I asked about this a few months ago. I hoped to know before giving a bunch of flac files to a friend in law enforcement.
While there are a plethora of software engineers here, not one lawyer spoke up. It ended up a morality thread. Did a bunch of web research. In spite of those FBI warnings on most CDs and DVDs, it appears to be a civil matter, likely to end up better defined by case law over the next few years. There are places on the web where you can legally download lossless music files.
