City puts lid on cabbies wearing caps By LYDA LONGA Staff Writer Last update: 16 October 2003 DAYTONA BEACH -- Joseph Young noticed it was raining as he left for work on Oct. 1 -- so he donned his Boston Red Sox ball cap. That decision cost Young, a cab driver who works double shifts to make ends meet, $103. The cabbie, a driver for All-Florida Cab, Shuttle and Limo here, said he was not aware that he was breaking any laws by wearing a baseball cap inside his cab. "This is so stupid," Young said earlier this week. After only four months on the job at All Florida, Young found out the hard way about a city ordinance that regulates the appearance of cab drivers. Such laws are also on the books in other cities across the country. Dave Durante, a supervisor at All Florida, said all his drivers are told up front that baseball caps are out, but Young said he doesn't remember the admonition. On Oct. 1, he was parked along the curb at the intersection of Grandview Avenue and Seabreeze Boulevard when a Daytona Beach officer sidled up to his cab. According to a police report, the officer noticed Young was parked illegally -- then spotted Young's Red Sox cap. "He gave me a $40 ticket for parking along the yellow line," Young said. "The cap ticket was $103." Baseball might be as American as apple pie, but baseball caps -- and a few other specific items of apparel -- are not, in Daytona Beach. Part-time Daytona Beach resident Betty Monaco said she feels the cabbie dress code is paramount. "I think baseball caps, especially when worn backwards, do not look good," said Monaco, who wore a smart corduroy, cream-colored blazer and dark slacks as she boarded a Yellow Cab at the airport Wednesday. "I like to see a well-dressed taxi cab driver." Deputy City Manager Paul McKitrick, who helped amend the taxi driver-appearance ordinance in 1995, said company owners and the city wanted to improve cabbies' looks. "There were too many cab drivers in the city wearing baseball-type caps, and it gave a slovenly appearance," McKitrick said. "The thought was that they did not look professional." The municipal ordinance that emerged is brief but packs a punch, according to cab company owner Tony Ciulla. The fact that the ordinance does not rule out other types of hats -- such as cowboy hats, straw hats, beanies, etc. -- really irks Ciulla. "I think if a cabbie was wearing a straw hat inside his cab, he would look like a dork," said Ciulla, owner of Southern Komfort Taxi. Ciulla says he is also upset that cabbies can't wear T-shirts. Cut-off shorts and swimsuits are also illegal, as are sandals. Young can take some solace. Other cities around the country have their own standards for cab-driver attire. It's illegal to dress like Elvis while you drive a cab in Seattle. And cabbies in St. Louis must wear black pants, black shoes and white shirts. If you're a taxi driver in Philadelphia, make sure you're wearing socks before you turn on the meter. And in Chicago, where some cabbies must don khaki pants and polo shirts, umbrellas are a required accessory to keep passengers dry in the lousy Midwestern weather. Daytona Beach cab driver Mitch Moore has a problem with penalties that can slam cabbies if they're not mindful of their wardrobe. "There's nothing wrong with trying to maintain a standard for drivers, but I think they're picking on people who don't make that much money to begin with," Moore said. I am not arguing the legality. Or the need for the law to be as it is. Only that in this case I believe that the husband is being a prick. G Charles I can see over ruling the parents. As I stated before, if my wife made the hard decision to take me off life support there is no way I would want my mother to be able to come and reverse that decision. When I got married I left her house for good, and my wife became my closest relative. Kidman wins London Sun libel suitLONDON -- Actress Nicole Kidman has won her libel case against the London Sun over claims she had an affair with actor Jude Law, reports said Wednesday. The 37-year-old actress was awarded undisclosed damages, which she reportedly will give to a charity that helps children in Romania, the London Mirror said. Her lawyer told the High Court in London: "The article implied the claimant had led Jude Law to cheat on his wife, Sadie Frost, and by her behavior caused the breakdown of their marriage." Law, 30, co-starred with Kidman in "Cold Mountain." He is divorcing Frost, 37, with whom he has four children. In its own coverage, the editors of the Sun wrote of the original article alleging she had broken the marriage: "We now accept that these allegations are untrue. We apologize to Ms. Kidman for the distress and the embarrassment caused to her. "As a mark of our regret we have agreed to pay Ms. Kidman