Dont alot of states have laws that still basicly say sex
between a man and a wife isnt rape?

When I tried to prosecute a rape, at one point they told me a
stranger raping someone is assault, but a person you know personally is a lesser
crime. makes sense, heh ?

 the defense introduced
what it described as compelling evidence that the
 accuser wore underpants

But prosecutors told Eagle County Judge Frederick

 uncontradicted
evidence that the Los Angeles Lakers' guard raped
 the 19-year-old woman at a
 mountain resort.

Now, Gannett must decide whether there is enough
 evidence in the case to
require a criminal trial. Bryant, who is free on
 $25,000 bond, faces the
potential of life in prison if he is convicted.

Gannett said he hoped to rule by Monday whether
 Bryant will have to stand
trial on a sexual assault charge that could send him
 to prison for life.

I am confident that the judge will find probably
 cause and will bind this

 the hearing. It is not
my intent to try this case to the media, but rather
to try this case to an
 Eagle County jury of 12.

Wednesday's hearing was held in open court after
 Gannett shot down
prosecutors' request to close portions of the
 proceedings to the public.

 Accuser's Sexual History Questioned

Bryant's defense focused on the accuser's
 undergarments. Lawyers said the
tests found substances -- later described by the
 lead investigator as
semen -- from a man other than Bryant. His lawyers
 argue that injuries to
the woman may have been caused by previous sexual
 partners.

 Bryant attorney Pamela Mackey (search

 Detective Doug Winters
to say that the yellow underwear the woman wore to
her rape exam at a nearby
hospital the next day contained sperm from another
 man, along with Caucasian
 pubic hair.

The 25-year-old Bryant, who is black, contends he
 had consensual sex with
 the woman.

Winters said the woman told him she had consensual
 sex with another man on
June 27 or June 28 and used a condom, backing
 earlier defense suggestions
she was sexually active before her encounter with
 Bryant.

Winters also said two pairs of panties from the
woman were tested - one from
the night of June 30, the other being the one she
wore to a hospital for an
 exam the next day.

The latter pair contained blood and semen, Winters
 said.

The accuser arrived at the hospital wearing panties
 with someone else's
semen and sperm in them, not that of Mr. Bryant,
 correct? Mackey asked.

 That's correct, Winters responded.

Mackey suggested injuries found during the woman's
 exam could have come from
having repeated sex, a contention she first made in
 court last week.

The defense contends the tests on the underpants
 provide Bryant with
 compelling evidence of innocence.

The defense questioning of Winters came six days
 after prosecutors revealed
details of the alleged June 30 attack.

Bryant sat stoically with his hands folded watching
 his attorney tear apart
the prosecution's version of the case. Occasionally,
 he leaned over and
talked to his other lawyer, Hal Haddon.

Mackey, who was subdued while questioning Winters,
 also managed to introduce
something prosecutors didn't talk about last week -
 a statement by the night
auditor at the hotel who was the first person the
 accuser saw when she left
 Bryant's room.

The night auditor sent police a letter saying she
saw the woman as she came
back to the front desk at the Cordillera Lodge
 Spa.

What the night auditor says in her letter is the
 accuser did not look or
sound as if there had been any problem, Mackey
 said, asking Winters,
 Correct?

 Yes, Winters

No, but it does have bearing on whether he
raped her or not. If she herself doesn't remember if she was clear in
saying no, then that matters don't you think? What if all she said to him

On the stand in testimony...
1) Detective said their was male Caucasian pubic hair and
semen in her panties from another man. These are the panties she
wore to the hospital.
2) Victim says no sex with no one for 4 days before
Kobe (ok, if that is true, why was she still wearing the panties
Uhhh)
3) Detective says that the victim was unclear if she
made it clear she said no.

Later guys and gals...in about 15 minutes that is.
 We are going to the
Smoky Mountains for the weekend. I'm so ready for this trip. I will
take some pictures and send them in...I have a digital camera now so
 no excuses, right? :-)

Anyway, we are staying in a cabin in Pigeon Forge.

I think we will enjoy it. We will drive to Gadsden, AL tonight or
Fort Payne, then go the rest of the way tomorrow. We'll be back
sometime Sunday night, so I will be back in after the weekend.

Next month it will be Branson, MO...we'll be taking mom up there so
she can have some time away from things after she recoups from the

Anyway, I'll be around for a few more minutes, then I'm gone. Hope you

[Sndbox] City puts lid on cabbies wearing caps

2003-10-16 Thread Charles

City puts lid on cabbies wearing caps
By LYDA LONGA Staff Writer Last update: 16
  October 2003

