and your lawyer would (probably, IANAL) say "huh, you want to take legal
action against some unknown person who might be anywhere in the world...
yeah... right..."

if you can track them down and the spammers are abusing a registered
trademark, then you might have some chance... but i fear you'd need
resources in amounts comparable to AOL or microsoft to get anywhere... if
you don't have a trademark, on what grounds are you going to sue them?