damages for libel and to pay her legal costs." He told Snow and a national television audience that President Bush has alarmed the nation with a speech warning that an attack from Iraq was imminent. Snow coolly played a tape of the president's State of the Union speech where he in fact said exactly the opposite. Bush warned the Congress that the United States could not wait for a threat to become imminent, to appear suddenly and without warning. Snow then read from a speech that Rockefeller himself had given, one in which the West Virginia Democrat had proclaimed the threat from Iraq to be imminent. Sen. Rockefeller was exposed and embarrassed and babbled on incoherently about what an average American should have inferred from the president's speech. I think he was close to proclaiming psychic powers when the interview mercifully for him ended. Finally, a Democratic critic of the president had been obliged to confront the facts. It doesn't happen too often. On the same day, Slow Joe Biden was allowed by Tim Russert to repeatedly dodge the hard questions such as why he had voted for the war in Iraq if it seemed like a bad idea to him now. Few can filibuster like Joe, however, and Russert didn't corner him. The Democrats need cornering right now, especially on the Kay Report. It has become an intonation from the left that David Kay's catalog of horrors represents a huge setback for the administration when in fact it is an eye-opening and verdict-sealing litany of the many threats Saddam posed to the world. The infrastructure and production of banned weapons is documented, as is the last minute rush to destroy the evidence and conceal the trail. The factually-minded, however, have all the evidence they need. Saddam routinely and thoroughly violated the U.N. resolutions. He routinely pursued and likely possessed a wide array of the world's deadliest weapons. His ambitions in this area were enormous. His regime would never have "evolved," and his brutal sons would have been even more dangerous than the father. Of 130 massive weapons depots, we have searched 10. Even the summary of the report goes on at length with details of this sort. Democrats and their allies in the media are attempting the biggest spin since Clinton's declaration of chastity toward Ms. Lewinsky. They are saying that David Kay has produced no proof of Saddam's threat. From that premise, they launch into attacks on the war in Iraq, even when those attacks, like Rockefeller's, depend on obvious lies. It doesn't take much to expose this tactic and to demonstrate the agenda. But it does take questioners willing to embarrass powerful Democrats, and it does take a press corps willing to read the reports that brave men and women have prepared. The American voter will not be fooled by the double talk and posturing of Democrats eager to return to power by any means. But it remains alarming that elite media are so intent on assisting in their return that they will ignore and distort even chapter and verse on the evils of Saddam's regime. Recall that late in 2002, Saddam produced a detailed report for the U.N. that purported to prove his compliance with all U.N. resolutions. Recall as well how closely reported the production of that report was, and how many thought the report combined with the return of inspectors to Iraq would protect Iraq from invasion. David Kay has now conclusively given the lie to all the theatrics of late 2002 and early 2003, to the ego of Blix and the maneuvers of the French. There is overwhelming proof that all of the forces of appeasement then were wrong. It is startling and shameful that instead of trumpeting this evidence of American justice and wisdom, Democrats are joining with European critics to question the predicate for the war. Even if this turned out to be shrewd politics, it would still be reckless. And it is likely to be the opposite of shrewd when Americans vote in 13 months. That decision cost Young, a cab driver who works double shifts to make ends meet, $103. The cabbie, a driver for All-Florida Cab, Shuttle and Limo here, said he was not aware that he was breaking any laws by wearing a baseball cap inside his cab. "This is so stupid," Young said earlier this week. After only four months on the job at All Florida, Young found out the hard way about a city ordinance that regulates the appearance of cab drivers. Such laws are also on the books in other cities across the country. Dave Durante, a supervisor at All Florida, said all his drivers are told up front that baseball caps are out, but Young said he doesn't remember the admonition. On Oct. 1, he was parked along the curb at the intersection of Grandview Avenue and Seabreeze Boulevard when a Daytona Beach officer sidled up to his cab. According to a police