Probably not. He'd be charged under the Mercenaries act - its a Spanish Civil War era law intended to stop Canadians from fighting overseas for foreign governments or revots. Problem is that once that's enacted what's to stop the thousands of Canadians who served in Vietnam in the US army from being charged as well, or those currently serving with the US. As for treason, it wouldn't necessarily apply. Over all I suspect that this is part of the reason why the Canadian government isn't really involved in the case. They'd rather let the US do Canada's dirty work so to speak.
