[OSM-legal-talk] New license and mechanically created derivations
Hi, I have read a draft of the ODbL and I fear I don't understand the implications entirely... I would like to build a mechanically created non-factual work - that work will have as its input data non-factual data created by my fellow employees (we own rights to it) and OSM. (This is a virtual earth situation where I build plausible 3-d models from OSM data and rules.) Under the old scheme (assuming OSM was non-factual) I would simply put the derived result under CC-BY-SA and go home happy. :-) I can't tell what I am required to do with the ODbL. It appears that there are _no_ restrictions on how I license/distribute my derived work as long as: - I don't change the OSM data and then hoard it (I do all my edits in OSM and not later) and - My derived work isn't anything like a database. Are there parts of OSM that might be non-factual, and if so, what would the corresponding copyright-based license be? My goal here is not to see how much I can get for how little...just to understand how to use OSM data such that (1) I am following the intentions of those licensing the data and (2) avoiding legal risk to my company. If there is anything semi-official and current, please let me know and I apologize for not RTFMing...most of what I've found is at least a few months old. thanks!!! It appears that there are _no_ restrictions on how I license/distribute my derived work as long as: - I don't change the OSM data and then hoard it (I do all my edits in OSM and not later) and - My derived work isn't anything like a database. This is right (and I would be most pleased if all the edits were done directly in OSM). However, I see other plausible solutions under the ODbL: - You change the OSM data, mix it with propietary data, but never release the results to anybody (i.e. internal use inside the company only). - You do your pseudo-3D buildings, and then decide to release them to the public, along with some propietary data. In this scenario, the ODbL still applies, but the factual info license does not. As the legalese definition of database is very broad (even a dead-tree phonebook is a DB), the ODbL will stick to any computer file containing any piece of OSM data, or any pseudo-3D building, even if the file contains propietary data. In the last example, the ODbL only requires that the DB (or the file) is readable by anyone (technically, the license requires that you allow extraction of data from the DB to anybody). In my understanding, this would mean no encription, no weird DRM or copy-protection schemes, and not being tied to one piece of software to read the file (think MS Office format tying you up to MS Office). Keep in mind that the ODbL only covers the database **as a whole**. The individual nodes and ways are covered only by the Factual Info License. Are there parts of OSM that might be non-factual, and if so, what would the corresponding copyright-based license be? It is my understanding that *all* the individual pieces of data will be considered facts, as soon as the license change is over. My goal here is not to see how much I can get for how little...just to understand how to use OSM data such that (1) I am following the intentions of those licensing the data and (2) avoiding legal risk to my company. Martin Norbäck schrieb: The advantage of having a simple tagging mechanism like this is that the editors can easily prevent accidental reversal of a way, like josm does right now with oneway. There are probably other uses for this kind of scheme. And it doesn't really fit into a relation either. JOSM will already allow the reversal of tags that are direction specific. I think that was what I was saying above, yes. So it should be easy to extend it to handle the forward:/backward: prefix. I think what Shaun was saying, that JOSM already does that, too :-) It currently supports forward/backward and left/right as both prefix and suffix and both tag names and relation roles. Christoph Böhme a écrit : Would it be possible to reuse and extend the client-side code from osb for a web-based client-side interface? If it is a moral question : of course. If it is a technical question : 50% of the code has to be rewriten. So, I do not think bug reporters will ever feel the desire add tags to their bug reports. You're right. No bug reporter will feel the desire to add new tags. But when I proposed the use of tags, I thought about the clients-developper : - I want the simplier interface with only lat/lon/date, two bug states, and a text. I do not want a crapy interface with 30 text areas and 60 combo-boxes - Someone will desire to add a zoom level for each bug, the email of the authors, and three bug states - Someone else will want a reference to the OSM data, the diameter of the area that the bug describes, the age of the mother of the author, etc. The tag=value schema does all this. And, as the OSM end-user clients (like Mapnik, [EMAIL PROTECTED], routing softwares), there are only small pieces of the data that are rendered depending of the choice of the rendered. The server side already exists : it's basically OSM database without ways, with a guest account, and accepting long string values (the text users could add). That is really attractive. The only problems I can see here (apart from that we still should try to define a bug report format) are that annotations to a bug report like comments, images and attachments cannot be stored in the osm database (as far as I know). I do not think that it would be the best idea to put images in the database besides it is technically possible with a classical database ; I do not know about OSM database. An URL to a solid file seems to me much more efficient. and we'd lose out on all the fun of documenting / defining the tags on the wiki :-P And maybe, with all this complexity, we will have a new service to trac the inconsistencies in OpenStreetBugs' bugs. Hi What about defining the API first? And before defining the API we need the use cases. An other thing I would like to see are bug reports in XMPP (Jabber) Network. Think about a map that shows you a new report without polling. People could discuss immediately in a small chat window about this bug. Scalability shouldn't be a problem with XMPP. A forth possibility is to use the relation boundary where admin_level is provided: http://wiki.openstreetmap.org/wiki/Relation:boundary If two places are in the same place (e.g. Paris France - US), then it can be sorted by the lowest admin_level. And admin_level is already an attempt to give a worldwide consistent categorization: http://wiki.openstreetmap.org/wiki/Key:admin_level#admin_level Of course, this will work only if the place node representing an administive level is attached to its boundary relation (which is not said in the wiki at the moment). Considering how complicated relations feels I'm asking here instead of just changing the wiki: http://wiki.openstreetmap.org/wiki/Relation:restriction So in the scheme *in use* today you say no left turn, to:way2 from:way1, and then in the routing programs/rendering applications need to calculate what that means. At T junctions the ambiguity is resolved using restriction=no_left_turn/no_right_turn. Where slipways join bidirectional roads (at high speed), the ambiguity is resolved with restriction=no_u_turn (only_straight_on ). At 4 way junctions you should one of the ways (making 2 Ts). Some people want us to split ways whenever an ambiguity arises, but it will mean we have to split a number of major roads at every little intersection where a service road joins. So a better solution would be to resolve the ambiguities with tags like from/to_direction=forwards/backwards (unimplemented). Routing engines already need to know about forwards / backwards. Whatever follows after no_ or only_ can be used to paint nice matching signs on a map or to give voice commands, but should not be used to identify which ways the restiction applies to!

A mon avis. -- sly ___ Talk-fr mailing list Talk-fr@openstreetmap.org http://lists.openstreetmap.org/listinfo/talk-fr
