim that China is already operating a spy base in Cuba similar to the Russian surveillance facility at Lourdes. U.S.-Cuban relations remain very cool, even hostile at times. China regards Taiwan as a rebel province and has vowed to retake the island -- by force if necessary. Bush addressed the national NAACP convention in Baltimore and denounced such "new forms of racism" as racial profiling and redlining. But even as he spoke, a very old, traditional form of racism was being implemented in Florida: the disfranchisement of eligible voters, especially blacks, which helped Bush win that state and the election. Despite one well-reported incident involving a police checkpoint near a polling place, disfranchisement 2000-style did not depend on intimidation. Cattle prods and attack dogs, the legacy of former Birmingham Commissioner of Public Safety Bull Connor, were nowhere in evidence. Instead, Florida state elections officials and hired data crunchers used computers to target thousands of voters, many of whom were then purged from the voter rolls without reason. And many thousands more saw their votes thrown out as a result of error-prone voting machines and poorly designed ballots, the results of an underfunded and chaotic electoral system. In all, some 200,000 Floridians were either not permitted to vote in the November 7 election on questionable or possibly illegal grounds, or saw their ballots discarded and not counted. A large and disproportionate number were black. Florida's black leaders, already engaged in an emotional, bitter confrontation with Governor Jeb Bush, George W. Bush's brother, had mounted an unprecedented voter registration effort to defeat candidates they saw as political enemies. According to exit polls, 65 percent more black voters went to the polls in Florida in 2000 than in the 1996 election, and of the votes that were counted, blacks went at least 9 to 1 for Democrat Al Gore. But the votes that were tallied were not enough. After the US Supreme Court cut off ballot recounts, Bush had a margin of 537 votes out of more than 5.8 million cast. The closeness of the final count made all votes not cast and not counted that much more crucial. (As one example, the Palm Beach Post recently reported that Gore lost 6,600 votes in Palm Beach County alone because of the infamous butterfly ballot, more than ten times Bush's margin of victory.) State officials deny racist intent in their actions, but the US Commission on Civil Rights conducted two hearings in Florida in January and February to determine why so many Floridians were denied the right to vote. In a preliminary assessment, the commission noted that the Voting Rights Act of 1965 "was aimed at subtle, as well as obvious, state regulation and practices" that could deny citizens the right to vote because of their race. The commission said it found evidence of "prohibited discrimination" in Florida's polling process. A final report is due this summer. The NAACP and others filed suit on January 10 against Secretary of State Katherine Harris, who was a co-chair of the campaign and is responsible for the conduct of fair elections in Florida, and other Florida officials, charging them with violating the Fourteenth Amendment and the 1965 Voting Rights Act. The suit demands many reforms of the Florida electoral system. But no future remedy can undo what happened in 2000, only a portion of which has been revealed through the hearing, the suit and media reports. "They done got us," said civil rights veteran Elmore Bryant of Marianna, Florida, referring to the GOP-mandated purge of voter rolls. "They had themselves a game and we had no game. The old leaders in the '60s wouldn't have let this happen. We woulda had us a game too, but we didn't. They done got us good." The stage for the November 7 election and the effort by black leaders to defeat George W. Bush was set during Jeb Bush's initial and unsuccessful run for governor in 1994. During a debate in Tampa on July 27 of that year, Bush was asked by a journalist what he would do for Florida's black community if he was elected. His answer was both concise and prophetic. "Probably nothing," he said, explaining that he favored what he called "equality of opportunity" for all Floridians. Four years later, when he ran again, he avoided such candor. But although he won, he was backed by only 10 percent of the state's blacks, according to exit polls. In his first year in office, Bush then eliminated most affirmative action programs benefiting minorities and women, substituting a plan he called the One Florida Initiative. That program ended guaranteed minority and female set-asides in state hiring, in the awarding of state contracts (only 1 percent of state spending for merchandise and services went to minority-owned firms as it was, according to the Miami Herald) and in university admissions. Polls had shown that such a move would be popular with the white majority in the state. Black and feminist leaders called it a betrayal. After the

President Bush is being widely praised for his deft handling of the hostage crisis. In China today, the government-run media are celebrating a great "victory" over the American superpower. Chinese leaders are being praised for extracting an apology from the United States for its aggressive invasion of Chinese territory. Who is right to celebrate? Comforting as it would be to believe otherwise, the Chinese see more clearly than we do that -- so far -- they have won and we have lost. First, make no mistake: The United States has apologized. And the fact of our apology is all the more humiliating because the United States was in no way to blame for the incident. An American surveillance plane flying in international airspace was bumped by a Chinese fighter and forced to make an emergency landing in Chinese territory. The Chinese pilot, some say, was "reckless." Maybe so. But the pilot was only carrying out his government's specific orders to recklessly harass American aircraft flying over the South China Sea, which Beijing wants to claim as Chinese territory and from which the Chinese military wants the United States excluded. For months the Chinese have been directing their pilots to fly closer to American surveillance planes. And for months they have ignored repeated U.S. warnings about the dangers of this new, aggressive policy. And so the collision was not, as American officials insist, a "tragic" accident for which no one was to blame. It was the direct consequence of a deliberate Chinese policy to increase the risks to American pilots and crew -- and to their own -- in order to achieve a military objective. Confronted by this direct and deliberate challenge, the United States has apologized. We have not only expressed regret and sorrow for the loss of the Chinese pilot and plane. We have publicly declared that we are "very sorry" for violating Chinese airspace by landing our crippled plane in Chinese territory. And let us not forgot why we apologized. The letter that our ambassador delivered to the Chinese government this week was not the product of high diplomacy. It was not the product of Sino-American "cooperation" -- a welcome harbinger of future "crisis management" between the two powers. It was the product of Chinese extortion. They held our troops hostage until we said, "Uncle." When we finally said something that in Chinese sounds a lot like "uncle," they let them go. We can kid ourselves all we want, but we have suffered a blow to our prestige and reputation, a loss that will reverberate throughout the world if we do not begin immediately to repair the damage. The problem is not merely that we have lost face -- though the Chinese are right to believe that great powers should place a high value on their reputation. The bigger problem is that our reliability as defender of the peace and protector of friends and allies, especially in East Asia, has been thrown into doubt. If we do not have the will to stand up to the Chinese when they hold 24 Americans for 10 days, who can believe we will stand up to China when it threatens Taiwan and dares us to risk thousands more troops to defend