It is really strange that the income tax seeks the private key besides the
public.  This in effect nullifies authenticity vis-a-vis the whole concept
of digitally signing document/ e-return.  This issue should certainly be
raised with income tax officials.

The interpretation referred by Sudhanwa is the distribution of copyrighted 
product.

Legally speaking, Copyright in simpler term is a right over the intellectual 
property to prevent reproducing copyrighted work without the permission of the 
person who creates the Intellectual Property/work or any person who acquires 
right over Intellectual Property; and 

Licence on other hand is permission to use the Intellectual Property in 
specified manner stipulated in Licence agreement.

Licence agreement is the most necessary piece of legal instrument to protect 
individual's right over the intellectual property.  Any person aggrieved from 
any violation of respective work or terms of agreement may initiate legal 
action against the breacher before the courts of law.

None whatsoever.  I suspect the clause exists because of US law and
not because Indian law requires it which is why they sound so
confident about brushing it off.  Hence my repeated suspicion if it is
binding under Indian law.  Guess there's only one way to find out.

and as per section 2(nnn)Restrictive Trade practice is
(nnn)“restrictive trade practice” means a trade practice which tends
to bring about manipulation of price or conditions of delivery or to affect
flow of supplies in the market relating to goods or services in such a manner
as to impose on the consumers unjustified costs or restrictions and shall
include—
(a)  delay beyond the
period agreed to by a trader in supply of such goods or in providing the
services which has led or is likely to lead to rise in the price;
(b)  any trade practice which requires a consumer
to buy, hire or avail of any goods or, as the case may be, services as
condition precedent to buying, hiring or availing of other goods or services;]

Therefore action under consumer protection act be initiated.  No lawyer is 
needed in contesting the case, so you can choose the forum where you wish to 
initiate proceedings.
Civil Courts and as also said by Sudev, you can alternatively go before the 
Monopolies and Restrictive Trade Commission with your complaint.

Hi All,
In my opinion the decision to opt out has its god grounds but by not 
participating in the LA2007, there was an opportunity afforded to the MS to 
hack the cause of conference.  It must always be understood the control over 
the conference schedules also was given to the MS for stating their point 
and in the ultimate the lug remained the looser.

Due to the delay/deliemma, the thought of floating group for freelance 
software developer and developing profile of capable software developers too 
was co-presented by other persons, hence loss to the ilug-delhi.

a) He gets credit for the research
b) Any one using the research paper as the basis for
her research will give cerdit to original researcher
and/or will make research available under simmilar
license.

These are governed by the copyright Act, 1957 passed by the parliament of 
India.  With the rights in Act, the developer of the software (with strict 
condition that he  originally conceived the idea  expression) has the right 
over the same and enjoys the exclusive right ver the same.  Therefore the 
researcher can grant licence/permission to any person for use of the code 
with proper credit to the owner.

Now if anybody infringes the condition then he can be sued and you can claim 
the damages for the same.

Here the basic thing is that the idea/expression/software must by developed 
and published with these conditions.  This can definately sove your problem.

[ilugd] [india-gii] MCA's dicatat on e-filing

Dear Members,

To introduce my self, I am an advocate  member of ilug-delhi and of Supreme 
Court Bar.
Now proceeding to the topic, the requirement in e-filing of proprietary 
solution (Digital Signature) issued by the CA issued by the Ministries 
require all the condemnation since it promotes specific vendors with 
proprietary solutions.

In this regard, in Linux-Asia, during the presentation by the Director, 
(Technology Interface)to the President Mr V Ponraj, I suggested to introduce 
solution under open source.  Further I even sent an email addressed to the 
Hon'ble President of India.  However, till date, I have not received any 
reply.

In this regard, an action can be taken by the entire linux-delhi group by 
way of filing PIL.  However, this  requires certain preliminary steps to be 
taken.  Firstly, a letter(preferred)  email be sent to the Ministry of IT, 
Ministry of Commerce  Industries, Ministry of Finance by the secretary.  
Then after a lapse of reasonable time for action taking, PIL can be filed by 
the Linux-Delhi group.  I suggest that this action needs to be taken 
considering these facts.

I am prepared and ready to provide any assistance including legal in this 
regard.

Please Feel free to revert for initiating positive action in this regard.

Proposed Amendments to the Information Technology Act




The government of India has proposed many amendments by the Information 
Technology (Amendment) Act, 2005.  The government of India, owing to the 
recent spurt of cyber crimes  exposures, has proposed amendments to the 
Information Technology Act 2000.  Amongst the proposed amendments, major are 
:


1. Provision for technology neutral authentication mechanism : The amendment 
Act provides for Electronic Signature (however it includes digital 
signature) instead of Digital Signature as a move towards for providing 
technology neutral authentication mechanism for authentication of electronic 
records.


2. Generalising/ Broadening the definition of Cyber offences to include more 
computer related offences viz. Cyber Crimes  :  Provision for including 
cyber crimes under the head computer related offences with penal punishment 
instead of hacking of the computer by broadening the definition of cyber 
crimes.


3. Reduced Punishment  : Reduction of punishment for Cyber offences viz. 
punishment for computer related offences to imprisonment for one year or two 
years respectively and for publishing the pornography/ obscene matter on the 
electronic media to three years.  Specific enhanced punishment for child 
pornography.


4. Provision for compounding of offences : Provision for compounding of 
offences even for matters pending prosecution/ adjudication before the 
court.


5. Exclusion of liability : Specific provision explicitly reducing the 
liability for offence committed by the intermediaries.


6. Introduced provision for punishment for Invading Privacy : Punishment for 
offence of unauthorizedly recording pictures/ photographs of persons thereby 
invading their privacy.