report, the officer noticed Young was parked illegally -- then spotted Young's Red Sox cap. "He gave me a $40 ticket for parking along the yellow line," Young said. "The cap ticket was $103." Baseball might be as American as apple pie, but baseball caps -- and a few other specific items of apparel -- are not, in Daytona Beach. Part-time Daytona Beach resident Betty Monaco said she feels the cabbie dress code is paramount. "I think baseball caps, especially when worn backwards, do not look good," said Monaco, who wore a smart corduroy, cream-colored blazer and dark slacks as she boarded a Yellow Cab at the airport Wednesday. "I like to see a well-dressed taxi cab driver." Deputy City Manager Paul McKitrick, who helped amend the taxi driver-appearance ordinance in 1995, said company owners and the city wanted to improve cabbies' looks. "There were too many cab drivers in the city wearing baseball-type caps, and it gave a slovenly appearance," McKitrick said. "The thought was that they did not look professional." The municipal ordinance that emerged is brief but packs a punch, according to cab company owner Tony Ciulla. The fact that the ordinance does not rule out other types of hats -- such as cowboy hats, straw hats, beanies, etc. -- really irks Ciulla. "I think if a cabbie was wearing a straw hat inside his cab, he would look like a dork," said Ciulla, owner of Southern Komfort Taxi. Ciulla says he is also upset that cabbies can't wear T-shirts. Cut-off shorts and swimsuits are also illegal, as are sandals. Young can take some solace. Other cities around the country have their own standards for cab-driver attire. It's illegal to dress like Elvis while you drive a cab in Seattle. And cabbies in St. Louis must wear black pants, black shoes and white shirts. If you're a taxi driver in Philadelphia, make sure you're wearing socks before you turn on the meter. And in Chicago, where some cabbies must don khaki pants and polo shirts, umbrellas are a required accessory to keep passengers dry in the lousy Midwestern weather. Daytona Beach cab driver Mitch Moore has a problem with penalties that can slam cabbies if they're not mindful of their wardrobe. "There's nothing wrong with trying to maintain a standard for drivers, but I think they're picking on people who don't make that much money to begin with," Moore said. They say the questioning brought into evidence that shouldn't be brought into play yet. Can Antidiscrimination Laws Corrupt Religious Schools? Wednesday, October 15, 2003 By David E. Bernstein Editor's Note: The article below is excerpted from the author's new book,"You Can't Say That! The Growing Threat to Civil Liberties from Antidiscrimination Laws" (Cato Institute, 2003) Antidiscrimination laws (search)are colliding with civil liberties at many levels -- on the job, in public spaces, and on campuses. Left-wing egalitarian activists are pushing hard to eliminate every perceived slight, offense, injustice and politically incorrect action they can identify. At religious schools the conflict is intense, as the examples below show--and it's sparking more court battles that have yet to settle the problem. The First Amendment (search)protects the free exercise of religion and prohibits governmental establishment of religion. The Constitution prohibits the government from interfering in the hiring and firing of ''ministerial'' church employees, including religion teachers at church-sponsored schools. However, courts have held that antidiscrimination laws can still regulate the employment of teachers of secular subjects in religious schools. One such teacher, Linda Hoskinson, felt a calling to teach in Christian schools. She found employment as a grade school instructor at Dayton Christian Schools (search), an affiliate of two of Dayton, Ohio's strict fundamentalist churches. DCS sought to employ only teachers who would ''carry with them into their classes the religious fervor and conviction felt necessary to stimulate young minds into accepting Christ as savior.'' Hoskinson seemed to have found her niche. However, when Hoskinson informed the DCS administration that she and her husband were expecting a baby, she was told that her contract would not be renewed. The school's sponsoring churches believe that mothers of young children should not be employed outside of the home, so continuing to employ Hoskinson would flout church doctrine. Hoskinson consulted an attorney, who informed DCS that it was violating Hoskinson's rights under federal and state antidiscrimination laws, even though DCS had accepted no government funding. DCS responded by immediately firing Hoskinson for violating the ''Biblical Chain of Command (search)," a belief adhered to by some Christian sects, including DCS's sponsors, that all disputes among