that democratic ally? Nor should anyone doubt that Saddam Hussein has studied this whole affair intently to see how the United States responds when faced with this kind of bullying. So far the lesson is all too clear: When you bully the United States, the United States searches for a way to apologize. Fortunately, the hostage crisis just ended was only Act One in the Sino-American confrontation. Act Two begins now. As Richard Perle, Charles Krauthammer and others have said, China must now pay a price for its appalling and bellicose behavior. The point is not to exact vengeance. The point is not to seek confrontation for its own sake. The point is to make clear to the Chinese government that this kind of muscle-flexing and flagrant violation of international norms cannot be tolerated, and will not be rewarded or excused. Right now the United States can take steps to ensure that China understands how counterproductive its actions have been. First, we can resume our surveillance flights in the South China Sea immediately, without any deviation from the routes and methods used before the crisis. Then, in two weeks, the Bush administration should agree to the sale of a robust package of weapons to Taiwan, including a commitment to sell Taiwan the Aegis system. We should do this not only to send a message to China. We have an obligation to give the Taiwanese democracy what it needs to defend itself against an increasingly threatening Chinese military posture. But the Chinese also need to know that their efforts to drive us away from Taiwan are

Once the worm has infected wsock32.dll, it has the abilty to monitor the Internet connection as well as incoming and outgoing email traffic. The worm then scans for email addresses. When an email address is detected whether on an Internet site or in email being sent or received, the worm waits for a period of time and then sends an infected message to the detected address. The worm attempts to connect to the alt.comp.virus newsgroup. If it connects successfully, then the worm uploads its own plug-ins to this newsgroup in an encrypted form. It goes thru the subject header of the messages, and tries to match a specific format. The subject header will also specify the version number of the attached plug-in if the plug-ins are present. If newer versions of the plug-ins are found, the worm downloads them and updates its behavior. One of the plug-ins for W95.Hybris.gen generates a spiral image. Upon execution, the plug-in initially loads OpenGL libraries which are used to draw a large black and white spiral image. It also registers itself as a service; this prevents it from being displayed in the Close Programs dialog box. For additional information on this, see the document W95.Hybris.Plugin. This worm also has a plug-in that infects executable programs. The DOS EXE infection is fairly simple dropping technique. The virus code is appended to the end of the file with a small 16-bit dropper routine. This routine creates a temporary file with an .exe extension in the TEMP folder and executes it. It then deletes the temporary executable. In this way, Wsock32.dll is infected with the actual worm body. The PE executables have a much more complicated file infection process. PE files become infected only if they have a long enough code section. The virus infection plug-in packs the original code area and overwrites it if it will fit in the same place. This complicated antiheuristic infection technique is difficult but possible to repair. If Wsock32.dll is being used by the system, the worm cannot modify it. In this situation, the worm will add a registry entry to one of the following subkeys: HKEY_LOCAL_MACHINE\Software\Microsoft\Windows\CurrentVersion\RunOnce HKEY_CURRENT_USER\Software\Microsoft\Windows\CurrentVersion\RunOnce It always alternates between these two keys as the worm spreads from one computer to another. The worm hooks onto the following exports of Wsock32.dll: send() recv() connect() Whenever you send email, the worm sends a second message to the same person, attaching a copy of itself using a randomly generated file name. Removal instructions: To remove the W95.Hybris.gen worm, follow these steps: 1. Run LiveUpdate to ensure that you have the most recent virus definitions. When an infected file is detected, do the following: When Wsock32.dll is detected as infected, choose Repair. In most cases, NAV can repair this file. If NAV cannot repair the file, then you will need to replace it from the Windows installation CD. If you need to replace this file, see the instructions in the next section. NOTE: If NAV cannot repair Wsock32.dll when Windows is in normal mode, then try to repair it in Safe Mode. A pro-gun activist launched a campaign against the group this year when he discovered what he said were unapproved taxpayer subsidies -- meaning free rent -- going toward the ailing gun-control organization. The foundation, which gained notoriety for its march on Washington last year, has had financial trouble lately, said Mary Leigh Blek, president of the foundation. Thirty of 35 staff were let go last month out of the national office in the hospital. Executive director James McGuire resigned as director and as a board member last month. The questions about the propriety of the group's office space was another headache for the organization. The hospital property belongs to the city, and the Board of Supervisors has to approve such arrangements. That has not happened in the case of the Million Mom March, an education and advocacy group that supports stricter gun laws. McGuire said the group is an offshoot of the Trauma Foundation, a nonprofit injury prevention group that has rights to the space. That group, which McGuire also founded, was given the space for free in 1981 through an arrangement with Donald Trunkey, then the director of the hospital's burn center. McGuire said all political activities of the Million Mom March are carried out at another office, meaning that taxpayers aren't unwittingly supporting a political organization. Gun activist James March dismissed that explanation, saying McGuire is involved in several gun-control groups, some of which are used as a cover for others. "They can't keep their story straight," March said. "All roads lead back to (McGuire)." On Wednesday, some supervisors said they were concerned the groups may have become too cozy with city property. "Any property that the city and county owns, that we then lease to someone, should not be subleased," said Supervisor Leland Yee, who has questioned the hospital's financial practices in the past. Supervisor Aaron Peskin, a member of the city's finance committee, raised questions about the lack of lease for either group. He noted that the city administrative code requires all leases worth more than $500,000 in a five-year period be revisited. Blek is confident the group will rebound in the coming year. Rallies are planned on Mother's Day in every state the group has chapters. In Sacramento the group will support a bill that requires Californians to pass a written test, a firing-range demonstration and a thumbprint for a state Department of Justice background check. According to an Associated Press story, CDC analysts credited "stricter sentencing in some areas, new laws that make it more difficult for criminals to get guns, the waning crack trade and low unemployment because of the booming economy." CDC, which has been attempting to convince the nation that violent crime is a disease, is right about stricter sentencing of gun-wielding criminals, but dead wrong about criminals having any difficulty obtaining guns. Despite decades-old bans on guns in high-crime cities like New York, Washington, D.C., and Chicago, criminals have all the guns they want. The AP report doesn't mention that the National Center for Health Statistics report for 1998 (latest available) shows that of the 30,708 total firearms- related deaths, only 11,798 - slightly more than a third - were homicides (some of which are justifiable). Suicides account for well over half of the gun deaths - 17,424, or 57%. An incredibly low 866 were