Does anyone realize the thousands and thousands of dollars in billing hours that our lawyers have charged the taxpayers in their effort to stop the Little League? My yelling and screaming at the lawyers has accomplished nothing. I have said to them that I hope Danny and the Little League sue the BOE, and if he does, I will be a witness for the Little League, and if it means I have to resign my seat on the BOE in order to do that, then so be it. If the monthly bill for the law firm comes up at tomorrow night's BOE meeting, I will ask that it be separated, so that can have the pleasure of voting against it and explaining why. [AsburyPark] Lighthouse V Long Branch - Federal Circuit Appeals Court rules
Good Morning everyone. The Appeals court reversed the December 2005 decision against The Lighthouse in part. They decided in a published opinion yesterday that The C 1 Commercial Zone ordinance of Long Branch was illegal and violated the civil rights of the Lighthouse Mission myself. We are being remanded back to the circuit court for a damages trial including legal fees. It's not a complete victory, in that they did not violate the redevelopment plan for the block because the City has put its hope of revitalization on increased retail alcohol distribution. That would be hindered as NJ State Statute prohibits Liquor Licenses within 200 feet of a church or school. We are not sure if we are going to accept that logic. In as much as it would now put drinking establishments in a place of sanctity greater than Houses of Worship! As a former retail liquor store owner in Brooklyn, I am really enjoying the comedy associated with this decision. Bottom line, when Long Branch prohibited us in 1995 they violated the Constitution of the United States and RLUIPA. So for the last 12 years we were prohibited illegally. Will we get to survive the redevelopment plans of Broadway Arts? That's the next chapter. I think the Statute NJSA 33:1-76 where the alcohol free zones are created around churches and schools may need to be addressed in a separate action. We do not care if our neighbors are retail liquor establishments! After all Jesus did make wine from water. Peace to you all. Again, speaking only for myself, the BOE has on at least three occasions voted its support for the Little League and Danny's efforts. Each and every time the law firm on who knows whose initiative has turned yes into no. (To add to my disclaimer above, I must add that I voted against this law firm but I was in the distinct minority.) This law firm acts as if we work for them and not vice-versa. Unfortunately, when they spend countless hours (and thousands of taxpayer dollars) on report after report advising the BOE that 17 hoops have to be jumped through before Danny can proceed, there are some who believe they are acting in the best interests of the kids. To me it seems like a protection racket of some kind. And most unfortunately, the new state monitor, yet another unnecessary layer of bureaucracy, backs the lawyers! The state claims to have veto power over the BOE. So I do not think you will find a single person on the board who does not support Danny and the Little League, at least I hope that's the case, but we are more and more marginalized. And, yes, I have been totally ineffective and I know it. Only in Asbury Park could this possibly be an issue. Any other town would celebrate the efforts of volunteers like Danny, not try to thwart them. I am ready to pay for the banner that can go over the entrance to the city stating Abandon Hope, All Ye Who Enter Here. I think that Asbury lacks office space big time. A well designed office building could go a long way as far as feeding some of the restaurants and other business's on Cookman that flounder during the day. I also still think that a Trader Joes would be a great idea. At this point in time, I really can't see there being the need or market for more housing. Maybe if the real estate market was sound I'd be thinking that some form of housing would be great at that location, but predictions are showing at least another dismal and scary year ahead for the housing market. The scoreboard builds confidence. Friday night, November 30 at 5:00, the Asbury Park High School Football Team plays for their section's State Championship. Asbury Park hasn't played for a Championship in 20 years, and hasn't won one in 23. The game will be held at Rutgers in New Brunswick. Please make the time to go to this game. The Asbury Park High School players will get an adrenaline boost when they hear a roaring crowd. They play against Keansburg. Keansburg is a football town, with a good program from Pop Warner on up. Make no mistake, Keansburg will fill seats at Rutgers. They won't let their players down, and neither should we. The only way to show Asbury players support is to be there. They won't know you wish them well from your homes. Let's let