An update on the testimonial ruse. I was contacted by a reporter from a 
major paper in New Jersey. They along with the atty.gen. have launched an 
investigation. The institutions that were quoted are pretty hot about it. 
Apparently the whole situation is pretty ugly. One other thing-- Chris Reeve 
removed himself from the company over two years ago for obvious reasons but 
they have continued to use his name. Of course, Chris died quite a while 
ago, so you can see the ethical implications.

Yep they had Arkansas Rehabilitation Services on there giving a testimonial with my counselors name and yes he was hot and told me to write a complaint along with him for using our names without permission.
Going to be interesting how this turns out.

MIDDLESEX COUNTY — Comfort Direct Inc., a New Brunswick-based company that produces "Self-Adjusting Technology" mattresses is being sued by the state Attorney General's Office and Division of Consumer Affairs for fraudulent advertising.


The company is accused of using unauthorized or fabricated testimonials from hospitals and individuals on its Web site.
Attorney General Zulima V. Farber said Comfort Direct "made false and unauthorized claims that its product was used and endorsed by medical institutions and doctors."
Farber said the company is accused of using unauthorized or fabricated testimonials from several medical facilities including five in New Jersey. They are Bayonne Medical Center, Health South Medical Center in Toms River, Kessler Institute of Rehabilitation in Chester, Saint Clare's Hospital in Dover and and the N.J. Department of Human Resources.
The Division of Consumer Affairs has received 33 complaints against the company which Farber said has ignored demands by the institutions to remove the testimonials and endorsements.
The company, which produces and sells mattresses and other bedding equipment, offers consumers a 90-day trial period, Farber said, but has attached conditions that are difficult to comply with.
"Consumers who thought these mattresses would help relieve back and neck pain encountered another type of pain when they want to return the mattresses and get refunds," Consumer Affairs Director Kimberly Ricketts said.

It is a good mattress and I have been satisfiedwith it. I have it on a 
regular bed though. I see no reason that it wouldn't work on a hospital bed.

Yesthey have sizes that fit hospital beds.
Rehabilitation services paid for it.
No I wouldn't recommendthis mattress, I've had for about 5 months and there's already an indention in it and there are better mattresses out there for thesame price which wasn't cheap.

Yeah I plan on pursuing this because it does bother me because other of my fellow quads are counting on my opinion as a quad and as I posted I wouldn't buy another one.
I don'tenjoy the fact of being used as a salesman or someone endorsing a brand to benefita companies profit margin.
now I wouldn't mind if they put my e-mail address on there for others to ask me personally but this just seems sleezy.

Sometinges, in life, all you have to market is your credibility. 
Endorsements, are a multi-million dollar industry. You don't think Ed 
McMahon of the Johnny Carson show is promoting Pride Products out of the 
kindness of his heart, do you? Or those people you see on television 
hawking the benefits of using the product they are representing. 
Compensation is big... very big.
So in the end, all you have to market is YOUR Crediblilty. When 
another steals your credibilty without your knowledge, your approval or 
compensation... it is wrong very wrong.
You have nothing to lose by complaining to those who are falsely using your 
good name for their corporate profits.
Best not to represent yourself. 
Always have a trained 3rd party do that for you.
Wait until you hear about some of the 
others who didn't know they were being used.

I too am excited at the thought that thru the combine efforts of many 
people on the Quad-List, justice will prevail. I'm actually surprised that 
Jim Lubin's name wasn't included in the celebrities who use the services of that 
company, lol.

Sometimes in marketing and advertising the term negative permission is 
justed to justify a company's actions. That is, if you don't give them 
permission "Not To" use your likeness or quotes, then it is automatic that they 
can. Kinda weird, eh?

Still, it would be kewl to contact a few of the notable references listed 
at the website to determine if they actually gave their knowing permission to 
endorse the product.

I know that most government agencies will not let their employees endorse 
products or companies for profit using their government positions. In some 
cases, it can be used as
grounds for dismissal. Unauthorized people, speaking on behalf of a 
government agency, for a For Profit company is frown upon.

Most States and local law programs have a "lawyer referral." You can 
speak with a local attorney for a period that varies from 30 minutes to an hours 
and its free. Check it out in your area. Make sure that you present 
and have "All The Facts" before making contact with the lawyer. Then

myself. Yes, I check the testamonials and saw quite a list of professional 
listed with their personal comments. I shutter to think what anyone of 
them would say or do if they are listed without their permission or 
consent. They are doctors, nurses, reseachers, government officials and I 
also saw Teddy Pendergrass, the singer. I'll bet that he is getting his 
money up front before he allowed them to post that with his picture.

Maybe none of them gave their permission and are not aware of the fact 
either.
Comfort Drect is listed as a member and supportor of the BBB and they 
also
displayed the NBC logo on their site. I wonder if everyone knows that 
or has approved its use on the website.

I'm employed by the State of Arkansas and I injured my spine during work. The State offers a program of rehabilitation and provides physical therapy products such as orthopedic mattresses. I was fortunate to receive the SAT Self Adjusting Technology Mattress for my home and it provides wonderful support for my back in addition to being extremely comfortable."

I'm pissed that's a bunch of bull. I bought one this year and the rehab 
that
bought is giving a testimonial also and I bet Chet Stuart my rehab 
counselor

doesn't know either and I'm calling him to find out.
We might have a lawsuit on our hands.

Yes, I check the testamonials and saw quite a list of professional listed
with their personal comments.  I shutter to think what anyone of them would
say or do if they are listed without their permission or consent.  They are
doctors, nurses, reseachers, government officials and I also saw Teddy
Pendergrass, the singer.  I'll bet that he is getting his money up front
before he allowed them to post that with his picture.

Maybe none of them gave their permission and are not aware of the fact
either.
Comfort Drect is listed as a member and supportor of the BBB and they also
displayed the NBC logo on their site.  I wonder if everyone knows that or
has approved its use on the website.

their approval or endorsement. I sent off an email to Teddy Pendergrass's 
people to see if he received his monies. Believe me when I say that he 
doesn't offer his endorsement to anyone or anything without being paid up 
front. His actions will speak much louder than any of our words.
