Who's ready to pay?

SCO ready to clean out Linux users for $1399 per CPU

---Small slice of the article -

Linux users face a serious question. Is $699 too much to pay for a good
bath?

The $699 scrubbing fee is exactly how much SCO wants for one CPU's worth
of a Linux license, and that's just for the time being. Come October 15,
the single CPU fee jumps to a whopping $1,399.

This is the latest word from SCO handed down by Mr. Clean himself - SCO
CEO Darl McBride, during a Tuesday conference call. SCO had been holding
out on exactly how much it planned to charge Linux users for their use
of what it claims is borrowed Unix code, but now all has been made clear
- crystal clear. .

First question that came to my mind after reading the news was:
"How on earth do they think they could ever make someone actually pay?"

See, they can ask whatever they want. Important is how they could put
enough weight on their demand.

I have been asking my boss for years about a raise in pay. He agreed
whenever *he* was ready.

Hmmm. Well, technically since I have a server and two workstations
running here now, that brings me up to $2797.00. For my own part I'm
saving Lanman's sample response email from the newbie list in case they
try to extort any money from me.

As Dr Jung said, they can pry it from my cold dead fingers. Other than
that and until then they can kiss my ass.

They will get money out of this. There are people out there who become
frightened, pay when the threatening letter arrives with the appropriate
letterhead, or the name of an organisation that is large enough to seem
invincible. I hope I am wrong, but people are already starting to send money,
and the longer this lasts there will be people having doubts and more will
send money. We are conditioned that way. This is a cynical plan to raise
money, a scam like any other. Once they stop and say that they are not
carrying it any further [they dare not say they had no basis for the
assertion] they will not return the money that is now residing in their
coffers.

Here in Oz there was a saddler who had made a saddle for a pastoral company,
but couldn't recall which company he made it for, so he sent a bill for its
manufacture to the ten pastoral companies that he had on his books. He
received back 9 cheques.

They will not care about litigation, because if they do not bring it on, no
one else will, and if they do, it will be funded by those that are already
sending money just to be sure and safe.

There are too many numbers running around. The $699\$1399 numbers are
the before Oct 15/after Oct 15 price for a single-cpu server. The $199
number I quoted is the before Oct 15 price for a single-user desktop
machine. See http://www.sco.com/scosource/description.html They do
not give the after Oct 15 price for a desktop.

So you can sort of pick your own amount that you're not going to
pay. [My desktop has Apache running on it. So which would I owe if I

OK, will the amount I am not going to pay then is 1 cent.. they will not
get
one cent out of me...

The reason they are doing this, is very very simple.. they have dropping
revenue
and no way to improve the situation since SCO unix is not the best choice
unix anyway.
(IBM is not complaining about AIX, neither HP about HP-UX or Sun about
solaris being made
worthless by Linux.) SCO just don't have anything else thats making money
and they had to do something to stop their shareprice going down the
toilet.

The only way to make the company of interest to the shareholders is to
engage in legal action.
As for charging for linux, well they are furthering the scare tactics,
trying to show how "Serious" they are..
They might even scare a few away from linux or to buy a license...

Problem is that anyone that pays it, can sue them later if they are found
to have no case.

I think that its a safe bet that SCO won't be part of the IT industry's
future, they have burnt every bridge accept M$ and M$ doesn't want Unix
around either.

I think IBM and Novell should get together and counter sue SCO for making
unproven claims and trying to extort their linux clients. Have SCO barred
from making such claims till its proven in court. In other words, "put up
or shut up!" IBM and Novell can also sue that their linux business has been
hurt by SCO's unproven claims and sue for damages.

I am surprised at how little action has been taken in the US to counter
this.. they should be following the Europeans and have it ruled that SCO
must prove their claims before being able to try to extort customers.

That's all part of their FUD campain. They may try to charge for it, but
there's no way they can sue for it.

Say I write a book and publish it. Then along comes publisher B who takes
huge sections of my book and publishes it under another name, which is
clearly copyright violation. You bought the book from publisher B. Can I
sue you for copyright infringment because you purchased and read the book?
No. But I can go after publisher B.

I've seen that very analogy presented by various legal analysts.

They want to slow the adoption of Linux in corporate environments (since
Linux is beating UNIX by far more than it is Windows in those
environments), and hopes that there will be companies that will pay rather
than take a chance of being sued for copyright violation.

well you could just build and boot a 2.2 kernel...

As I understand it, the 2.2 kernel is not under scrutiny.

I think IBM and Novell should get together and counter sue SCO for making
unproven claims and trying to extort their linux clients. Have SCO barred
from making such claims till its proven in court. In other words, "put up

hurt by SCO's unproven claims and sue for damages.

First rule of law for anyone not a lawyer, don't sue, let others sue you.

IBM and Novell don't want to throw money away chasing a chimera.

I wonder... Will SCO come after me if I just switch to my copy of Caldera E-
Desktop, the technology release that has an early 2.4 kernel?

For the copy of Mandrake you now have. Wait...check that: it's $1399.00
for every CPU that's running a copy of kernel 2.4 or above.

Who's ready to pay?

SCO ready to clean out Linux users for $1399 per CPU
By Ashlee Vance in Chicago
Posted: 05/08/2003 at 21:35 GM

http://www.theregister.co.uk/content/53/32187.html

- crystal clear. .

I have my 139,900 pennies all stacked up. Where's the CEO so I can watch him
sit on them? And if its only 19,900 that would be pretty fun, too.

Personally, I can't wait for (and will happily participate in) the class
action lawsuit that SCO will inevitably get slapped with.

Frankly, that would be one settlement that I'd be happy if the lawyers got a
*big* paycheck at the end and I nothing. As long as it was a *really* *BIG*
paycheck...

Unfortunately, the problem [as I see it] is that, this is what they call an
"exit strategy" for the SCO scumbag... er... execs--i.e. they'll drive their
share-price as high as they can, with the promise of billions in pay-out,
then sell their stock and bail out.

At that point, the company will become worthless... Guess who the only
winners will be? Given the individuals involved, they'll probably manage to
get their sleazy hands into some other venture in short order... :( Maybe
someone should notify the FTC (or is it the SEC) of this probability?

But I digress... When is beta 2 comming out?? :)

Let's not generate our own FUD. The $1399 is for a server, not a
desktop. The fee for a single-user desktop is only $199.

No, I'm not paying that, either.
