I guess I'd like to understand why Sun is allowed to do this.

I don't, but one of the great things about OpenSolaris is that it
frees us to be engineers while Sun can go and deal with its own
problems for Solaris only.  We should not be subjecting ourselves to
Sun's byzantine and paranoid ideas about export control.

Does the OGB need to consider this issue?