DAYTONA BEACH -- Joseph Young noticed it was raining as he left for
work on Oct. 1 -- so he donned his Boston Red Sox ball cap.
That decision cost Young, a cab driver who works double shifts to make
  ends meet, $103.
The cabbie, a driver for All-Florida Cab, Shuttle and Limo here, said
he was not aware that he was breaking any laws by wearing a baseball cap
  inside his cab.
"This is so stupid," Young said earlier this week.
After only four months on the job at All Florida, Young found out the
hard way about a city ordinance that regulates the appearance of cab
drivers. Such laws are also on the books in other cities across the
  country.
Dave Durante, a supervisor at All Florida, said all his drivers are
told up front that baseball caps are out, but Young said he doesn't
  remember the admonition.
On Oct. 1, he was parked along the curb at the intersection of
Grandview Avenue and Seabreeze Boulevard when a Daytona Beach officer
  sidled up to his cab.
According to a police report, the officer noticed Young was parked
illegally -- then spotted Young's Red Sox cap.
"He gave me a $40 ticket for parking along the yellow line," Young
said. "The cap ticket was $103."
Baseball might be as American as apple pie, but baseball caps -- and a
few other specific items of apparel -- are not, in Daytona Beach.
Part-time Daytona Beach resident Betty Monaco said she feels the cabbie
  dress code is paramount.
"I think baseball caps, especially when worn backwards, do not look
good," said Monaco, who wore a smart corduroy, cream-colored blazer and
dark slacks as she boarded a Yellow Cab at the airport Wednesday. "I like
to see a well-dressed taxi cab driver."
Deputy City Manager Paul McKitrick, who helped amend the taxi
driver-appearance ordinance in 1995, said company owners and the city
  wanted to improve cabbies' looks.
"There were too many cab drivers in the city wearing baseball-type
caps, and it gave a slovenly appearance," McKitrick said. "The thought was
that they did not look professional."
The municipal ordinance that emerged is brief but packs a punch,
according to cab company owner Tony Ciulla.
The fact that the ordinance does not rule out other types of hats --
such as cowboy hats, straw hats, beanies, etc. -- really irks Ciulla.
"I think if a cabbie was wearing a straw hat inside his cab, he would
look like a dork," said Ciulla, owner of Southern Komfort Taxi.
Ciulla says he is also upset that cabbies can't wear T-shirts. Cut-off
shorts and swimsuits are also illegal, as are sandals.
Young can take some solace. Other cities around the country have their
  own standards for cab-driver attire.
It's illegal to dress like Elvis while you drive a cab in Seattle. And
cabbies in St. Louis must wear black pants, black shoes and white shirts.
If you're a taxi driver in Philadelphia, make sure you're wearing socks
before you turn on the meter. And in Chicago, where some cabbies must don
khaki pants and polo shirts, umbrellas are a required accessory to keep
passengers dry in the lousy Midwestern weather.
Daytona Beach cab driver Mitch Moore has a problem with penalties that
can slam cabbies if they're not mindful of their wardrobe.
"There's nothing wrong with trying to maintain a standard for drivers,
but I think they're picking on people who don't make that much money to
  begin with," Moore said.
As far as Young is concerned, the whole issue is much ado about
  nothing.
"I usually wear a cap when it's rainy out," he said. "That's
  all."

[Sndbox] Bush's 'hate-filled people' remark riles Moslem leader

2003-10-16 Thread Charles

Bush's 'hate-filled people' remark riles
Moslem leaderOCTOBER 16, 2003 04:32:21 Jakarta (dpa) - U.S.
President George W. Bush's call on Indonesian Moslems to stop ``hate-filled
people'' from determining the country's future drew immediate fire from one
prominent religious leader who accused Washington of ``double standards''.
``We're demanding the U.S. explain to the world its stand,'' said Din
Syamsuddin, deputy chairman of Muhammadiyah, Indonesia's second largest Moslem
organization. Syamsudin's remark was in response to Bush's statement
calling on Indonesia to tell the world most of the country's Moslems are
moderate, and to stop small groups of ``hate-filled people'' from dictating how
the country should be run. In an interview published on Thursday by
Kompas newspaper, Indonesia's most respected daily, Bush said he will discuss
ways to combat terrorism with President Megawati Sukarnoputri and other Asian
leaders during his tour to Asia and Australia next week. ``I think it's
very important for Indonesia to firstly announce to the world that the majority
of Moslems in Indonesia are moderate, respecting democracy and peace,'' Bush
said in an interview. ``In line with that, it's very important not let a
splinter of murderers determine Indonesia's (future) ... We don't want that
Indonesia to be determined by a small group of hate-filled people,'' Bush added,
in an apparent reference to Moslem militants in the country. Syamsuddin,
who is also secretary general of the mainstream Indonesian Ulamas Council,
accused the U.S. of following a ``double-standard'' policy, in particularly in
connection with the Israeli-Palestinian conflict, and the invasion of
Afghanistan and Iraq. He also accused Bush of imposing unfair policy to
combat international terrorism. ``In handling terrorism, the United
States follows ... double standard policy,'' state-run Antara news agency quoted
Syamsuddin as saying. He urged Bush to stop terrorizing the world, in
particular his ``state terrorism'' policy because it has destroyed world order.
Syamsuddin urged President Megawati, as the leader of Indonesian which
boasts the world's largest Moslem population, ``should be brave in expressing
her peoples' aspiration and demanding the U.S. president to stop his unjust and
unfair policy in combatting terrorism''. Besides Megawati, during a
scheduled four-hour stop over on the Indonesian resort island of Bali on October
22, Bush also plans to hold talks with leaders of Indonesia's moderate Moslem
organizations. Bush, in his interview with Kompas, said he wanted to
address anti-American sentiment in Southeast Asia during his visit, ``to make
sure that people who are suspicious of our country finally understand our
motivation is pure''.