members of the church should be resolved within the church. Like all DCS employees, Hoskinson had agreed in her contract to abide by the Biblical Chain of Command, but had broken that agreement when she took her problems with church policy to an outside lawyer. Hoskinson filed a sex discrimination complaint with the Ohio Civil Rights Commission. The commission investigated, and urged DCS to sign a settlement agreement that stipulated, among other things, that contrary to DCS's belief in resolving disputes within the church, DCS "shall make clear in its employment contracts that employees may contact the Commission if they believe they are being discriminated against at any time." When DCS received the proposed agreement, it filed a suit in federal court asking that the court protect DCS's free exercise of religion by prohibiting the commission from investigating and prosecuting the school. The court rejected DCS's free exercise claim, reasoning that the commission's enforcement of Ohio's antidiscrimination law placed only ''a minimal burden'' on the plaintiffs' free exercise rights. No mothers with young children would be forced to work; DCS needed only to refrain from firing Hoskinson. The court did not address the plaintiffs' claim that by forcing DCS to employ a teacher who disobeyed church teachings, the law threatened the plaintiffs' ability to impress upon the students the importance of church doctrine. Although the court downplayed the importance of the case to the plaintiffs, it found that the state had a compelling interest in eliminating ''all forms of discrimination,'' and in preventing young people from being educated ''in an atmosphere of discrimination.'' An appeals court reversed the lower court decision, finding that the Commission's investigation violated the plaintiffs' free exercise rights, and that those rights were not trumped by the government's interest in eradicating discrimination. The commission appealed to the Supreme Court. The case divided liberal civil libertarian organizations. The American Civil Liberties Union sided with the commission, while Americans United for the Separation of Church and State supported the school's position. The Supreme Court ultimately sidestepped the civil liberties issue by reversing the appeals court on the grounds that the federal courts should not have interfered in ongoing state proceedings. Malaysian Leader: 'Jews Rule World by Proxy' Thursday, October 16, 2003 PUTRAJAYA, Malaysia Malaysian Prime Minister Mahathir Mohamad (search)on Thursday told a summit of Islamic leaders that "Jews rule the world by proxy" and the world's 1.3 billion Muslims should unite, using non-violent means for a "final victory. "The Europeans killed 6 million Jews out of 12 million, but today the Jews rule the world by proxy," Mahathir said. "They get others to fight and die for them." Malaysia, a democratic nation which has a large non-Muslim population and does not enforce strict Islamic law, has long been a critic of Israel's occupation of Palestinian territories and of U.S. policy in the Middle East, including the war in Iraq and its strong backing of the Jewish state. Mahathir, 77, who is retiring on Oct. 31, has used almost every international podium to lambaste the West for two decades, winning a reputation as an outspoken champion of Third World causes. "For well over half a century we have fought over Palestine. What have we achieved? Nothing. We are worse off than before," he said. "If we had paused to think, then we could have devised a plan, a strategy that can win us final victory." The prime minister, who has turned his country into the world's 17th-ranked trading nation during his 22 years in power, said Jews "invented socialism, communism, human rights and democracy" to avoid persecution and gain control of the most powerful countries. Mahathir added that "1.3 billion Muslims cannot be defeated by a few million Jews," but he suggested using political and economic tactics instead of violence. Israeli Foreign Ministry spokesman Jonathan Peled expressed disappointment in the remarks but said he wasn't surprised. "It is not new that in such forums there is always an attempt to reach of the lowest common denominator which is Israel bashing," he said in Jerusalem. "But obviously we'd like to see more moderate and responsible kind of declarations coming out of such summits." Rabbi Abraham Cooper, associate dean of the Simon Wiesenthal Center (search)in Los Angeles, said Mahathir has used anti-Israel statements in the past to prove he's tough on the West. But, he said, Thursday's speech was still worrisome. U.S. Ambassador to Malaysia Marie Huhtala declined to comment on Mahathir's speech. Washington was angered over a speech he made in February, as host of the