Andrew Alston's email indicates that there is at least one existing ipv6 network deployment where this is not the case. It is unlikely that this is an isolated example: there's no shortage of brownfield ipv6 deployments on the internet.
As a general comment, protocol specification is about ensuring wide-scale interoperability, so redefining well-known semantic constructions is something that's likely to cause difficulties. The lower in the stack you go, the more likely you are to run into problems.