[Sndbox] Ozzy tour on shaky ground, canceled

2003-10-16 Thread Charles

Ozzy tour on shaky ground, canceledBOSTON
-- Ozzy Osbourne has canceled his European shock-rock tour to take treatment for
severe shaking, the London Mirror reported Wednesday. The 54-year-old's
trembling was obvious in episodes of the reality television show, "The
Osbournes," but it apparently caused him enough concern to seek help from a
Boston neurologist, the report said. Neurologist Allan Ropper, of St.
Elizabeth's Medical Center in Boston does not believe Ozzy has Parkinson's
disease as has been reported, and explained why singing would be a challenge
during treatment. "His tremor is now under control," Ropper said. "Unfortunately
some of the medication I prescribed can cause extreme dryness of the mouth."
Osbourne said he hopes to reschedule the European tour for next year. This
year's was to have launched in Dublin, Oct. 22.

[Sndbox] Police upset at secret filming of officers

2003-10-16 Thread Charles

Police upset at secret filming of
officersLONDON -- British police are upset over a BBC documentary of a
reporter who went undercover as a police officer, the London Sun reported. Mark
Daly, 28, joined the Manchester police department and secretly videotaped fellow
officers with a camera hidden in his uniform. He worked as an officer making
arrests and taking statements, the Sun said. "Daly deliberately set out to ply
young recruits with alcohol to loosen their tongues," a senior officer told the
Sun. "The staff at Stockport, where he worked, recall he often questioned them
about race and their personal views." Greater Manchester Chief Constable Michael
Todd failed at his appeal to the BBC not to air "The Secret Policeman," Tuesday
on BBC1. Meanwhile, Daly is out on bail after being charged with "suspicion of
obtaining an advantage by deception" for his salary of $23,000 during his time
at the Manchester police department.

[Sndbox] Kidman wins London Sun libel suit

2003-10-16 Thread Charles

Kidman wins London Sun libel suitLONDON --
Actress Nicole Kidman has won her libel case against the London Sun over claims
she had an affair with actor Jude Law, reports said Wednesday. The 37-year-old
actress was awarded undisclosed damages, which she reportedly will give to a
charity that helps children in Romania, the London Mirror said. Her lawyer told
the High Court in London: "The article implied the claimant had led Jude Law to
cheat on his wife, Sadie Frost, and by her behavior caused the breakdown of
their marriage." Law, 30, co-starred with Kidman in "Cold Mountain." He is
divorcing Frost, 37, with whom he has four children. In its own coverage, the
editors of the Sun wrote of the original article alleging she had broken the
marriage: "We now accept that these allegations are untrue. We apologize to Ms.
Kidman for the distress and the embarrassment caused to her. "As a mark of our
regret we have agreed to pay Ms. Kidman damages for libel and to pay her legal
costs."

[Sndbox] Everything I Need to Know

2003-10-16 Thread Golfer1isme
Everything I need to know about life, I learned from Noah's Ark...

One: Don't miss the boat.

Two: Remember that we are all in the same boat.

Three: Plan ahead. It wasn't raining when Noah built the Ark.

Four: Stay fit. When you're 600 years old, someone may ask you to do something really big.

Five: Don't listen to critics; just get on with the job that needs to be done.

Six: Build your future on high ground.

Seven: For safety  sake, travel in pairs.

Eight: Speed isn't always an advantage. The snails were on board with the cheetahs.

Nine: When you're stressed, float a while.

Ten: Remember, the Ark was built by amateurs; the Titanic by professionals.

Eleven: No matter the storm, when you are with God, there's always a rainbow waiting.

I would think that having a lot of sex with different
partners could in some instances make you sore,
bruised and even look like if it were one act, to be
on the more violent side. I bet most women would tell
you that having lots of sex in a short period of time,
can leave you sore and tender in that region...and it
doesn't have to be aggressive or violent in nature.

[Sndbox] Barbarella Update

2003-10-16 Thread Charles

Subject: [milliways-L] Barbarella Update

Screenwriter John August, who wrote two Barbarella spec scripts for
producer/star Drew Barrymore, told SCI FI Wire that the project is back on
after a hiatus of two years. I went through two drafts about two years ago,
between the first Charlie's [Angels] and the second Charlie's, August said
in an interview. I got busy, and then Drew got busy, and Laura Ziskin, the
other producer, got busy. And we all went our separate ways. So we're just
now coming back together and figuring out what we have and what kind of
movie we want to make.

August said that he's a fan of the character. I think Barbarella is a great
trippy character, and the story that we're really telling is kind of a fable
itself, he said. This is unbelievably pretentious, but it's sort of like
Candide in space, where you have this very naive character who bumbles
through everything and ends up changing the world by accident.