accidents, and 620 were listed as "undetermined" or "other" -- which probably includes a lot more self-defense shootings. The NRA supposedly told the AP reporter that the lower death rates "are evidence that gun-safety programs are reaching Americans and that gun laws are working." NRA spokeswoman Patricia Gregory is directly quoted as saying: "There are tens of thousands of firearms laws on the books. Strict enforcement of existing law could reduce these numbers even further." NRA-ILA Director Jim Baker, after talking with Ms. Gregory, told me the reporter distilled the quote from a 15 minute interview. The reporter did not understand she was talking about enforcement of laws against criminal misuse. Earlier this year, Clinton announced plans to open an office in Harlem after a furor erupted over his proposal to lease space in Midtown's Carnegie Hall Tower for $811,000 per year at taxpayer expense. He reportedly is close to signing the lease for the Harlem space, which will cost more than $350,000 per year. News that he would take space there met with widespread approval by Harlem residents and businesses, who said the former president's presence would bring some cachet and positive publicity to a resurgent neighborhood that long labored under a negative image. In fact, despite having announced their rally a week ago and trying to drum up attendance, the Panthers apparently drew no one other than their own members to the demonstration, except for curious passersby. The party, whose controversial leader Khalid Muhammad died two months ago, conducted several "Million Youth" marches in Harlem and espouses a black nationalist philosophy. "I don't care what them Panthers think," said Dawn McKnight, who was working at the Slice of Harlem Pizzeria around the corner. "Lots of people like" Clinton, she said. "I think it's really a disgrace," said Deborah Munger of Queens, about the rally, which she passed while shopping. "People are people. It doesn't matter whether he's white, yellow or green. The bill, S.799, was enacted because of the threat of foot-and-mouth disease and any other contagious animal disease. According to the bill, the state veterinarian must consult with the North Carolina Commissioner of Agriculture and get the permission of the governor before taking any action under the new law. However, the law also states that the state veterinarian does not even need to have a reasonable suspicion that the person or vehicle is carrying a diseased animal. He can stop persons or vehicles to determine whether they are carrying a diseased animal. State Senator Charles Albertson (D-5th), who sponsored the bill, when asked if he had a problem with the constitutionality of the law, told the Asheville Tribune "No, I don't. In this case I think it's warranted and justified." "If you think there are animals that's moving through the country side, or any means of conveyance this virus could travel on, you can't wait to go get a court order before you need to take action," Albertson stated. This is a serious threat to animal agriculture, to the economy of this state, and you have to take, I think, extra ordinary measures to make sure you do everything to prevent it Asked if he thought that the threat was serious enough to suspend the Fourth Amendment of the U.S. Constitution, Albertson said, "Yes, I do. There is a great public concern here." Asked if it was more important for the people to be secure than for them to have rights, Albertson said, "I think, in this case, it may be justified." The bill stops short of allowing the state veterinarian, or his representatives, to enter private property other than a private road. The bill states, "If the person refuses to consent to the entry and examination after the State Veterinarian or an authorized representative has notified, in writing, the owner or person in whose custody the animal is found, of the intention to enter the property and conduct the examination, the State Veterinarian or an authorized representative may petition the district court in the county where the animal is found for an emergency order authorizing the entry and examination." Senator Charles Carter (D-28th) said that he was not concerned that there were any constitutional problems with the bill, but does think if there were "the judicial system would throw it out." According to Albertson, the vote in the Senate was unanimous, with only two descenting votes in the house. Albertson says the response from the state's animal industry has been positive. The Committee on Government Reform has urged the US Justice Department and the Florida government to undertake a "serious independent investigation" into the case of Mr Joseph Gersten, now a Sydney lawyer. Mr Gersten claims his political rival, Ms Janet Reno, the then Florida attorney who became the attorney-general in the Clinton administration, was part of a conspiracy to destroy his political and personal life. Since arriving in Australia, Mr Gersten has repeatedly sought political refugee status and is involved in court action to retain his right to practise law. A spokesman for the Immigration Minister, Mr Ruddock, said if Mr Gersten believed the committee's report constituted "information that was new and relevant" he should direct it to the appropriate authorities. The NSW Law Society, which is fighting Mr Gersten in the Supreme Court seeking to stop him practising as a solicitor, has relied on the information condemned by the committee's report. It had no comment on the matter. Mr Gersten said the committee's report was the first time his claims had been taken seriously, but his quest for justice had a long way to run. "Imagine your government creating fiction to destroy you," he said yesterday. "Not just destroying you in America, but swimming across the ocean, and across the world to continue their pursuit." The committee, headed by Republican congressman Mr Dan Burton, backs Mr Gersten's allegations that "the vast power of the state was used to destroy him", but it does not name Ms Reno as being personally involved. The report says the US reports that Australian authorities relied on to oppose Mr Gersten's application for residency "appear to be erroneous". On April 29, 1992, Mr Gersten, then an "irascible" Miami Dade County Commissioner with mayoral ambitions, reported his Mercedes-Benz stolen from his home's driveway. The car turned up the next day, but the people apprehended - all with previous criminal convictions - claimed the car was taken while Mr Gersten was smoking crack cocaine with a prostitute at a drug house. Mr Gersten refused to co-operate with the car theft investigation, and spent nearly three weeks in prison for contempt of court. He fled to Australia in 1993, and an outstanding charge of filing a false police report was only recently dropped. The committee report found numerous examples where FBI investigators and government officials ignored evidence that threw into doubt the claims against Mr Gersten. They include: That a drug test showed that he had not used cocaine; That a prostitute offered money to an alleged witness, Mr Wayne Pierce, to tell police that Mr Gersten had murdered a transvestite the same night. Mr Pierce later told police the information was false, but police never told Mr Gersten of the allegation. That there were "fatal inconsistencies" in the witnesses' testimony that police did not try to reconcile, suggesting that some one was out to frame Mr Gersten; That one of the accusers made an offer to Mr Gersten's lawyers to change his testimony if they paid him $US10,000. "State and Federal government officials have continued to rely on, and perpetuate, obviously suspect allegations against Gersten to his detriment," the report said. Ashcroft said the media would not be permitted to conduct on-site interviews with McVeigh and that video and voice-recorded interviews would be barred. He said media outlets could request telephone interviews but that any contact with McVeigh would be limited to the 15 minutes of personal calls he is permitted each day. The new limits will apply not just to McVeigh, he said, but to coverage of all