This fix breaks binary compatibility but only at package private

stopped buggy FETCH response crashing evolution so but i won't have

Commons Logging 1.1 has been in development for 18 months. It has now
reach it's 8th release candidate and it's second release VOTE. It's a
long road but I'm convinced that the effort will prove worthwhile.

remy ran a regression test for RC6 (thanks :)
we no long ship the jdk logger in API jar. however, tomcat uses jdk
logger as it's default. so, by excluding the jdk logger, JCL 1.1 is no
longer a drop in replacement at least for tomcat.
