Yes. Huge number of people were dieing of disease from bad milk in New 
York.  Pasteurization stopped that. But that does not mean it was 
needed. The problem was the horrible conditions the cows were kept in, 
and many, or probably most, were diseased, and kept in extremely dirty 
conditions. That was the real problem, and if they had cleaned up 
their act, the pasteurization would not have been necessary.  
And this is still going on to today with irradiated meats, etc. It is 
apparently easier and cheaper to irradiate the meat, than to clean up 
"their act".

"THEIR" next move.
They would just have to say "mad cow disease" to justify wiping out an 
entire herd.

Yes, there was a bacteria problem - caused by laziness in the form of
poor sanitation in the production processes.

This could have easily been handled by - gasp - holding producers
accountable for their actions, in the form of civil, and possibly in
some cases, criminal (if the evidence supported such) prosecutions for
negligence.

But no, the - large, corporate - milk producers rallied around a bill to
allow them to minimize liability and be even LAZIER in their sanitation
practices, by simply introducing 'pasteurization' at the end of the
process as some kind of 'cure-all'.

All they had to do was implement the use of hydrogen peroxide and/or CS
at different stages of the production process - in other words, enforce
CLEANLINESS. But no, this would not have been as 'convenient', nor would
it have provided liability protection.

Of course, since anyone can sue anyone/thing anytime for anything
(pretty much), there is no such thing as total liability protection...
but as long as these producers follow the proper guidelines for
pasteurization, they are relatively safe from effective lawsuits for
poor milk quality and/or contaminants.

Before and during the second world war raw milk was readily available in our 
town from this cow or that cow in the area no one ever got sick 
...sanitation laws were past in the late 40's that outlawed chickens cows

There are a couple states where it was legal to purchase raw milk from dairies. 
 Many people purchase raw milk marked for pet consumption only.  Pasteurized 
milk has all the beneficial enzymes killed out that helps you digest.  The cows 
that are in the commercial dairies have been given growth hormones, 
vaccinations, GM grain and other things that many people want to avoid in their 
lives.  This is the reason people are fighting for legalization and choice.

Actually  it still won't be illegal,  its just that the new regulations are impossible to comply with, so there will be no raw
milk that meets the criteria.  End result is the same.