Non-Aligned Movement of 117 countries, in which he described the looming war against Iraq as racist. Afghan President Hamid Karzai said he supported Mahathir's analysis, which also included steps for how Muslim nations can develop economically and socially. "It is great to hear Prime Minister Mahathir speak so eloquently on the problems of the ummah (Muslim world) and ways to remedy them," Karzai said. "His speech was an eye-opener to a lot of us and that is what the Islamic world should do." The summit is the first since the Sept. 11, 2001, terror attacks reshaped global politics and comes at a time when many Muslims -- even U.S. allies -- feel the war on terrorism has become a war against them. "It is well known that the Islamic community is being targeted today more than at any other time before in its creed, culture and social and political orientation," said Qatar's ruler, Sheikh Hamad bin Khalifa al-Thani, who hosted the U.S. headquarters in the Iraq war. The status of Iraq also proved a divisive issue. Malaysia resisted inviting the U.S.-picked Iraqi Governing Council, describing it as a puppet of American occupation. But Arab countries that have recognized the interim body prevailed and council representatives were attending the summit. Leaders attending the summit included Jordan's King Abullah, Syrian President Bashar Assad, Morocco's King Mohammed VI, Pakistani President Pervez Musharraf and Indonesian President Megawati Sukarnoputri. Billed incorrectly as a documentary -- it isn't, trust me -- "Born Rich" was made by silver spoon owner Jamie Johnson. He's the grandson or something of the founder of Johnson Johnson, and he thought it would be enlightening or fun to make a film about all his young friends who live on inherited wealth. It's too easy to say he was wrong. Critiquing "Born Rich" is like shooting fish in a barrel. You know going in that all the participants will be insipid and stupid, bratty nincompoops who deserve a good whacking and pick-pocketing at the same time. If you accept that, then "Born Rich" is a big success. If not, well, get ready to be snarky. How eye-opening Johnson's film could have been if he were a real filmmaker or at least found one to help him. But you go into "Born Rich" and leave it knowing nothing except that money and youth are wasted on the young. For instance, there's the young Italian whose biggest concern in life is finding a good tailor. He complains that "low lapels" on a suit jacket are gauche. "That's what Clinton had," he says with disgust. Yeah, you want to strangle him, but there are other rocket scientists here to deal with: Ivanka Trump, Luke Weil, Si Newhouse, Georgina Bloomberg (daughter of New York City's mayor), Stephanie Ercklentz, Juliet Hartford, Carlo von Zeitschel, and the truly odious Christina Floyd, daughter of famous golfer Raymond Floyd, among them. (I was disappointed that the biggest society nitwits of all time, Paris and Nikki Hilton, were not in the film. These two dopes were featured on "Oprah" earlier this week along with Johnson, which led me to believe they'd been included. Why there's been no federal legislation banning these two from public appearances is a mystery to me. Check the "Oprah" tape for Paris' inability to remember that the white box in her house with clothes and water in it is called a washing machine.) Of course this group whines about everything. They don't work -- big surprise! But worse than that, they are an uneducated group of louts who only know each other (thank goodness.) Surely the worst moment in the film belongs to Floyd, who describes without any irony, the restricted nature of the Southampton Bath and Tennis Club which remains exclusive of Jews, blacks or minorities of any kind. If Johnson were an actual filmmaker he might have addressed this issue, but he's not. In the end he's one of them and he lets Floyd's moronic and alarming comments float by as if they were no worse than the issue of good tailoring. Johnson misses a lot of other things too. Even though you might think being this stupid is at least mitigated by being really, really rich, there's no indication that the money can vanish as easily as it came. Hartford's father, for example, frittered away an enormous estate, leaving her and her mother in dire straits. This is never explained. Trump, sporting several hair-coloring jobs over a short time, alludes to the financial trouble her father, Donald, experienced in the mid '90s. But this is also glossed over, as are almost any in depth discussion of these kids' parents' multiple marriages, public affairs and other scandals. In the end, the only mildly

But Jackie you have to have some sort of standard to go by. I'm not advocating that it's ok for someone to drug a gal and rape her, you know I'm not.