August added that this Barbarella will not resemble Roger Vadim's 1968
movie, which starred Jane Fonda. Rather, it will be based on the original
French comic books. We don't have the rights to the original Barbarella
[film], August said. So not only is it not like the original Barbarella,
it's deliberately and legally not very much like the original Barbarella,
because we don't have the rights to that movie. [The comics are] Barbarella
and the Mirror of Storms and I don't even remember [the other]. What's weird
is both those comic books are only in French, so I've only read the
translations. You can just say they're based on two untranslated French
comic books of Barbarella. Barrymore is still attached to star.

[Sndbox] ] NBC Orders Full Season of Las Vegas

2003-10-16 Thread Charles

LOS ANGELES (Zap2it.com) - In Las Vegas, 22 is usually the last number you
want to hit. It's coming up lucky, however, for the series Las Vegas.

NBC has picked up the freshman drama for a full season of 22 episodes. It's
the first new drama this fall to get a full-season pickup, although it seems
likely that CBS will commit to Cold Case, Navy NCIS and Joan of
Arcadia before too long.

It's no secret that 'Las Vegas' has been very good luck for NBC on Monday
nights since its premiere, and the public wants more of the glitz and
glamour, NBC Entertainment President Jeff Zucker says. We feel this series
is only just beginning to gain traction and has unlimited potential through
the rest of the year.

The series ranks fourth among new dramas in total viewers (behind the three
CBS shows mentioned above), averaging about 11.5 million in its first four
weeks. Monday's (Oct. 13) episode held its own against FOX's baseball
playoff coverage and ABC's Monday Night Football, drawing about 10.8
million people.

More important to NBC, Las Vegas is the highest-rated new drama of the
season among adults 18-49. It's averaged a 4.6 rating in the demographic,
which advertisers target and NBC uses as its measure of success.

The series stars James Caan as head of security at a high-end Vegas resort
and Josh Duhamel as his protege. Nikki Cox, Vanessa Marcil, James Lesure,
Marsha Thomason and Molly Sims round out the cast.

Ok, more stuff is still leaking out of yesterday's hearing. In the
testimony the detective said that in one of her interviews with him he asked

[Sndbox] Sen. Jay Rockefeller looked shocked

2003-10-16 Thread Charles

Sen. Jay Rockefeller looked shocked

Posted: October 15, 20031:00 a.m.
Eastern
2003WorldNetDaily.com

He had expected to say anything he wanted and escape without challenge.
But Fox News Channel's Tony Snow had a different idea. Snow thought it might
be interesting to stick to the facts for a change.
This Sunday past, Sen. Rockefeller took a play from the Terry McAuliffe
playbook and simply invented a convenient history. He told Snow and a national
television audience that President Bush has alarmed the nation with a speech
warning that an attack from Iraq was imminent.
Snow coolly played a tape of the president's State of the Union speech where
he in fact said exactly the opposite. Bush warned the Congress that the United
States could not wait for a threat to become imminent, to appear suddenly and
without warning.
Snow then read from a speech that Rockefeller himself had given, one in which
the West Virginia Democrat had proclaimed the threat from Iraq to be imminent.
Sen. Rockefeller was exposed and embarrassed and babbled on incoherently
about what an average American should have inferred from the president's speech.
I think he was close to proclaiming psychic powers when the interview
mercifully for him ended.
Finally, a Democratic critic of the president had been obliged to confront
the facts. It doesn't happen too often. On the same day, Slow Joe Biden was
allowed by Tim Russert to repeatedly dodge the hard questions such as why he had
voted for the war in Iraq if it seemed like a bad idea to him now. Few can
filibuster like Joe, however, and Russert didn't corner him.
The Democrats need cornering right now, especially on the Kay Report. It has
become an intonation from the left that David Kay's catalog of horrors
represents a huge setback for the administration when in fact it is an
eye-opening and verdict-sealing litany of the many threats Saddam posed to the
world.
The infrastructure and production of banned weapons is documented, as is the
last minute rush to destroy the evidence and conceal the trail. The
factually-minded, however, have all the evidence they need.

Saddam routinely and thoroughly violated the U.N. resolutions.

He routinely pursued and likely possessed a wide array of the world's
deadliest weapons. His ambitions in this area were enormous.

His regime would never have "evolved," and his brutal sons would have been
even more dangerous than the father.

Of 130 massive weapons depots, we have searched 10.
Even the summary of the report goes on at length with details of this sort.
Democrats and their allies in the media are attempting the biggest spin since
Clinton's declaration of chastity toward Ms. Lewinsky. They are saying that
David Kay has produced no proof of Saddam's threat. From that premise, they
launch into attacks on the war in Iraq, even when those attacks, like
Rockefeller's, depend on obvious lies.
It doesn't take much to expose this tactic and to demonstrate the agenda.
But it does take questioners willing to embarrass powerful Democrats, and it
does take a press corps willing to read the reports that brave men and women
have prepared.
The American voter will not be fooled by the double talk and posturing of
Democrats eager to return to power by any means. But it remains alarming that
elite media are so intent on assisting in their return that they will ignore and
distort even chapter and verse on the evils of Saddam's regime.
Recall that late in 2002, Saddam produced a detailed report for the U.N. that
purported to prove his compliance with all U.N. resolutions. Recall as well how
closely reported the production of that report was, and how many thought the
report combined with the return of inspectors to Iraq would protect Iraq from
invasion.
David Kay has now conclusively given the lie to all the theatrics of late
2002 and early 2003, to the ego of Blix and the maneuvers of the French. There
is overwhelming proof that all of the forces of appeasement then were wrong.
It is startling and shameful that instead of trumpeting this evidence of
American justice and wisdom, Democrats are joining with European critics to
question the predicate for the war.
Even if this turned out to be shrewd politics, it would still be reckless.
And it is likely to be the opposite of shrewd when Americans vote in 13
months.

