Apart from considering the V over I concept ridiculous I think we've beaten this about multiple times. First is that you can't have a building over another building and secondly 13R say "NOT OVER FOUR STORIES." It doesn't say not over four stories except when ______ (fill in the blank). I do know of some jurisdictions around here that allow in their local ordinances for 13R for the residential portions in mixed use occupancies but only if the aggregate does not exceed four stories. On the other hand I know of two horrible "13R" apartments of eight stories on a hillside where the first three stories aren't "stories" because they're partially buried in the hillside (arguable although they are residential) and type I and the next five are stick-built but OK because the top floor is occupied "attic" space used for the second floor of the fourth floor "view" apartments (the view is of a shopping mall and Interstate 5) and sprinklered, and so it's only four stories with a "converted" (converted at the time of construction on the original approved plans) attic. The only way I can see this happening is a developer arguing with a politician and the Building Official being ordered to let this one through (this is the ecotopia of the West Coast where ,at least direct, baksheesh is not a way of life. When I asked the fire marshal how they got approved he just shrugged his shoulders and looked skyward.
