ozemail I think it is have au.com domains. Would they let you get it or do
they share similar rules ?  Its not exactly what you want but it makes life
easier and might improve the case against melbourneIT. We used a .net.au
registration to get a .com.au registration approved. The rules are different
with .net addressing. Have you tried getting money.net.au and then applying
for .com.au?
