You are correct in this. IMO, To also install 9 on your new drive is just redundant, which I found can cause bigger problems. Backing up however, is a good idea. If the drive does fail, you will obviously have to replace it and your system 9. I find this a great recommendation for people who are a bit apprehensive about installing OSX on an unsupported machine for the first time. If OSX turns out not to be all that you thought it would be (don't worry- you'll love it once you get use to it & start customizing it the way you like), then one can simply boot back in 9 on the old drive and wipe the OSX drive.

If I could make the
partition smaller by subdividing it into two parts
that would give me the 6 or 8 gigs you say it should
be. If I don't need to use it for 9.1 then what would
you recomend I use the new 1 or 2gig subdivision for?

If all you have is the failed OSX attempt on this drive, then I would wipe and reformat it entirely.
You can size the first partition as the 8gigs for OSX and the rest as you see fit.

it's having any part of the partition over the 8G boundary.

You lost me on this one? - the "part of the partition" thing. Since "subdividing" any partition creates, if you're not mindful of what you're doing, a lot of dead useless space. Once the 8 gig partition for OSX has been made, the rest of the drive can be partitioned in any way desired. The number of partitions has to determined before their respective sizes can be specified. So for example, if you take a 20 gig drive, create 2 partitions, then down size one partition to 8 gigs without increasing the size of the other partition, the remaining 2 gigs from the first partition will wind up as dead unaccessible space.
