IANAL but my two cents: Users always have the option of pulling from source code and building whether we are talking about podlings or top level projects. The ASF makes it clear that source control does not constitute a release and so does not have the legal assurances that users can expect from an official ASF release. However by virtue of being open source we provide the means for users to do this if they so wish.
