And how would you fell if that restaurant had a sign that said "No
shirt, no shoes, no service" and you entered wearing a blue shirt, jeans
and tennis shoes. Then the owner said to you, "Because we noticed that
most people that rob restaurants are wearing jeans, we decided today not
to allow anyone wearing jeans to enter. You understand don't you?"

Are you nuts? When someone sells you a service they put whatever
limitations
they want. Just like when you go to a hotel restaurant and they say...
No
Shoes, No Shirt, No Service. You don't have the right to say you will do
what you want on a network just because you believe you are entitled to.
If
your ISP lets you run servers then fine if you have read your TOS and
you
are permitted to. However if you have residential service, and your TOS
says
you can't run servers then you are stealing from your ISP.