City puts lid on cabbies wearing caps
By LYDA LONGA Staff Writer Last update: 16
October 2003

DAYTONA BEACH -- Joseph Young noticed it was raining as he left
for work on Oct. 1 -- so he donned his Boston Red Sox ball cap.
That decision cost Young, a cab driver who works double shifts to
make ends meet, $103.
Baseball might be as American as apple pie, but baseball caps -- and
a few other specific items of apparel -- are not, in Daytona Beach.
Part-time Daytona Beach resident Betty Monaco said she feels the
cabbie dress code is paramount.
"I think baseball caps, especially when worn backwards, do not look
good," said Monaco, who wore a smart corduroy, cream-colored blazer and
dark slacks as she boarded a Yellow Cab at the airport Wednesday. "I
like to see a well-dressed taxi cab driver."
"The thought
was that they did not look professional."
Cut-off shorts and swimsuits are also illegal, as are sandals.
Young can take some solace. Other cities around the country have
their own standards for cab-driver attire.
It's illegal to dress like Elvis while you drive a cab in Seattle.
And cabbies in St. Louis must wear black pants, black shoes and white
shirts.
If you're a taxi driver in Philadelphia, make sure you're wearing
socks before you turn on the meter. And in Chicago, where some cabbies
must don khaki pants and polo shirts, umbrellas are a required accessory
to keep passengers dry in the lousy Midwestern weather.
Daytona Beach cab driver Mitch Moore has a problem with penalties
that can slam cabbies if they're not mindful of their wardrobe.
"There's nothing wrong with trying to maintain a standard for
drivers, but I think they're picking on people who don't make that much
money to begin with," Moore said.
As far as Young is concerned, the whole issue is much ado about
nothing.
"I usually wear a cap when it's rainy out," he said. "That's
all."

caps, and it gave a slovenly appearance," McKitrick said. "The thought
was that they did not look professional."
"That's
all."

Ok, more stuff is still leaking out of yesterday's hearing. In the
testimony the detective said that in one of her interviews with him he asked
her if he stopped when she said no, and she said yes. That could account
for the lack of his semen. (i.e. he didn't finish). Now, if she said no

 On the stand in testimony...
 1) Detective said their was male Caucasian pubic hair and semen in her
panties from another man. These are the panties she wore to the
 hospital.
 2) Victim says no sex with no one for 4 days before Kobe (ok, if that
is true, why was she still wearing the panties
 Uhhh)
 3) Detective says that the victim was unclear if she made it clear
 she said no.

"The thought
was that they did not look professional."
Cut-off shorts and swimsuits are also illegal, as are sandals.
Young can take some solace. Other cities around the country have
their own standards for cab-driver attire.
It's illegal to dress like Elvis while you drive a cab in Seattle.
And cabbies in St. Louis must wear black pants, black shoes and white

to keep passengers dry in the lousy Midwestern weather.
"That's

Well, even if it is tossed, she can still sue him for civil damages and
possibly win because reasonable doubt isn't the standard. Let's say she did
have sex with him (he admits it, so it's a safe assumption), let's further
*speculate* she had sex with a bellhop. The bellhop raped (or at the very
least was rough enough to injure her) her. Which would be the juicer target
for the inevitable civil case?

Well, even if it is tossed, she can still sue him for civil damages and
possibly win because reasonable doubt isn't the standard. Let's say she did
have sex with him (he admits it, so it's a safe assumption), let's further
*speculate* she had sex with a bellhop. The bellhop raped (or at the very
least was rough enough to injure her) her. Which would be the juicer target
for the inevitable civil case?

[Sndbox] Can Antidiscrimination Laws Corrupt Religious Schools?

2003-10-16 Thread Charles

Can Antidiscrimination Laws Corrupt Religious
Schools?
Wednesday, October 15, 2003
By David E. Bernstein

