Although I have no special inside knowledge either way, I don't interperate the Univeral Binary Guidelines the same way John Gruber does. What it says is, Applications built for OS 8 or 9 can not be translated by Rosetta. So what? OS X can't run applications built for OS 8 or 9 either. Classic runs those apps. Classic is an OS X app. Classic may very well run in Rosetta (or even have a native Intel version). OS 8 and 9 apps run in Classic... so in theory, anywhere Classic can run, OS 8 and 9 apps can run. Now I conceed that it is not that simple. I don't know all about Classic's magic insides. There may be issues with getting Classic to run on Intel CPUs, and that may prevent Classic from being supported by Intel based Macs. The point is, I don't see anything that clearly states either way.
