raj, you could buy a laptop with windows bundled (but not yet
installed until you click the EULA in acceptance)

on receiving the laptop, you choose to read the EULA clearly. even
microsoft encourages you to read it, so would any lawyer.
upon reading it, a few may just discover something in it to which they
may not wish to agree.
hence the helpful 'decline' or 'do not accept' button or equivalent,
provided by the user-friendly microsoft.
my two-bit advice:

a) ensure you have all the paper-work fully-documented. invoices, cheques, etc.
b) this is a must: you must go with independent witnesses, preferably
at the retail, and in today's age, with a camera or a camcoder, so
that when you first open your laptop, read through the EULA, and click
on 'decline' or whatever, it is clear you "never" accepted, installed,
copied, or ever used that operating system. enough witnesses from both
sides to verify this.
c) hand over your request/demand for the refund in written. just so
that everything is very clearly documented.

if i were you, i would even go with my lawyer and some technical
experts who can verify all the above in a court of law.

all this just to be triply triply sure. i am not a lawyer, but the law
is not just meant for lawyers. you just need to understand what
becomes legally cognizable without any amiguity in action or intent or
purpose.

start publicly documenting every step, and auditing the time and
effort. you could even blog about it in advance.

set that first precedent in an indian court of law.

oh well, this should work easily.
no one is against you for not breaking the law. not even microsoft.
they should and most probably will honour your request for a refund.
it's no big deal.