Editor's Note: The article below is excerpted from the
author's new book,"You Can't Say That! The Growing Threat to Civil
Liberties from Antidiscrimination Laws" (Cato Institute, 2003)
Antidiscrimination laws (search)are colliding with civil liberties
at many levels -- on the job, in public spaces, and on campuses. Left-wing
egalitarian activists are pushing hard to eliminate every perceived slight,
offense, injustice and politically incorrect action they can identify. At
religious schools the conflict is intense, as the examples below show--and it's
sparking more court battles that have yet to settle the problem.
The First Amendment (search)protects the free exercise of
religion and prohibits governmental establishment of religion. The Constitution
prohibits the government from interfering in the hiring and firing of
''ministerial'' church employees, including religion teachers at
church-sponsored schools. However, courts have held that antidiscrimination laws
can still regulate the employment of teachers of secular subjects in religious
schools.
One such teacher, Linda Hoskinson, felt a calling to teach in
Christian schools. She found employment as a grade school instructor at
Dayton Christian Schools (search), an affiliate of two of Dayton, Ohio's
strict fundamentalist churches. DCS sought to employ only teachers who would
''carry with them into their classes the religious fervor and conviction felt
necessary to stimulate young minds into accepting Christ as savior.'' Hoskinson
seemed to have found her niche.
However, when Hoskinson informed the DCS administration that she
and her husband were expecting a baby, she was told that her contract would not
be renewed. The school's sponsoring churches believe that mothers of young
children should not be employed outside of the home, so continuing to employ
Hoskinson would flout church doctrine.
Hoskinson consulted an attorney, who informed DCS that it was
violating Hoskinson's rights under federal and state antidiscrimination laws,
even though DCS had accepted no government funding. DCS responded by immediately
firing Hoskinson for violating the ''Biblical Chain of Command (search)," a belief adhered to by some Christian
sects, including DCS's sponsors, that all disputes among members of the church
should be resolved within the church. Like all DCS employees, Hoskinson had
agreed in her contract to abide by the Biblical Chain of Command, but had broken
that agreement when she took her problems with church policy to an outside
lawyer.
Hoskinson filed a sex discrimination complaint with the Ohio
Civil Rights Commission. The commission investigated, and urged DCS to sign a
settlement agreement that stipulated, among other things, that contrary to DCS's
belief in resolving disputes within the church, DCS "shall make clear in its
employment contracts that employees may contact the Commission if they believe
they are being discriminated against at any time."
When DCS received the proposed agreement, it filed a suit in
federal court asking that the court protect DCS's free exercise of religion by
prohibiting the commission from investigating and prosecuting the school. The
court rejected DCS's free exercise claim, reasoning that the commission's
enforcement of Ohio's antidiscrimination law placed only ''a minimal burden'' on
the plaintiffs' free exercise rights. No mothers with young children would be
forced to work; DCS needed only to refrain from firing Hoskinson.
The court did not address the plaintiffs' claim that by forcing
DCS to employ a teacher who disobeyed church teachings, the law threatened the
plaintiffs' ability to impress upon the students the importance of church
doctrine.
Although the court downplayed the importance of the case to the
plaintiffs, it found that the state had a compelling interest in eliminating
''all forms of discrimination,'' and in preventing young people from being
educated ''in an atmosphere of discrimination.'' An appeals court reversed the
lower court decision, finding that the Commission's investigation violated the
plaintiffs' free exercise rights, and that those rights were not trumped by the
government's interest in eradicating discrimination.
The commission appealed to the Supreme Court. The case divided
liberal civil libertarian organizations. The American Civil Liberties Union
sided with the commission, while Americans United for the Separation of Church
and State supported the school's position. The Supreme Court ultimately
sidestepped the civil liberties issue by reversing the appeals court on the
grounds that the federal courts should not have interfered in ongoing state
proceedings.
Finally, after DCS had spent more than $100,000 defending
itself, Hoskinson dropped her lawsuit. Hoskinson, who in the meantime had given
birth to three children, and

[Sndbox] Malaysian Leader: 'Jews Rule World by Proxy'