federal executions. If McVeigh's execution goes through as scheduled, it will be the first application of the death penalty at the federal level since 1963. Representatives of journalist organizations and attorneys active in capital punishment cases lashed out at Ashcroft's remarks, calling them inappropriate for the nation's top law enforcement official and insensitive to the fact that important information sometimes surfaces in death row cases only as a result of media contacts. "It's just not an appropriate decision for Ashcroft to make," said Lucy Dalglish, executive director of the Reporters Committee for Freedom of the Press. "He's the guy in charge of flipping the switch. I don't think he's the last word on whether it's appropriate for the public to know what's going on inside prison walls." Ashcroft described the new restrictions at a news conference called to announce his decision to permit families of the 168 bombing victims to watch McVeigh's execution on closed-circuit television. "I would ask that the news media not become Timothy McVeigh's co-conspirator in his assault on America's public safety and upon America itself," Ashcroft said. "Please do not help him inject more poison into our culture. He's caused enough senseless damage already." Alex Jones, director of the Joan Shorenstein Center on the Press, Politics and Public Policy at Harvard University, said the restrictions Ashcroft has imposed "bespeak a real misunderstanding of the role of the media in a free society." "I share Ashcroft's perception of Timothy McVeigh as a wanton killer," Jones said. "But I think that to suggest that seeking to cover this very newsworthy event with thoroughness is to somehow become a partner to Tim McVeigh is a despicable thing for the attorney general to suggest." Jones called the restrictions on interviews Draconian. Ashcroft, he said, "is seeking blatantly to muzzle legitimate serious coverage of one of the most emotionally wrenching moments in recent memory." The Ashcroft rules are "deeply troubling," said David Protess, a professor at Northwestern University's Medill School of Journalism. Protess' students have uncovered evidence that has led to the release of three prisoners from death row in Illinois. The restrictions Ashcroft has imposed are consistent with U.S. Supreme Court decisions upholding the right of prison authorities to set limits on media access and with the recent trend to curtail such contact in many states. Protess said the trend had "disturbing" implications, even in cases like that of McVeigh, who has acknowledged his guilt. "Covering people on death row and what they have to say puts a human face on executions," he said. "If we're going to fully tell the story of a horrible crime we need to hear from the victim, the police, witnesses - and from the condemned person himself. Otherwise our stories are incomplete. How can our stories be complete if we don't hear from the person who's about to die?" Ashcroft stressed at Thursday's news conference that the limits on media access and other restrictions would be followed in other cases as well. But at the same time he acknowledged that he had been moved by the grisly nature of McVeigh's crime. "As an American who cares about our culture, I want to restrict a mass murderer's access to the public podium ..." Ashcroft said. "I do not want anyone to be able to purchase access to the podium of America with the blood of 168 innocent victims." Locke Bowman, a death penalty specialist at the University of Chicago Law School's MacArthur Justice Center, said it was the death sentence itself that had guaranteed the notoriety now swirling about McVeigh. "The whole situation is bizarre," Bowman said. "By setting out to execute this guy, by fulfilling his delusions of martyrdom, the U.S. government has made this a news story ... "Then faced with the inevitable consequence of that decision - that he becomes a news story - it seems to me doubly wrong to suggest that the opportunity to cover the story which the government created should be limited or cut off." -Caveat Lector- Auditors: Clinton Administration Officials Bowed to Political Pressure Friday, April 13, 2001WASHINGTON Federal auditors contend that Clinton administration housing officials bowed to political pressure and approved a $9.5 million college dormitory for Alaska Natives that wasn't necessary. Department of Housing and Urban Development officials tried to block release of the report from the HUD inspector general last winter, but it was resubmitted to the Bush administration and made public March 30. "It's the first time I've ever run across where they've requested us not to release a report," Frank Baca, head of the Seattle audit office that investigated the case, said Wednesday. The audit said HUD officials approved the dorm at Alaska Pacific University "without any evidence that there was a need for the project." Local HUD officials calculated that the 40-student dorm should cost no more than $2.3 million -- less than a quarter of the amount approved. Construction on the dorm has not started, and Baca said the project is on hold. Investigators said political pressure, not evidence of need, helped the project win approval. Those who weighed in to support the dormitory included Sen. Ted Stevens, R-Alaska, chairman of the Senate Appropriations Committee. Neither Stevens nor former Housing Secretary Andrew Cuomo responded to repeated requests for comment. Last December, Deputy Housing Secretary Saul Ramirez wrote auditors asking that the report not be issued. "We conclude that all findings are wrong," Ramirez wrote. He said auditors misinterpreted federal regulations. His letter did not mention political pressure. The dormitory is the latest in a series of problems that HUD's inspector general has found in the agency's housing programs for American Indians. Auditors have criticized HUD for building luxury homes for well-connected tribal members while thousands of other Indians live crammed into reservation shacks. Last fall, auditors found that Washington state's Lummi tribe had misspent up to $1.3 million of $12.4 million in HUD money it got from 1993 to 1999. A 1998 audit of Indian housing programs found that $14 million had been wasted or misspent. In the March 30 audit criticizing the dormitory, auditors said HUD officials gave no reason for approving the $9.5 million project, even though agency memos "appear to argue against" it. "We believe these improper actions occurred because HUD officials made decisions based primarily on political considerations," auditors wrote. In addition to Stevens, auditors said Carl Marrs, head of Cook Inlet Regional Inc., the Alaska Native corporation backing the dormitory, also met with Cuomo to lobby for the project, seeking it under programs for housing low income Indians. Cook Inlet is one of 13 regional corporations created to manage Alaska Natives' land and resources under a 1971 law Stevens wrote. The government money for the project is funneled through a nonprofit subsidiary, the Cook Inlet Housing Authority. A CIRI official defended the project. "The way to reduce the need for low-income housing is to educate Alaska Natives effectively so they don't need it," said Keith Sanders, CIRI's general counsel. Two weeks ago when Insight was reporting potential conflicts of interest involving IRS Commissioner Charles O. Rossotti's large holdings in a company that does millions of dollars' worth of business with his own agency (see "A Taxing Dilemma," April 23), the IRS said not to worry. Rossotti is recused from dealing with the huge government contracts of American Management Systems (AMS), the company that he cofounded and of which he remains the major shareholder, said Frank Keith, the IRS' national director of communications. "The commissioner has executed a viable and rigorous recusal pro-cess to separate himself from any dealings with AMS," Keith insisted. Now Insight has learned that in December 2000 the Clinton administration blew a very large hole in the wall that is supposed to separate Rossotti, whom Clinton appointed as commissioner in 1997, from dealing