Studio and AmericanBuilt, The problem is that the open ended never intended interpretations to the meanings of the constitution are ever more leaning toward popular opinion (always, as in clothing styles) which is in a permanent state of flux.
An interpretation that says a farmer MUST sell his crop (because commerce does NOT take place) and another which upheld reverse discrimination (University of California v. Bakke now followed by the New Haven firefighter case in which the court was split 5-4 with Kennedy saying "No individual should face workplace discrimination based on race") These two rulings are absolutely opposed to one another. Then there is the never mentioned unConstitutional subrogation of powers from one Branch to another.. ie the War Powers Act. This DESTROYS the intended system of checks and balances and allows a free-for-all in Washington. There is NO consistency, no hard and fast guidelines that are followed.... just the blowing of the political wind which has so many directions it is pitiful. Democracy is a disease but what you are seeing now is an "Oligarchy": Robert Michels <http://en.wikipedia.org/wiki/Robert_Michels> believed that any political system eventually evolves into an oligarchy. He called this the "iron law of oligarchy<http://en.wikipedia.org/wiki/Iron_law_of_oligarchy>". In these systems, actual differences between viable political rivals are small, the oligarchic elite<http://en.wikipedia.org/wiki/Elitism> impose strict limits on what constitutes an 'acceptable' and 'respectable' political position, and politicians' careers depend heavily on unelected economic and media elites. Thus the popular phrase: there is only one political party, the 'incumbent' party.