2003-10-16 Thread Charles

Malaysian Leader: 'Jews Rule World by Proxy'
Thursday, October 16, 2003

PUTRAJAYA, Malaysia Malaysian Prime Minister Mahathir
Mohamad (search)on Thursday told a summit of Islamic
leaders that "Jews rule the world by proxy" and the world's 1.3 billion Muslims
should unite, using non-violent means for a "final victory.
His speech at the Organization of the Islamic
Conference (search)summit, which he was hosting, drew
criticism from Jewish leaders, who warned it could spark more violence against
Jews.
Mahathir, who is known for his outspoken, anti-Western rhetoric,
criticized what he described as Jewish domination of the world and Muslim
nations' inability to adequately respond to it as he opened the meeting of
Islamic leaders from 57 nations.
"The Europeans killed 6 million Jews out of 12 million, but
today the Jews rule the world by proxy," Mahathir said. "They get others to
fight and die for them."
Malaysia, a democratic nation which has a large non-Muslim
population and does not enforce strict Islamic law, has long been a critic of
Israel's occupation of Palestinian territories and of U.S. policy in the Middle
East, including the war in Iraq and its strong backing of the Jewish
state.
Mahathir, 77, who is retiring on Oct. 31, has used almost every
international podium to lambaste the West for two decades, winning a reputation
as an outspoken champion of Third World causes.
"For well over half a century we have fought over Palestine.
What have we achieved? Nothing. We are worse off than before," he said. "If we
had paused to think, then we could have devised a plan, a strategy that can win
us final victory."
The prime minister, who has turned his country into the world's
17th-ranked trading nation during his 22 years in power, said Jews "invented
socialism, communism, human rights and democracy" to avoid persecution and gain
control of the most powerful countries.
Mahathir added that "1.3 billion Muslims cannot be defeated by a
few million Jews," but he suggested using political and economic tactics instead
of violence.
Israeli Foreign Ministry spokesman Jonathan Peled expressed
disappointment in the remarks but said he wasn't surprised.
"It is not new that in such forums there is always an attempt to
reach of the lowest common denominator which is Israel bashing," he said in
Jerusalem. "But obviously we'd like to see more moderate and responsible kind of
declarations coming out of such summits."
Rabbi Abraham Cooper, associate dean of the Simon
Wiesenthal Center (search)in Los Angeles, said Mahathir has
used anti-Israel statements in the past to prove he's tough on the West. But, he
said, Thursday's speech was still worrisome.
"What is profoundly shocking and worrying is the venue of the
speech, the audience and coming in the time we're living in," Cooper said during
a visit to Jerusalem. "Mahathir's speech today is an absolute invitation for
more hate crimes and terrorism against Jews. That's serious."
U.S. Ambassador to Malaysia Marie Huhtala declined to comment on
Mahathir's speech. Washington was angered over a speech he made in February, as
host of the Non-Aligned Movement of 117 countries, in which he described the
looming war against Iraq as racist.
Afghan President Hamid Karzai said he supported Mahathir's
analysis, which also included steps for how Muslim nations can develop
economically and socially.
"It is great to hear Prime Minister Mahathir speak so eloquently
on the problems of the ummah (Muslim world) and ways to remedy them," Karzai
said. "His speech was an eye-opener to a lot of us and that is what the Islamic
world should do."
The summit is the first since the Sept. 11, 2001, terror attacks
reshaped global politics and comes at a time when many Muslims -- even U.S.
allies -- feel the war on terrorism has become a war against them.
"It is well known that the Islamic community is being targeted
today more than at any other time before in its creed, culture and social and
political orientation," said Qatar's ruler, Sheikh Hamad bin Khalifa al-Thani,
who hosted the U.S. headquarters in the Iraq war.
The status of Iraq also proved a divisive issue. Malaysia
resisted inviting the U.S.-picked Iraqi Governing Council, describing it as a
puppet of American occupation. But Arab countries that have recognized the
interim body prevailed and council representatives were attending the
summit.
Leaders attending the summit included Jordan's King Abullah,
Syrian President Bashar Assad, Morocco's King Mohammed VI, Pakistani President
Pervez Musharraf and Indonesian President Megawati Sukarnoputri.
Russian President Vladimir Putin and Philippine President Gloria
Macapagal Arroyo are attending as special observers because of their large
Muslim minorities.

Charles I can see over ruling the parents. Because the husband

the husband should take their feelings into account, the decision must
always remain with the spouse.

[Sndbox] Lara Flynn Boyle's Big Mystery

2003-10-16 Thread Charles

Lara Flynn Boyle's Big Mystery

AP

Lara Flynn BoyleGet ready because yet another actor is about to get
behind the camera.
Lara Flynn Boyle, known for her
work as Helen the D.A. on "The Practice" and Donna the ditzy teen on "Twin
Peaks" is becoming a director.
Boyle -- wearing lots of makeup and looking
sultry -- shimmied into the Paris Review party Tuesday night, but kept way out
of the way. In fact, if publicist R. Couri Hay hadn't noticed a
person "who looks just like Lara Flynn Boyle," we might have all missed
her.
Jack Nicholson's sometime,
one-time girlfriend came to the big literary event with a dark-haired,
unidentified young man. She told me was there to see her long time pal
Alec Baldwin read a passage from the work of Jack
Kerouac from the stage.
But Boyle's big, mysterious new project is
something she's directing for HBO. Whatever it is -- and no one including her
close friends seem to know if it's a comedy, drama or documentary -- starts soon
in New York.
Eight years ago at the opening of the Hard Rock
Hotel in Las Vegas, Boyle, George Clooney and Gina
Gershon played a mean game of all-night blackjack with me and Page
Six's Richard Johnson. I wondered if Boyle remembered this long
ago sojourn.
"Yes!" she cried. "And I won you a lot of money
if I recall!" And then, perhaps in search of a late night dinner, she
disappeared.
'Born Rich' --
and Dumb
It's not TV, it's HBO, although Josiah
Hornblower's mother doesn't know about it. "She doesn't have HBO," he
said last night. "I don't think she even has cable."
What a shame, because Hornblower's mother, a
descendant of the Whitney-Vanderbilt family, could see her
28-year-old in a new HBO offering called "Born Rich." Billed incorrectly as a
documentary -- it isn't, trust me -- "Born Rich" was made by silver spoon owner
Jamie Johnson. He's the grandson or something of the founder of
Johnson Johnson, and he thought it would be enlightening or fun to make a
film about all his young friends who live on inherited wealth.
It's too easy to say he was wrong. Critiquing
"Born Rich" is like shooting fish in a barrel. You know going in that all the
participants will be insipid and stupid, bratty nincompoops who deserve a good
whacking and pick-pocketing at the same time. If you accept that, then "Born
Rich" is a big success. If not, well, get ready to be snarky.
How eye-opening Johnson's film could have been
if he were a real filmmaker or at least found one to help him. But you go into
"Born Rich" and leave it knowing nothing except that money and youth are wasted
on the young. For instance, there's the young Italian whose biggest concern in
life is finding a good tailor. He complains that "low lapels" on a suit jacket
are gauche. "That's what Clinton had," he says with disgust.
Yeah, you want to strangle him, but there are
other rocket scientists here to deal with: Ivanka Trump,
Luke Weil, Si Newhouse, Georgina
Bloomberg (daughter of New York City's mayor), Stephanie
Ercklentz, Juliet Hartford, Carlo von
Zeitschel, and the truly odious Christina Floyd,
daughter of famous golfer Raymond Floyd, among them.
(I was disappointed that the biggest society
nitwits of all time, Paris and Nikki Hilton,
were not in the film. These two dopes were featured on "Oprah" earlier this week
along with Johnson, which led me to believe they'd been included. Why there's
been no federal legislation banning these two from public appearances is a
mystery to me. Check the "Oprah" tape for Paris' inability to remember that the
white box in her house with clothes and water in it is called a washing
machine.)
Of course this group whines about everything.
They don't work -- big surprise! But worse than that, they are an uneducated
group of louts who only know each other (thank goodness.) Surely the worst
moment in the film belongs to Floyd, who describes without any irony, the
restricted nature of the Southampton Bath and Tennis Club which remains
exclusive of Jews, blacks or minorities of any kind. If Johnson were an actual
filmmaker he might have addressed this issue, but he's not. In the end he's one
of them and he lets Floyd's moronic and alarming comments float by as if they
were no worse than the issue of good tailoring.
Johnson misses a lot of other things too. Even
though you might think being this stupid is at least mitigated by being really,
really rich, there's no indication that the money can vanish as easily as it
came.
Hartford's father, for example, frittered away
an enormous estate, leaving her and her mother in dire straits. This is never
explained.
Trump, sporting several hair-coloring jobs over
a short time, alludes to the financial trouble her father, Donald, experienced
in the mid '90s. But this is also glossed over, as are almost any in depth
discussion of these kids' parents' multiple marriages, public affairs and other
scandals.
In the end, the only mildly