with his old company. Along with the last-minute pardons and "midnight regulations" that the administration rushed through in its last two months, it also issued a waiver of conflict-of-interest rules that allows Rossotti to participate in decisions that directly could affect the AMS bottom line. Insight has obtained a copy of that waiver. Signed on Dec. 11, 2000, by Clinton's deputy Treasury secretary, Stuart Eizenstat, the waiver allows Rossotti to join in discussions and decisions about the IRS' Custodial Accounting Project, which uses an automated financial-management system and software provided by AMS. "I have determined that your disqualifying financial interest in the Custodial Accounting Project [CAP], which arises from your ownership interest in American Management Systems Inc. [AMS], is not so substantial as to be deemed likely to affect the integrity of the services that the government may expect to receive from you with respect to the CAP," Eizenstat wrote. Clinton's man noted that, without this waiver, federal law "would preclude [Rossotti] from participating in the CAP because certain decisions would have a direct and predictable effect on your financial interest in AMS." Eizenstat, now a partner at the hugely powerful Washington law firm of Covington Burling, did not return Insight's telephone calls asking why the waiver was necessary. The conflict-of-interest waiver allows Rossotti to participate in "budget and resource-allocation issues, the prioritization of the CAP and high-level design and architecture issues." It gives him the power to decide how much money will go to the project and, indirectly, to AMS, say experts. At press time, the IRS had not returned Insight's telephone calls for comment about the newly revealed waiver and other issues that have surfaced. And this is no minor matter, say ethics specialists. Rossotti called the Custodial Accounting Project "critical" to IRS' ongoing computer-system modernization in testimony to a House subcommittee on April 4. The IRS has asked Congress for $50 million for the project in fiscal 2002 alone. Overall, the Bush administration's budget gives the IRS an 8 percent funding increase in 2002, double the 4 percent average re-quested for all agencies. The additional funds reflect the computer modernization. Because so much of this money could flow to AMS scheduled to be paid more than $17 million this year by the IRS, according to IRS spokesman Keith some have expressed concern. "I always want to be certain that government officials are avoiding conflicts of interests, but I won't jump to any conclusions," Rep. Ernest Istook Jr., R-Okla., chairman of the House Appropriations subcommittee that oversees IRS funding, tells Insight through a spokeswoman. Officials of some of the watchdog groups that insisted Treasury Secretary Paul O'Neill divest his $100 million worth of Alcoa stock (see "The $100 Million Misunderstanding," April 2-9) now say that Rossotti's situation is more serious than O'Neill's would have been had he not agreed to sell the stock. "The point there [with Alcoa] was that there was very little the Treasury Department could do that would not impact Alcoa, and I think eventually Secretary O'Neill came around to that conclusion," says Larry Noble, executive director of the Washington-based Center for Responsive Politics. "I think the same principles apply [to Rossotti], a little bit more directly here in the sense that the IRS is doing business with AMS." Charles Lewis, the executive director and founder of the Center for Public Integrity who called strongly for O'Neill to divest, says Rossotti should follow O'Neill's lead. Hillary Rodham Clinton voted for the McCain-Feingold campaign-finance "reform" bill - ostensibly believing, like her colleagues, that banning "soft money" contributions will eliminate the most corrupting influence from the political process. So guess who's now working like a bat out of hell raising millions in soft money for herself and her party? Ms. Clinton, that's who. Is anyone really surprised? Certainly, New York's junior senator knows a thing or two about soft money. Last year, she raised more of it than any other Senate candidate in the nation - $9.6 million, through so-called joint fund-raising, which allows candidates to simultaneously raise money for their party and their own campaign. Oh, but this is only about fairness, says Sen. Clinton. She'll be happy to abide by McCain-Feingold - once it actually takes effect, that is. Until then, she proclaims, "we have to play hard on the field where we currently are, especially when we have an opponent who is still out there running up and down the field as fast as they can." Which is why she's about to open her new multimillion-dollar mansion to her party's cause, raking in the bucks as quickly as possible. That might sound plausible - until you consider that last year, according to Common Cause, Senate Democrats nationally raised $15 million in joint fund-raising, while the Republicans netted just $2.6 million in that soft-money technique. So who's chasing whom? Besides, the notion that anything goes until McCain-Feingold becomes law is downright ludicrous, especially given the arguments that its supporters - including Hillary Clinton - used about the moral imperative of passing the bill and the evils of soft money. In fact, it sounds very much like Hillary had to be dragged kicking and screaming to support this bill. Nothing she's ever done, before or since, suggests that she really believes in the campaign-finance reform cause she so strongly espoused. Mrs. Clinton should take a cue on this one from her senior colleague, Chuck Schumer. He's refused to raise any soft money this year, saying through a spokesman that he intends to "honor the spirit of McCain-Feingold." Last winter, the U.S. was cold. Growing seasons are moving south. Orange groves in central Florida that used to be productive several decades ago, can no longer grow oranges because it's gotten too cold. Floridians complained that they couldn't remember a winter as cold as that just ending. Yet while they sat around their homes in sweaters, they earnestly discussed imminent world disaster from global warming. Fifteen hundred scientists, solely on the basis of computer models, predict doom from human caused global warming; and the United Nations Intergovernmental Panel on Climate Change (IPCC) issues increasingly apocalyptic warnings about impending disaster. Yet over nineteen thousand scientists see no such danger from human caused global warming (a silent majority ignored by the media, because stories about disaster sell newspapers and boost viewers, but stories concluding "no problem" do not). NASA has had satellites in space for over 20 years with the mission of measuring the earth's temperature, and has found that there has been a slight cooling over the past 20 years. NOAA issued a report that last November and December were the coldest such periods on record. Scientists measure ocean floor sediments and ice cores and find that the planet routinely undergoes significant fluctuations in climate, and that it has been doing so for thousands of years without any help from man. Twelve thousand years ago the planet emerged from the last great ice age. A century and a half ago the earth emerged from a mini ice age. When the planet emerges from an ice age, it gets warmer, without any help from man. But cynics in politics and global government types at the United Nations continue to demand we "do something" about global warming, and pandering politicians with a lust for power are only too happy to oblige. Completely forgotten are the dire warnings of a mere thirty years ago that we were all about to die from global cooling, with the same fearmongers warning of a looming, human-induced ice age. Hot, cold, no matter. Ignorant fear is the order of the day. Emulating the rooster that thinks its crowing causes the sun to rise, human ignorance, arrogance, and vanity causes some people to think that they have the power to fundamentally alter the climate of the planet. Environmental extremists would like to see human