Asbury players beat Keanburg's numbers on the scoreboard, while we beat Keansburg's numbers in the stands. Let me tell you of three recent stories about Asbury Football that might explain why we haven't been State Champs for two and a half decades. About 7 or 8 years ago Asbury had a great team. We were 8-0 and heading for a State Championship. Then there was a complaint made to the NJSIAA, the governing body. One of our players was in a program that required him to go to tutoring. He didn't go to tutoring, because the school never offered it. So what punishment did the NJSIAA impose upon Asbury for having a student that didn't go to tutoring? They turned our 8-0 record into an 0-8 record. Bye-Bye playoffs. They didn't care about all the work every kid on the team did on that field to go undefeated. They punished everyone for an off the field infraction. They stole the season. In professional football, if you have too many men on the field it's a five-yard penalty. Throwing to an ineligible receiver is loss of a down. For the NJSIAA to wipe out a whole season and crush the hopes of all those kids and the City for an off field tutoring infraction was a giant middle finger to the City of Asbury Park. This Friday, lets give it back to them. By the way, the young man who missed the tutoring, who this whole system is supposedly set up to serve – he quit school. He never returned to High School after the ruling because he felt responsible, even though the school never offered the tutoring. What a heartbreak. I get sick thinking about it. Then a few years ago, we had a star quarterback, who the NJSIAA said could not play his whole senior year. When he was in 8th grade, knowing he was going to be a star, the High School coach let him suit up and take some snaps with the High School team, just to give him a thrill. The NJSIAA ruled that 8th grade was his first year of eligibility for taking the snaps, and you only get four - so no senior year play for him. There was a challenge to the ruling, and a settlement was made where the quarterback was suspended for two games. In a 10 game seasons, two games can keep you out of the playoffs. Then there was last year. The Asbury Park Board of Education (Bored of Education?) is notorious for concentrating on gossip, tearing people down and personnel issues. Mario, Boola, Boola, was before anybody's time! I echo your sentiment, too! Academics were the thing for me, too! Sports is the reward, for having done the work, first! Back in the 70's I saw nothing but kids who wanted to be a pro! My advice was, learn all you can, first so you enjoy the fact, that sports is the recreation deserved, for a job well done in school! I dunno, but I enjoyed cheering, knowing that, I missed the honor roll, by a few points! All A's and maybe a B+, kept me on the cheering squad! Without those grades, I was toast! No activities, except books, were it not for my fierce competiveness, in getting those grades! It guaranteed me, that I wasn't just a pretty face! My nemisis, was I had an older sister, who was skipped a grade, she was so smart! She graduated Xavier at 16, honor society, a debutante, her senior year, etc. I had to follow her example, because this was how parents raised their kids, back then. It was Be like your sister, which was no easy feat, for me. I had to put my nose to the grindstone, studing most nights until after 10PM, when there was mid-terms, etc. To my surprise, when you are a constant A student, you get exempted from certain exams, unless they are state mandated! I was one lucky kid, to have the kind of parents, I had. My father taught me Algebra, who without his help, I'd have been a bum, as the sisters would say! So no, I didn't become a bum, or the H word, so prevalent in today's society. The B and H words were for girls who didn't care about themselves. My mother said they were common! Funny, I never heard a boy say those words, only grownups used that language and rarely. I remember my Mom, calling someone a harlot and when I asked what it was, she rolled her eyes at me and said, you don't want to know! Sports are good for children. It teaches sportsmanship and discipline. How to be a member of a team, rather than a gang and making friends, for life. When an adult who could be doing something else, takes time, for kids, I call that love. It's sad, that the Little League Coach is going through something that can be made simple! Most newspapers are no longer doing subscriptions. The NYTimes stopped their special subscription months ago and even the Wall Street Journal is debating about going all free. The future of online news is free based on advertising. The newspaper companies have known that for years but kept trying to deny that it was happening. The Asbury Park Press would be nuts to go subscription. I still don't understand why every daily and weekly paper still aren't online right now...