Charles This I agree with. I think that the husband and the

I can not see over ruling the woman's parents on this matter.
I think it is in very poor taste and quite cruel... JMO.
Charles I can see over ruling the parents. Because the husband

asked her if he stopped when she said no, and she said yes. That
could account for the lack of his semen. (i.e. he didn't finish).
Now, if she said no (that's in question) and from her own testimony he
stoppedis that rape?
Isn't stopping what he's *SUPPOSED* to do?

Maybe we shouldn't do this sounds like she wanted to be convinced that
it was ok..that he might care for her afterwards or something to me. I
think she got what she wanted...and then had second thoughts after he
didn't want a relationship with her afterwards. She is young..but she
obviously had sex before...and from what we are hearing now, quite a
lot of it.

RE: [Sndbox] Breaking...

2003-10-16 Thread Charles

But Jackie you have to have some sort of
standard to go by. I'm not advocating that it's ok for someone to drug a
gal and rape her, you know I'm not. But if there isn't some sort of
standard then rape will never be prosecutable. Either that or anyone can
get prosecuted for a serious crime because he makes a girl mad. That's why
the recent law passed in one state that says a woman can withdraw consent even
while the act is being committed and if he doesn't stop the thrust *immediately*
he's raped her is such a dangerous law.

There has to be some sort of acknowledgement
that the guy in question should at least have the right to expect a clear
no. In the case of drugging someone that's not consensual in any
manner. In this case both parties admit consent. She even told the
detective that he stopped when she made it clear.

its not a yes. how about a rape victim whos been
drugged or a rape victim whos drank too much or one whos mouth is covered where
they cant say no does that make it less of a rape because they couldnt say
no?

i cant answer on alot of partners but on the lot of sex part your not sore or tender if the guy knows what hes doing :

RE: [Sndbox] Right to Die

2003-10-16 Thread Angela
I somewhat agree with you on that, but in some cases the husband might know
the wishes better than the parents. I do think he should talk it over with
them, listen to what they think, take it into consideration and then make
his decision.

Again I am not arguing... only pointing out that the parents
should have a valid bitch. If I were the husband I wouldn't
be able to say to the parents No she has to die
If there were a living will that said she wanted to die under
theses circumstances it might be different.

To me part of being married is getting along with the spouses
 family... or
 at least having some respect.

Charles This I agree with. I think that the husband and the
 parents
should be able to come to an agreement.

I can not see over ruling the woman's parents on this matter.
I think it is in very poor taste and quite cruel... JMO.

Charles I can see over ruling the parents. Because the husband
 is the
next of kin. As I stated before, if my wife made the hard decision to
 take
me off life support there is no way I would want my mother to be able
 to
come and reverse that decision. When I got married I left her house
 for
good, and my wife became my closest relative. While I agree with you
 that
the husband should take their feelings into account, the decision must
 always remain with the spouse.

disheveled, was not bleeding or apparently injured, and acted normally. It
does make one wonder you know.

the thing here though is not to establish reasonable doubt at a hearing the hearing is suppose to see if there is enough evidence to go to trial. at least thats what a normal hearing is for.