society driven back to pre-industrial levels, and in California they have been given free reign to implement their vision. Thanks to a regulatory morass that has been instituted to mollify those extremists, and to pander to consumers who really think that they can have something for nothing, California is only beginning to experience the results of a decade of head-in-the-sand politics. It's a failure of the free market, cry the political panderers, government bureaucrats, and environmental socialists who created the mess. California's energy system is about as far from being a deregulated free market as anything can be -- there are price caps on consumer electricity rates, thus there is no incentive for consumers to conserve, and no economic benefit to building new power plants; environmental restrictions make it virtually impossible to build new power plants anyway, and would make any new plant enormously expensive and economically unviable; there are restrictions on how power companies are allowed to buy fuel and electricity; and there was a centralized bureaucracy that controlled it all. Offshore and across the country, existing oil wells are shut down and new wells banned; clean coal deposits were placed off limits in national monuments; hydropower dams are being dismantled to appease the fish lobby; and the nuclear power industry has been driven virtually to the edge of extinction by hysterical propaganda from "no-nuke" radicals, who have created in the public an irrational fear of nuclear power. Blaming deregulation, free markets, and greedy utility companies, ignorant populations (when was the last time you heard of a comprehensive course in fundamental free market economics taught in public schools?) warn politicians in other states considering deregulating their own power industries, "You better not!" And politicians bow to the pressure and put their own plans for deregulation on hold; while the same anti-capitalist radicals, politicians, and regulators who caused California's problems in the first place claim that the only solution is still more regulation. Ashcroft said the media would not be permitted to conduct on-site interviews with McVeigh and that video and voice-recorded interviews would be barred. He said media outlets could request telephone interviews but that any contact with McVeigh would be limited to the 15 minutes of personal calls he is permitted each day. The new limits will apply not just to McVeigh, he said, but to coverage of all federal executions. If McVeigh's execution goes through as scheduled, it will be the first application of the death penalty at the federal level since 1963. Representatives of journalist organizations and attorneys active in capital punishment cases lashed out at Ashcroft's remarks, calling them inappropriate for the nation's top law enforcement official and insensitive to the fact that important information sometimes surfaces in death row cases only as a result of media contacts. "It's just not an appropriate decision for Ashcroft to make," said Lucy Dalglish, executive director of the Reporters Committee for Freedom of the Press. "He's the guy in charge of flipping the switch. I don't think he's the last word on whether it's appropriate for the public to know what's going on inside prison walls." Ashcroft described the new restrictions at a news conference called to announce his decision to permit families of the 168 bombing victims to watch McVeigh's execution on closed-circuit television. "I would ask that the news media not become Timothy McVeigh's co-conspirator in his assault on America's public safety and upon America itself," Ashcroft said. "Please do not help him inject more poison into our culture. He's caused enough senseless damage already." Alex Jones, director of the Joan Shorenstein Center on the Press, Politics and Public Policy at Harvard University, said the restrictions Ashcroft has imposed "bespeak a real misunderstanding of the role of the media in a free society." "I share Ashcroft's perception of Timothy McVeigh as a wanton killer," Jones said. "But I think that to suggest that seeking to cover this very newsworthy event with thoroughness is to somehow become a partner to Tim McVeigh is a despicable thing for the attorney general to suggest." Jones called the restrictions on interviews Draconian. Ashcroft, he said, "is seeking blatantly to muzzle legitimate serious coverage of one of the most emotionally wrenching moments in recent memory." The Ashcroft rules are "deeply troubling," said David Protess, a professor at Northwestern University's Medill School of Journalism. Protess' students have uncovered evidence that has led to the release of three prisoners from death row in Illinois. The restrictions Ashcroft has imposed are consistent with U.S. Supreme Court decisions upholding the right of prison authorities to set limits on media access and with the recent trend to curtail such contact in many states. Protess said the trend had "disturbing" implications, even in cases like that of McVeigh, who has acknowledged his guilt. "Covering people on death row and what they have to say puts a human face on executions," he said. "If we're going to fully tell the story of a horrible crime we need to hear from the victim, the police, witnesses - and from the condemned person himself. Otherwise our stories are incomplete. Aum Shinri Kyo membership has grown by about 150, or 10 percent, with at least 1,650 followers by the end of last year, the Justice Ministry said in a report submitted to the Cabinet. About 650 of them are carrying out cult activities at group homes and facilities, it said. The group was responsible for the sarin gas attack on March 20, 1995 that killed 12 people and sickened thousands. The incident has shaken people's sense of security in Japan, which has enjoyed a relatively low crime rate. The report said that on the surface the group has changed its name, acknowledged its responsibility for the subway gassing and apologized. But fundamentally, it remains the same. "The group's dangerous nature has not changed even though no poisonous substances or ingredients have been found at their facilities," the report said. "Its deceptive nature is unchanged." Investigators at the Public Safety Agency have found 29 Aum facilities and 200 apartment houses in 10 onsite inspections. The cult, which now calls itself Aleph, is expanding its computer-related business and raking in profits from its 13 companies. Under influential leader Fumihiro Joyu's "cyber cult" plan, the group continues spreading its "dangerous" teachings on the Net, the report said. Joyu, jailed guru Shoko Asahara's most-trusted aide, was released from prison in December 1999 and is considered the cult's de facto leader. The cult also earns funds by charging expensive fees through the sale of books and compact discs containing Asahara's teachings and seminars. The group is moving to expand overseas as well, said the report, which did not specify where. The cult is by law under Public Safety Agency surveillance. The Justice Ministry is responsible for publishing the cult's activities in an annual report. The latest update is for the period between May 16 and December 31, 2000. Judges have handed down death sentences to several former leaders in the gas attack and other killings. TIME has learned that U.S. Attorney Mary Jo White has dropped a subpoena on Clinton's brother, Roger, for a grand jury appearance this week to discuss his role in an alleged pardon swindle. Insiders say that White has all but finished with most witnesses in the controversial clemency granted to four New York Hasidic Jewish leaders. And, in a possibly major development, one lawyer close to the investigation says that White has struck an immunity deal with Democratic donor Denise Rich, whose international financier ex-husband Marc was pardoned by Clinton despite objections from White House lawyers. A host of witnesses connected to the pardon of Rich, the fugitive financier whose clemency kicked off the furor about how Bill Clinton used his pardon power, have already either been before the grand jury in New York or have been interviewed by White's prosecutors, according to lawyers close to the case. Beth Dozoretz, a friend of Clinton and Denise Rich, testified in grand jury proceedings earlier this month and will be returning for another appearance. Jack Quinn, an attorney for Marc Rich who took the pardon plea to the president, also testified, as did another Rich lawyer, Robert Fink. Beth Nolan, the former White House counsel who opposed the Rich pardon, agreed to talk to White's prosecutors outside of the grand jury. Democratic donor Denise Rich, who was persuaded to go to bat for her former husband in spite of a bitter divorce, had been bargaining with prosecutors for weeks in an attempt to work out an immunity deal. Investigators are looking at whether Clinton pardoned Marc Rich in exchange for large contributions from Denise Rich to Clinton's presidential library, the Democratic Party or other political campaigns, and whether Marc Rich was the actual source of the money. Rich's lawyers declined comment, as did White's office. However, cautioned a lawyer who represents a different witness in the case, "Immunity was inevitable for her, given the theory that they are investigating. While Clinton has said he received no money from a handful of people for whom he requested clemency from his brother (the president denied them all), two Texans claim they were swindled after being solicited to pay more than $200,000 to a group that included Roger Clinton - who was then supposed to secure a pardon for a relative, but did not attempt to do so, they allege. He may find White a tough sell. "They are moving speedily along, and they are not letting people have extensions," said a lawyer who represents someone else in the pardons probe. Most of the possible witnesses connected to the clemency granted to four Hasidic Jews from the New Square, NY community, for instance, have already testified. The four were convicted of stealing more than $30 million in government funds by establishing a fictitious religious school; their sentences were commuted after the Grand Rabbi of their ultra-orthodox community arranged a Dec. 22 meeting at the White House with both Clintons present. New Square had voted almost unanimously for Hillary Clinton in the New York Senate race. But, said a lawyer familiar with the case, even if Hillary had promised to lobby her husband for clemency in exchange for the town's votes (and there appears to be no proof of that), it would be tough to find a crime there. Anyway, aside from the fact that this is Babs, what makes Gephardt-who wants to be either speaker or president-attend a Hollywood gripe session? One answer: money. She's a big Democratic contributor. But, you ask, won't campaign finance reform reduce the influence of big givers like Streisand? No way, says one party fundraiser. "If you pass reform, people like Streisand become huge." Why? Concerts-and the ability to gather huge crowds and collect huge sums in small amounts. "Her name is even more golden." But what about the Streisand critique, such as it is? Are the Democrats dead, as Streisand and some others seem to think? Are they under the spell of the Bushies? Are they timid? "Democrats don't have to be ruthless like the Republicans," Streisand advises. "They just have to be strong. . . . Just being nice doesn't work. Democrats should fight before it's too late! Last time I checked, the Democrats weren't exactly losing much time bashing President Bush or his tax cut or his decision not to lower the amount of arsenic in drinking water. "It is breathtaking how remarkably unwilling they are to sit down and try to find common ground." How nice is that? New evidence casts doubt on global warming -- -- Claims are "based on false data," international team of scientists says -- -- by Robert Matthews -- -- Fresh doubt has been cast on evidence for global warming following the discovery that a key method of measuring temperature change has exaggerated the warming rate by almost 40 percent. Studies of temperature records dating back more than a century have seemed to indicate a rise in global temperature of around 0.5C, with much of it occurring since the late 1970s. This has led many scientists to conclude global warming is under way, with the finger of blame usually pointed at man-made emissions of such greenhouse gases as carbon dioxide. Now an international team of scientists, including researchers from the Met Office in Bracknell, Berkshire, United Kingdom, has found serious discrepancies in the temperature measurements, suggesting that the amount of global warming is much less than previously believed. Measuring water, not air The concern focuses on the temperature of the atmosphere over the oceans, which cover almost three-quarters of the Earth's surface. While scientists use standard weather station instruments to detect warming on land, they have been forced to rely on the crews of ships to make measurements over the vast ocean regions. Crews have taken the temperature by dipping buckets into the sea or using water flowing into the engine intakes. Scientists have assumed there is a simple link between the temperature of seawater and that of the air above it. However, after analyzing years of data from scientific buoys in the Pacific that measure sea and air temperatures simultaneously, the team has found no evidence of a simple link. Instead, the seawater measurements have exaggerated the amount of global warming over the seas, with the real temperature having risen less than half as fast during the 1970s than the standard measurements suggest. Reporting their findings in the influential journal Geophysical Research Letters, the scientists say the exact cause of the discrepancy is not known. One possibility is that the atmosphere responded faster than the sea to cooling events such as volcanic eruptions. A big cut The findings have major implications for the climate change debate because sea temperature measurements are a key part of global warming calculations. According to the team, replacing the standard seawater data with the appropriate air data produces a big cut in the overall global warming rate during the last 20 years, from around 0.18C per decade to 0.13C. This suggests that the widely quoted global warming figure used to persuade governments to take action on greenhouse gas emissions exaggerates the true warming rate by almost 40 percent. The team is now calling for climate experts to switch from seawater data to sea-air temperature measurements. One member of the team, David Parker, of the Hadley Centre for Climate Prediction and Research at the Met Office, said the discovery of the discrepancy "shows we don't understand everything, and that we need better observations--all branches of science are like that." Yet according to Parker, the new results do not undermine the case for global warming: "It is raising questions about the interpretation of the sea-surface data." Even so, the findings will be seized on by skeptics as more evidence that scientists have little idea about the current rate of global warming, let alone its future rate. Climate experts are still trying to explain why satellites measuring the temperature of the Earth have detected little sign of global warming, despite taking measurements during supposedly the warmest period on record. Some researchers suspect the fault may again lie with the ground-based temperature measurements. They say many of the data come from stations surrounded by growing urban sprawl, whose warmth could give a misleading figure. If the Russian figures are accurate, the weapon would represent an advance on most current torpedoes which dive to depths of only about 700 or 800 meters, according to Anthony Watts, editor of Jane's Underwater Warfare Systems. "One thousand meters is certainly an advance on what is quoted in open source literature as normal operating depth ... for most light torpedoes," he said. The system, called RPK-8, can also be used against torpedoes and underwater objects near the surface, Itar-Tass reported, citing the Russian Defense Ministry. And if the media elite take one look -- as they just did -- at the first Bush-Cheney budget and charge them with making drastic cuts in the wonderful Clinton-Gore "non-proliferation" programs -- particularly the Nunn-Lugar-Domenici "loose nuke" programs -- then you know there are Clinton-Gore moles infesting quite a few other agencies. In the first place, the Clinton-Gore "non-proliferation" programs were not wonderful. And, they did not focus on preventing Russian nukes from getting loose, which is what Nunn-Lugar-Domenici mandated that they do. If the Russians had been able to obtain and maintain -- without our assistance -- safe and secure control over a.) every Soviet nuke and b.) all the Soviet weapons-useable fissile materials -- and then safely and securely dispose of any excess -- there would have been no need for the Nunn-Lugar-Domenici Acts in the first place. But the Russians couldnât do all that by themselves, so they came to us and asked for our assistance. And Congress immediately authorized President Bush to give it to them. However, it quickly became apparent to Congress that Clinton-Gore did not have the same understanding of "non-proliferation" as Bush-Quayle did. For Clinton-Gore, "non-proliferation" was synonymous with "disarmament." Clinton-Gore were not so much interested in assisting the Russians to secure their nuke stockpile as they were in getting rid of all of our nukes -- right away -- as an example for the rest of the world to follow. (Nixon had already gotten rid of all our biological weapons, Reagan got rid of our chemical weapons, Bush began getting rid of all the nukes we no longer needed, but candidate George W. Bush correctly promised to keep all the nukes we do need.) Youâve probably heard about the billions of dollars that Congress authorized Clinton -- they never authorized the Gore-Chernomyrdin Commission to do any of the things they did, but they went ahead and did them, anyway -- to give the Russians to prevent nuke proliferation. These are the wonderful programs that the media elite are now accusing Bush-Cheney of cutting, drastically. Well, hardly any of that money was actually given to the Russians. Most of the billions -- initially authorized by the Freedom Support Act of 1992 for the purpose of bringing the emerging states of the former Soviet Union into the Western-style, market-oriented community of nations -- were funneled through federal agencies (State Department, Department of Defense, Agency for International Development -- AID, Ex-Im Bank, Overseas Private Investment Corporation, Department of Commerce, etc.) to U.S. contractors and their partners in the former Soviet Union. Title V of the multi-billion dollar Freedom Support Act is what is usually called the Nunn-Lugar Act, and it authorized the Departments of Defense (DOD) and Energy (DOE) to spend up to $400 million per year to prevent the proliferation of "weapons of mass destruction." However, it is very clear from the legislative history that the Nunn-Lugar Act was almost entirely focused on preventing Russian nukes from getting loose, but very little was actually spent by either DOD or DOE for that purpose. In fact, by 1997, DOD was spending virtually all Title V funds on something called "Defense Conversion." And almost all the rest of the multi-billion dollar Freedom Support Act funds were being spent by AID and other agencies on something called "Partnerships for Freedom." The point-people for these two grand Clinton-Gore Freedom Support Act programs -- to irreversibly disarm Russia under cover of the Gore-Chernomyrdin Commission -- were Secretary of Commerce Ron Brown, Secretary of Defense Perry and Secretary of Energy OâLeary. Once the work was finished, the fuel--so radioactive it couldn't be handled except by remote control--was buried in three underground trenches. And there it remained, largely forgotten. Until last year, when routine surveys found tritium--known to cause birth defects--at concentrations 90 times the federal drinking water standard in a nearby well. By last month, the level of tritium in the ground water had increased fourfold. Deteriorating underground tanks a few miles away hold 54 million gallons of radioactive soup that over the years has made its way into the ground waterexcerpts: How far has it leaked? There is already some tritium in the Columbia River, measurable in Richland's drinking water supply--although at well below federal safety standards. Mulberry bushes measured along the Hanford shore also have shown substantial amounts of strontium-90 and thorium, in addition to other toxic contaminants such as chromium. None of it, federal officials believe, is enough to jeopardize public health. The Columbia's vast flows so far have diluted the contamination to well within federal standards. But imagine what it will be like in 10 or 20 years, say Washington state officials, who are pushing for increased cleanup efforts. -Caveat Lector- Scientists Find Way to Block Effects of Marijuana April 13, 2001 04:13 PM ET By Will Dunham WASHINGTON (Reuters) - Chemically blocking receptors in the brain that respond to a key compound in marijuana squelches the "high" caused by the drug, scientists said on Thursday in a finding that could lead to treatment for marijuana abuse and perhaps even for obesity. Researchers with the U.S. National Institute on Drug Abuse (NIDA) have confirmed for the first time in people that chemically blocking the brain's cannabinoid receptors -- proteins on the surface of brain cells -- cuts the intoxicating effects of smoked marijuana. The study involved 63 adult men with histories of marijuana use. Animal tests have found that the major effects of the active ingredient in marijuana, tetrahydrocannabinol (THC), result from its binding to specific cannabinoid receptors. In the study, the researchers used a compound called SR141716, which was discovered by French drug maker Sanofi-Synthelabo. The compound binds to the cannabinoid receptor and blocks compounds such as THC from activating it. The findings appear in the journal Archives of General Psychiatry. Cannabinoid receptors are most dense in brain regions involved in thinking and memory, attention and control of movement, the researchers said. Their precise function in people is not well understood, although animal studies have shown compounds that activate the receptor sites impair learning and memory and increase appetite and food intake. Lead researcher Dr. Marilyn Huestis of NIDA, part of the National Institutes of Health, said the findings help point the way toward possible treatment for people addicted to marijuana. "It's certainly an issue that is still a little controversial," she said of whether marijuana can cause addiction. "But there's been some beautiful work showing that marijuana is addictive, and that a number of people who utilize the drug on a chronic basis have developed dependence and have a very difficult time stopping taking the drug." OBESITY TREATMENT POSSIBLE Huestis also said the compound, by blocking the brain's cannabinoid receptors, may prove useful in treating obesity and psychotic diseases such as schizophrenia and improving memory. "One of the most promising aspects is the issue of obesity and the fact that marijuana produces hunger," Huestis said in an interview. Sanofi-Synthelabo has completed one set of clinical trials involving treating obesity with SR141716 and is now in talks with the U.S. Food and Drug Administration about a next set of trials, said Dr. Joseph Palumbo, a research official with the firm. "We're still learning about some of the effects that we may have." Subjects in the study were given either SR141716 or a placebo (dummy pill) and two hours later smoked one marijuana cigarette. Those who received the compound showed significantly reduced marijuana effects, while the placebo group showed typical marijuana intoxication, the researchers said. Subjects given the highest dose of SR141716 (90 mg) reported a 43 percent reduction in how "high" they felt compared to the control group, the study found. They also had a 59 percent smaller increase in heart rate, one of the primary physical effects of marijuana.
